HomeMy WebLinkAbout1221A By-law to authorize additional street lighting on the roads and highways of the Corporation of the Township of Clarke and to authorize a special rate upon taxable property to cover operating and capital costs incurred under the Street Lighting Agreement between resident freeholders of the Township of Clarke and the Hydro Electric Power Commission of Ontario.

NOW THEREFORE the Municipal Council of the Corporation of the
Township of Clarke enacts as follows:
(1) That the Corporation do make applicable the said Street
Lighting Agreement to the said additional area, which may be more
particularly described as the blocks or part blocks as set out in
Exhibit "B" hereto attached.
all in the said Township, as shown outlined in red on the sketch marked
Exhibit "A" hereto attached and forming part of this By-law, and which
is known as the Hamlet of Kendal.
(2) That the said additional area be lighted by that number

of street lights on those highways therein which are specified in the
following list, namely:-

as shown on the said Exhibit "A" and in addition by such further street
lights on the said highways and on other highways in the said additional
area as shall be requested by the Council by notice in writing to the
Commission from time to time;
(3) THAT all lighting of highways in the said additional area and
all street lighting works therein be under and be governed by the said
Street Lighting Agreement as if the said additional area had been origin-
ally described in the said Street Lighting Agreement AND that the Corpor-
ation pay the Commission for the Lighting of highways in the said
additional area in accordance with the terms of the said Street Lighting
Agreement;

(~+) THAT ~G of the cost incurred under the said Agree-
ment for Street Lighting in the said additional area herein described
be raised, levied and collected by an annual special rate upon the
taxable property lying within the said additional area;
(5) THAT ~~ T of tree cost incurred under the said Agree-
ment for Street Lighting in the said additional area herein described
be paid by the Corporation at large and be chargeable to the Municipality
as a whole:

Kendal as outlined in red on Exhibit A to comprise Blocks
K,. L, M, N, 0, P, Q, R, S, T, U, V, and X as shown on the
registered plan of Kendal; also that portion of Block H
fronting on Monck Street east of lot 5 a distance of 307
feet with a depth of 72 feet; also that portion of Block
A on the south side of Water Street shown as lots 1 and
2, together with plot adjoining the east side of lot 2
having a frontage of 2$7 feet on Water Street and depth
of 165 feet.
