HomeMy WebLinkAbout1728A By-Law for permitting and regulating the size and mode of construction of culverts situated on a Highway. expedient to regulate the materials used, manner of construction, and payment of cost for the construction of private driveway or entrance culverts; AND WHEREAS the authority for the works herein are to be undertaken under the terms of The Municipal Act, R.S.O. 1970, Chapter 2$t~, S. 352, S.S. 20, and amendments thereto; The Council of The Corporation of the Township of Clarke enacts as follows: 1. All persons requiring an entrance onto any road under the jurisdiction of the Township of Clarke shall make application to the Road Superintendent of the Township of Clarke for the supply and installation of entrance culverts. 2. The Road Superintendent or his agent shall determine if a culvert is necessary in conjunction with the entrance applied for. 3. The Building Inspector of the Township of Clarke shall not issue a building permit to an applicant until he has received a copy of the Entrance Culvert Application and Work Order duly completed. l~.. Upon receiving any application the Road Superintendent or his agent shall determine the type and diameter of culvert that shall be used. 5. No person shall install or allow to be installed any culvert ~n a road in the Township of Clarke without having made application under this By-Law and having secured the approval of the Road Superintendent. 6. No culvert other than that approved by the Rosd Superintendent shall be used within the Township and not so as to restrict the generality of the foregoing but for purposes of clarification the requirements shall be interpreted to preclude the use of boiler pipes, water main, wood plank, concrete block or any unsatisfactory material. 7. The minimum size of a culvert that may be installed shall be twenty-two feet (22t) in length by fifteen inches (15`ta in diameter. $. Where a culvert in excess of 50 feet in length is requested the applicant shall be required to pay the entire cost of constructing as many catch basins as may be necessary in the opinion of the Road Superintendent to facilitate surface drainage from the roadway. 9. Where a person has installed or allowed to be installed any culvert other than that approved by the Road Superintendent then that person shall be notified of the condition and requested to remove the culvert. Should the removal of any unsatisfactory culvert be not completed within 30 days of receiving notification then the Road Superintendent may direct a Road Employee to remove the culvert and the person shall pay the full cost of such removal. 10. Where a culvert has been installed in accordance with the provisions of this ~y-law then the Township of Clarke shall assume all future maintenance of such culvert. w, s , ~ r~.. 11. Where an entrance culvert is required the applicant shall pay to the Township of Clarke the cost of the culvert together with the installation charges as follows: (a) minimum installation charge is ~1+l~.00 plus the cost of culvert pipe (b) culverts in excess of minimum size shall be charged at the rate of $2.00 per lineal foot plus the cost of culvert pipe (c) installations requiring more than 3 loads of gravel or fill, the applicant or owner shall be charged for the cost of the extra gravel or fill 12. All applications are subject to the hereinafter noted conditions: (a) A nonrreturnable application fee of X10.00 shall accompgny each ap-plication for entrance permit. If the application is completed and paid within 90 days, the X10.00 application fee will form part of the approved cost. (b) Permit applications will expire after 90 days from date of issue if approved cost has not been paid by applicant. (cj Permit applications will expire after 1 year from date of issue if approved cost is paid by applicant but culvert not installed, save and excepting where the installation is delayed by reason of reconstruction of~ subject road. Where approved cost of entrance has been paid by applicant and the permit has expired, the approved cost, less $10.00 application fee, will be returned to the applicant. (d) Entrance Culvert ~-pplication and Work Orders are not transferable except those that have been paid for and installation completed. 13. Any person wha contravenes any provision of this Bylaw shall upon conviction be liable to a penalty not exceeding X100.00 recoverable under The Summary Convictions Nct. 1l~. By-Law No. 1162 be and is hereby repealed. Read a first and second time this / s~day of February 1972.
