HomeMy WebLinkAbout1458A By-law respecting licences for Nursing Homes. The Council of the Corporation of the ?ownship of Clarks enacts as follows; I. In this Hy-law (a) "Board" means the Local Hoard of Health for the Northum- Berland ~ Durham Health IInit, (b) "nursing home" means eny premises in which persona are cared for or lodged for hire where, in addition to sleep- ing accommodation and meals, personal cars, nursing services, medical oars .and treatment are provided or made available, (c) "occupier" means the person who operates a nursing home under this By-law, (d) "personal cars" means personal services such es the pro- vision of ai8 to residents in walking or in climbing or descending stairs, in getting in or out of bed, in feeding, dressing, bathing or in other matters of personal hygiene, and includes the preparation of special diets, the provision of tray service for meals, the supervision of medication and other similar types of personal assistance, (~) "resident" means a person who is cared for or lodges for hire in a nursing home. 2. No person shall, within the limits of the Township of Clarke, operate a nursing home unless or until he has obtained a licence therefor from the Clerk of the Township of Clarke. 3. A fee of X25.00 shall be paid by the occupier for the licence issued to him. 4. Eeoh licence shall be issued in respect of a specified location and the licence shell not be used by the occupier for a location other than the one specified therein. ., :. ( ~} y. Each lioenoe shall be issued in respeot of a specified number of persons and the occupier shall not permit a number of persons greater than that specifi®d in the licence to be eared for or lodged for hire at the location in respeot of which the livenoe is issued, 6. Every applicant Por a licence or renewal of a lioenoe to operate a nursing home shall submit a written application in which he shall state: (a) the name and address of the applicant; (b) 1©cation of the premises for which the licence is sought; (c} the number of rooms used for sleeping accommodation by the residents and the number of beds in each; (d) the mazimum number of residents which the applicant proposes to accommodate at one time; (e) the number of bath-tubs or showers, wash-basins and flush toilets available for use by the residents; (f) such other information ss the Board may require. ']. Ea~oh applicant for a licence or renewal of a licence shall be accompanied by (a) a certificate of an officer authorized to inspect buildings under The Fire Marshals Act certifying that the premises have been inspected by him within 3 months of the date of application and that they are reasonably safe from fire hazard;. and (b) a certificate of the Medical ©fficer of Health certifying that the premises have been inspected by him or his representativ® within three months of the date of the application, and that, in his Opinion, they are in reasonable compliance with the requirements of this By-law. -. (3) 8. The occupier shall provide sleeping accommodation for residents in rooms with a minimum of (!t) 400 cubic feet of air space and fifty square feet of floor space for each person under siateea years of age, (b) 600 pubic feet of air space and seventy-five square feet of floor space for each person sizteen years of age and over, and each room so used shall contain at least one window opening directly to the outside air, and the size of the window shall be not less than 10 per Dent of the floor area of the room and shall be capable of being opened or closed at all times. 9. Sleeping accommodation shall not be provided in any space in the premises used as a lobby, hallway, closet, bathroom, stairway or kitchen. 10. The occupier shall provide toilet and bathing facilities which are readily accessible to all residents with a minimum of one wash-basin and one flush toilet for every eight residents and one bath-tub or shower for every twelve residents. 11. The occupier shall not admit or retain as a resident any maternity case, or any person who requires treatment for alcoholism, drug addiction, mental illness or disease, or any person who requires active medical or surgical Dare or treatment of a kind usually provided in a hospital. 12. The occupier shall (a) provide for nursing services for residents by or under the supervision of a registered nurse, and (b) ensure that medical Dare and attention are made available by a duly qualified medical practitioner to residents ®s required. ( 4 ) 13. The occupier shall employ such persons who are in th® opinion of the Board of the Medical Officer of Health su~'~'icient in number and qualified to provide th® nursing services and personal care required by the residents. 14. The ocoupier shall provid® (a) nourishing m®als at regular intervals and apeoial diets, where required, prepared by or under the supervision of a comp®tent person, and (b) adequate and sanitary supplies of milk and drinking water. 15. The occupier shall keep or ©ause to be kept a register of pars©ns resident in the nursing home which shall set forth (a) the name, age, see and former place of abode of ®ach resident, (b) the date and circumstances of his admission to the home, (c) a r®cord of all medical eaaminations after admission, the diagnoses and orders of duly qualified medical practitioners, and the medicines, medications sad treatments prescribed or administered. (d) the date, the circumstances of his discharge from the home and th® name and address of the person or institution in whos® Dare or to which he was dis- charged, (~) in the event of the death of the resident, a record of the circumstances of the death and the name and address of the person claiming the body, and (f) such other additional information as may be required by the Medical Officer of Health. 5 16. The occupier shall maintain .the nursing home in a thoroughly glean, safe and sanitary condition, and without limiting the generality of the foregoing, he shall ~a) eliminate fire hazards including the provision and maintenance of (i) protection tom radf;ntars or other heating equipment, (ii ); water supplies adequate for all normal needs including those of fire protection, and (iiij at least two separate means of egress to the outside from Floors with sleeping accommodation; (b) maintain a minimum temperature of 68 degrees Farenheit in the nursing home from the 1st of October to the 31st of May; (c) have the premises inspected at least once in every sin months by an officer authorize8 to inspect buildings under The Fire Marshals Act; (d) have the premises inspected at least once in every sin months by the Medical Officer of Health or his representative; (e) keep all parts of the building fre• from rubbish, garbage, ashen, flammable materials and other debris; (t) keep the cellar of the nursing home well drained an8 ventilated; (g) keep the nursing home weatherproof, free rrom dampness, adequately heated, and all heating equipment in good repair; (h) maintain adequate kitchen equipment and facilities to ensure the proper preparation and protection of food; (1) take all necessary steps to keep the building free t'rom vermin, insects and pests. ~'~r ~ 6 y 1?. The Medical Officer of Health or his representative, an officer authorized to inspect buildings under The Fire Marshals Aot or any employee of the Corporation required to administer or enforce the provisions of this By-law may enter n nursing home at eny and all resonable times for the purpose of inspecting the premises and every part thereof to ascertain whether the provisions oP this By-law are being or have been complied with and it shall ba an offence for any person to prevent or obstruct any such official from carrying out his duties under this By-law. 18. In every nursing home, the licence shall ba posted in a conspicuous place in the lower hallway, and a printed copy of this By-law shall be made available by the occupier for azamination upon the request of any resident in the nursing home. 19. The Board may at any time revoke any licence issued under this By-law, and notice thereof shall be given by the Board by registered letter mailed to the occupier at the address in respect of which the licence was issued. 20. Each licence shall be in force for one year from the 1st day of June to the 31st day of May. 21. Any occupier or other parson concerned in the management of a nursing home who is guilty of an;,~offence under this By-law shall on summary conviction be liable to a penalty of not more than #50.00 for each offence. 22. This By-law shall take effaot on and from the lst day of September 1964. 23. By-Law No. 1324 be and is hereby repealed. Read a first and second time this ~~ day of Sr.~..N~s~. 1964.
