WHEREAS Zoning By-Law No. 1592 was passed by the Municipal Council
of the Corporation of the Tov~~nship of Clarke on the 23rd day of May 196;
AND WHEREAS the Clarke Planning Board has made a general review of
the provisions of the By-Law and has .recommended to the Municipal_ Council
that certain amendments be made to the said By-Law;
AND WHEREAS the Municipal Council upon the recommendation of the
Clarke Planning Board deems it advisably to amend the said By-Lai^r;
NOW THEREFORE the Municipal Council of the Corporation of the
Township of Clarke ENACTS as follows : -
1. That SECTION 2 of By-Law No. 1592 is hereby amended by adding the
follouring after SECTION 2.13:
2.13 A Public Garage: moans and includes a building or place where
motor vehicles are hired or kept or used for hire, or where
such vehicles or gasoline or oils are stored or kept far
sale, or a building or place used as a motor vehicle repair
shop (but does not include an auto body repair shop] or for
washing or cleaning motor vehicles, but does not include
any business use othert~rise defined or classified in this
By-Law.
2, That SECTION 2.15 of By-Lai^r D?o. 1592 is hereby amended by adding at
the end of the third lino and after ~,esc~rh .~„ in a the follo~~ri_ng:

3, That SECTION 3.1 of By-Law No. 1592 is hereby amended by inserting
between Commercial. rtCn and Industrial t~Mltt under Zone and lone Svmbol

This By-Law shall not be effective to reduce or mitigate
~tny restrictions lawfully imposed by a governmental
authority but in such cases the greater restriction
shall apply.
5. That SECTION 3.~ of By-La~~r No. 1592 is hereby amended by deleting
ttdefined by the Township of Clarke or by any local Board thereofrr~
h, That SECTION x..1.1 of By-Lai? No. 192 is hereby amended by addir~
thereto at the end of the first line after add f~Rl'~, and after
or.° %n the second line delete the F~Rr~.
7. That SECTION 5.5 of By-Law No. 1592 is hereby am°nded by adding
thereto at the end of the sentence after ~.^rP1l ~n~ - ~tshall be

~?, That SECTION 5.6 of By-Lat^~ No. 1592 is hereby deleted.
a, That Table II of By-Law No, 1592 is hereby amended by adding
~~Minimum Rear Yard 35 ft .1/, and deleting the word ngrou.ndt~ from
Minimum floor area.
10. That Table III of Ry-Law No. 1592 is hereby amended by adding
nMini_mum Side Yards 25 ft . it rrMinimum. Rear Yard 35 ft . et .
1.1. That SECTION 6.2 of By-Law No. 1592 shall be amended by re-v~rordin~_
to read t~No Shopping Centre shall be established except by a
rezoning for this specific use.E~.
12. That By-Law No. 1592 is hereby amended by inserting immediately after
SECTION 6 A - HIGHWAY COMI~?ERCIAL nHC~t:
6 A.l Highwav Commercial Zone Permitted Uses:
T?o person shall use land or erect or use a building or

`- structure in a High~~ay Commercial Zone (HC) except for
one or more of the follo~^~ing purposes subject to SECTION
3 ~ GENERAL PROVISIONS:
(a) Restaurants, Sporting Goods Service Centre, Public
Garages, Service Stations, Hotels, Motels, (with E
or without restaurant faciliti.es), Car Wash Stations,
Commercial NllrSerleS.
(b) Notwithstanding any provisions of this By~Law to the
contrary, the o~mer of a Commercial operation i_n the
HC Zone may erect a caretakers residence in the same
lot, which shall conform to Table II of By~Law No.
1592 or an apartment above the first floor to a minimum
of 600 sq. ft, exclusive of halls and stairways.

13. That SECTION ~'.1 (b) of By-~Law No. 1592 is amended by adding
"conservation areasn.
11~.. That SECTION 10 (a)(i) of By-Law No. 1592 is hereby amended by

15. That SECTION 10 (b) of By-Law No. 1592 is hereby amended by altering
't(a)« before zone to rr(A)tt.
l6. That Schedule ~tAn o_f By-Law No. 1592 shall be amended by adding ~tOS~~
symbol to the Department of Lands and Forests, and adding United
Countiest Durham Reforestation and the ~~OS'1 symbol to the Ganaraska
Conservation Authority.
17 • That Schedule ciA-t of By-La~~~ No. 1592 shall be amended by changing
from. Development .Zone etDn to a Highway Commercial Zone °tHC'! the area
as shot^an on Schedule s~An.attached hereto and more particularly shown
in the plan of survey attached hereto as Schedule ttBit.
1F~. This By~La~s~ shall take effect from the date of passage by Council
and shall come into force upon approval by the Ontario Municipal
Board.
That By-Law No. 1602 be and the same is hereby repealed.
