HomeMy WebLinkAbout1706A By-Law of the Township of Clarke regarding the maintenance, management, regulation, control and taking over of a certain cemetery. WHEREAS the former Presbyterian Cemetery in the hamlet of Newtonville in the Township has been unused for over thirty years, and is now in a poor state of repair, and can be considered abandoned; AND WHEREAS the Newtonville congregation of the Presbyterian Church in Canada was at its request dissolved on the 13th day of September, 1955 and the church abutting the cemetery is no longer an existing congregation of Presbyterian Church in Canada; AND WHEREAS extensive discussions have been carried on with The Department of Financial and Commercial Affairs Cemeteries Branch and Messrs. Cassels, Brock, Barristers and Solicitors, of Toronto who act for Presbyterian Church in Canada; Church in Canada AND WHEREAS PresbyterbnAh3s agreed to pay the Township the sum of X2,105.72 which funds are funds held as a result of the sale of the church building proper but are being treated as cemetery trust funds; AND WHEREAS following extensive negotiations between the Corporation of the Township of Clarke and the Trustee Board of the Presbyterian Church in Canada through their Solicitors it has been agreed that upon payment of the sum mentioned above the Township will assume the lands described fully in Appendix erArr to this By-Law under their power to assume abandoned cemeteries with the necessary approval by provincial authorities; AND WHEREAS the said cemetery has been commonly referred to as Newtonville Presbyterian Cemetery and is part of Lot $, Concession 2; BE IT THEREFORE ENACTED by the Municipal Council of the Township of Clarke that: 1. The Cemetery herein described in Appendix F'A~t hereto attached shall, according to the provisions of The Cemeteries Act, R.S.O. 1960, Chapter l~.7, be taken over by the said Township of Clarke.
