'~'~iEREAS the Corporation of the Township of Clarke proposes to either construct, reconstruct, extend or improve the following capital works in the municipality in accordance with the pro- visions of the lt?~unicipal ?Works Assistance Program., ~~?D ??9?iEREAS for that purpose the Corporation proposes to make annlication for assistance in accordance with the terms of The ~~unicipal forks Assistance Act (Ontario) and the ~!iunicipal Develop- went and Loan.Aet (Canada), A1\TD ~.'7~-?E'RE_4S the projects are in the opinion of the Council of the Corporation municipal projects qualified for assistance under the said Act as they would not, .without the assistance rendered under said Aet, have been included among the capital works pro~eets to be undertaken within the calendar years in respect of which the application for assistance will be made, 1~TD RE.AS the works herein are to be undertaken under the terms of The l~.?unicipal Act, R.S.O. 1960, Chapter 249, 5.459, ss.1(b), a.nd amendments thereto; T?0~"I, Th'F,REFORL', P.E IT ENACTED .~~TD T'?' TS HEREBY EIT,~CTED as a by-law of the Corporation of the Townsb.ip of Clarke by the Council thereof as follow s:~ 1. The following roads including Bridges and Culverts and ancillary buildings shall be constructed or reconstructed in the following locations at the following estimated costs, the details of such projects being recited in detail in a report made by '_"otten, Sims and Associates Ltd. dated at the Town of ~Phitby the 15th day of March, 1965 and summarized for purposes of this by-law as follows: Pro~eet Description Location Estimated Cost A. The Engineering Consultant for the Corporation of the Township of Clarke in this matter shall be Totten, dims and Associates Ltd. 306 Dundas Street ~Yest ~'Phitby Ontario and they shall forthwith make such plans, profiles, and specifications and furnish such informa- tion as may be necessary for the making of a eantraet for the execu- tion of the work. Such plans and specifications to clarify in detail the works already outlined in their preliminary report dated 15th day of March 1965. 3. The work shall be carried on and executed under the superinten~ Bence and according to the direction and orders of such Engineering Consultants. 4. The Reeve and Clerk are authorized to pause a contract for the construction of each and every work or any combination thereof to be made and entered into with some person or persons, firm or corporation, subject to the approval of this Council to be declared by resolution. 5. For the purposes aforesaid the Corporation of the Township of Clarke shall borrow upon the general credit of the Corporation a sum sufficient to finance their portion of the said works which sum shall not exceed28,488.00 and shall issue debentures, there- fore, when duly authorized and approved. 6, The Treasurer may (sub~eet to the approval of the Council) agree with any bank or person for temporary advances of money to meet the cost of the work pending the completion of it at a rate of interest not to exceed five and three-quarters per cent (5g~.) per annum. Z. l~lny debentures to be issued (save those to be issued to the Province of Ontario) for the loan to be effected to pay for the post of the work when completed shall bear interest at five and three-quarters per a®nt (5~~0) per annum and be made payable within 5 years on the instalment plan. 8. The debentures to be issued to the Province of Ontario for the loan to be effected to pay for the cost of the work when completed shall bear interest at fine and three-eighths per cent (5-3/8'f,) per annum and be made payable within 5 years on the instalment plan. g In settling the seam to be raised annually to pay the debt the rate of interest on investments shall not be estimated at more than 5-3/~~o in respect of the debt incurred to the Province of Ontario and 54~ in respect of the debt incurred to others.
