THE CORPORATION OF THE TOWNSHIP OF CLARKS
BY-LAW NUMBER # 17K5 ~ '
Whereas under By-Law #1736 the Council of the Township of
Clarke authorized the transfer to and assumption by the Home Smith
Properties Limited of a subdivision agreement adopted under By-Law
#1655 and
Whereas for the sale of such transfer and assumption subsequent
conditions were required from Home Smith Properties Limited and
Whereas in a letter dated August 2nd, 1972 Home Smith Properties
set out these additional conditions and undertook to perform them, and
Whereas Henry DeWith, Acting Clerk and Clerk-Treasurer of the
Corporation of the Township of Clarke by letter tp Fdome Smith Properties
Limited, dated July 14th, 1972 listed a series of eight (8) conditions,
also which were to form part of the assigned Agreement, and agreed to
Home Smith Properties Limited granting of additional lands and to Home
Smith Properties Limited grading of the same, for a playground, the
condition proposes in return for deleting that Home Smith Properties
Limited pay ten thousand dollars ($10,000.00) in cash as under sub-
division agreement condition #27.
NOW THEREFORE COUNCIL OF THE TOWNSHIP OF CLARKS ENACTS AS FOLLOWS:
1. That the terms 1 through 9 inclusive in the letter dated the 2nd
of August 1972, and sent from Home Smith Properties Limited to B. W.
Collins, Clerk Administrator of the Township of Clarke and a copy of
which is annexed hereto, and the terms 1, 2, 3, 5 and 8 of the letter
from Henry DeWith, Acting Clerk of the Township of Clarke to Home Smith
Properties Limited dated July 14th, 1972 a copy of which is hereto
annexed, be incorporated into the subdivision agreement authorized by
By-Law #1655.
2. That said terms should be read mutatis mutandis with the agreement
where possible, and where they conflict such terms will be read as
being paramount.
3. That Home Smith Properties Limited are and is hereby absolved from
paying the Ten Thousand Dollars ($10,000.00) referred to in term #27
under the subdivision agreement, in so far as they have transferred
Block "F~' to the Township of Clarke and graded said Block r~Fn for play-
g~ound purposes.
