Subject: ASpgN SPRINGS SUBDIVISION. PHASE 1, PLAN 40M-1686,
CERTIFICATE OF ACCEPTANCE, STORM SEWER SYSTEM
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:.
1. THAT Report WD-64-94 be received; and
2. THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the storm sewer system
constructed within Plan 40M-1686.

2.0 BACKGROUND
2.1 On September 5, 1991, the former Town of Newcastle entered
into a subdivision agreement with Martin Road Holdings Limited
and West Bowmanville Developments Ltd. to develop lands by
plan of subdivision, located in Bowmanville, and described as
Plan 40M-1686 (Attachment No.l). The agreement required the
developer to construct all roadworks including hot-mix paving,
curb. and gutter, sidewalks, boulevard sodding and street
trees, a storm drainage system and street lights, hereinafter
referred to as the 'Works'.

2.2 The subdivision agreement provides for the separation of the
Works into five (5) stages:
a) Storm Sewer System;
b) Roads and Above Ground Services;
c) Tributary Stormwater Manaaement Works;
d) Water Quality Works; and
e) CPR Underpass Works
2.3 'The Storm Sewer Svstem was completed and a 'Certificate of
Completion' was issued dated January 31, 1992. The system was
placed on a two (2) year maintenance period which expired on
January 31, 1994. The works were subsequently re-inspected
and all deficiencies have now been corrected to the
satisfaction of the Director.
2.4 it is now appropriate to issue a 'Certificate of Acceptance'
for the Storm Sewer System. The subdivision agreement
provides for this certificate to be issued by the Director of
Public Works, subject to the approval of Council.
