HomeMy WebLinkAbout1615A BY-LAW for the purpose of acquiring by expropriation certain land which is required for the widening and improving and grade separation over The Canadian Pacific Railway between Lots 8 and 9 in the Broken Front Concession (Range B), Township of Clarke.
WHEREAS for the purposes of widening and improving and providing
for adequate grade separation over the Canadian Pacific Railway
between Lots 8 and 9, Range B, Concession Broken Front, Township
of Clarke, County of Durham, The Corporation of the Township
of Clarke finds it necessary to acquire by expropriation the land
shown on the plan of survey annexed hereto as Schedule "A" and
Schedule "B".
AND WHEREAS in accordance with the provisions of The Municipal
Act R.S.O. 1960 and the Expropriations Procedures Act, 1962-63,
The Expropriation Procedures Amendment Act 1965 and The Expropria-
tion Procedures Amendment Act 1966, the Corporation may expropriate
land for the said purposes:
NOW THEa-BEFORE, BE IT ENACTED by The Council of The Corporation of
The Township of Clarke as follows:.
1. THAT the land in heavy outline on the Plan of Survey
annexed hereto as Schedule "A" and Schedule "B" shall be
and is hereby acquired for the purposes of widening and
improving and grade separation over the Canadian Pacific
Railway ou the Newtonville Road between Lots 8 and 9
Range B Concession Broken Front, Township of Clarke,
County of Durham.

2. THAT for purposes of said expropriation (a) a plan
suitable for registration and acceptable to the Registrar
of the West Riding of the County of Durham shall be duly
completed by M.D.Brown', .Ontario Land Surveyor.:;
(b) The Reeve and Clerk for the Corporation of the
Township of Clarke are hereby authorized and directed
to sign the said plan and to affix the seal of The
Corporation thereon, and
(c) Said plan shall be duly tendered for registration in
the Registry Office for the Registry Division of the
6'Vest Riding of the County of Durham.
