WHEREAS the Municipal [ict being R.S.O. 1960 Chapter ~J+9 provides that
the Council of any municipality may, subject to the provisions of the
Highway Traffic xct, Chapter 17~, pass a by-law designating through
highways;
xND WHERExS clause ~6 of subsection 1 of section 1 of The Highway
Traffic xct provides that:-
"through highway' means any highway or part of a highway
designated as such b~ the Minister or by by-law of a
municipality approved by the Department, and every such
highway shall be marked by a stop sign or yield right-of-
way sign in compliance with the regulations of the Depart-
ment;
AND WHEREAS section 65 (a) of The Highway Traffic Act provides for
the erection of stop signs at intersections on highways under its
jurisdiction;
NOW THEREFORE the Council of the Corporation of the Municipality
of Clarke enacts as follows:
1. The following highways or parts of highways under the juris-
diction of the Municipality of Clarke are designated as through
highways:
(1) Concession Road No. 3, from the east side of Provincial
Highway No. 35 ~ 115 to the west side of Morgans Road
more particularly described as follows:~ that part of the
road allowance between Concessions 2 and 3 in the Township
of Clarke lying between the easterly limit of Highway No. 35
~ 115 and extending in an easterly direction to the
easterly limit of Lot 17.
(~) Concession Road No. 5, from the east side of Provincial
Highway No. 35 £~ 115 to the east side of the sideroad
between Lots 22 £~ 23, more particularly described as
follows:- that part of the road allowance between
Concessions 4 and 5 in the Township of Clarke lying between
the easterly limit of Highway No. 35 £~ 115 and extending
in an easterly direction to the westerly limit of Lot 22.
2. The designation in section 1 of this by-law of a highway or
part of a highway as a through highway shall not include any
intersection thereon where the road intersected is a Kingts
Highway or where traffic control signals are installed.
3. This by-law shall become effective when
(1) properly worded signs have been erected and are on display
(2) approved by the Department of Transport.
