HomeMy WebLinkAbout1497Being a By-Law to provide for the widening and improvement of certain roads described herein and for the expropriation of certain lands required therefore.
WHEREAS the Corporation of The Township of Clarke has
undertaken to improve and widen the following roads all in
the Township of Clarke in the County of Durham being descri-
bed as follows;
Road A - A Road Allowance known as Morgans Road. and
being 2.65 miles of road in the area west
of the Hamlet of Crooked Creek and being
the road allowance between Lots 16 and 17
in the secor_d and third concessions.
Road B - A Road Allou~ance 4 miles in length in total
and lying between lots 4 and 5 ire concessions
six, seven and eight; and abutting lots 5
to 9 inclusive in the eighth concession and
between lots 8 and 9 in the eighth conges-.
sion.
Road C - A Road Allowance known as the Leskard Road
being 2.'] miles in length and lying between
lots 30 and 31 in concessions six and seven.
Road D - A Road Allowance being 2.5 miles in length
abutting lots 16 to 26 inclusive and lying
between the fifth and sixth concessions.
Road E. - A Road Allowance adjacent to a structure
referred to as The Kimball Bridge and being

AND WHEREAS an agreement has been reached with certain
land owners of land required for the said pro~eet and has not
bean reached with certain other land owners as to the compen-
sation to be paid for the lands required
AND WHEREAS the Council of The Corporation of the Town-
ship of Clarke deems it expedient to expropriate the lands
of the owners for which compensation has not been agreed upon
using the procedures of expropriation as set out in the
Expropriation Procedures Act RSO 1962-63, Chapter 43
NOW THEREFORE pursuant to The Municipal Act RSO 1860,
Chapter 249, Section 459 (1) (b) and 333 (1), the Council of
The Corporatior_ of The Township of Clarke hereinafter referred
to as the "Corporation"
HEREBY E~?~CTS AS FOLLOWS:
1. The Corporation hereby expropriates the fes
simple and all right, title, claims and
interest of the owners and mortgagees in the
lands and premises as set out on the plan
of survey shown as Schedules A, B, C, D,
etc., annexed hereto and prepared by M.D. Brown,
O.L.S. or Donevan and Fleischmann, O.L.S.,
dated as shown, the lands to be expropriated
being shown thereon.
2. The Corporation hereby authorizes the Clerk
to forward written instructions to the said
M. D. Brown, O.L.S. and Donevan and Fleischmann,
O.L.S. to prepare and file a plan of the said
lands expropriated hereb;r, the said filing to
be in accordance with The Expropriation Pro-
cedures Act, RSO 1962-63, Chapter 43.
3. The Corporation further instructs the Clerk
to take such additional steps as are neces-
sary in accordance with the procedure as
set out in The Expropriation Procedures Act.
4. The Corporation, its workmen, servants, em-
ployees or contractors, or employees, work-
men or servants of its contractors, are here-
by authorized to enter upon the said lands
for the purpose of carrying out the said road
widening and improvement.
5. Notwithstanding the foregoing, the Reeve and
the Clerk are hereby authorized and directed
to negotiate with the owners and mortgagees
and any other persons concerned to settle
the compensation to be given for the said
lands, provided that the amount and nature
of such compensation shall be confirmed by
