TBAT Report WD-59-94 be received; 2. THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the Initial and Final Stage Works constructed within Blocks 99 and 111, Plan lOM-799; and 3. THAT Council approve the by-law attached to Report WD-59-94 assuming Blocks 99 and 111, within Plan lOM-799, as public highway. No. 3: Road Dedication By-law for Plan lOM-834 2.0 BACKGROUND 2.1 On June 4, 1987, the former Town of Newcastle entered into a subdivision agreement with Foster Creek Developments Limited to develop certain lands by plan of subdivision, located in Newcastle Village and described as Plan 10M-799 (Attachment No. 1). The agreement required the developer to construct all - 1006 :.o. ~®w~.~.. REPORT NO.: WD-59-94 PAGE 2 roadworks,. including hot-mix paving, curb and gutter, sidewalks, boulevard sodding and street trees, a storm drainage system and street lights, hereinafter referred to as the 'Works'. 2.2 The subdivision Works were completed in two (2) phases. The main portion of the subdivision was completed first and all of those Works were accepted by the Municipality through Report WD-16-92. 2.3 The culvert and bridge Works on Edward Street were completed secondly, and issued separate 'Completion Certificates' dated as follows: -initial Stage Works: January 2, 1992. -Final Stage Works: January 2, 1993. The Agreement required the Initial Stage Works to be placed on a two (2) year maintenance period while the Final Stage Works be placed on a one (1) year maintenance period. Accordingly, both maintenance periods expired on January 2, 1994. 2.4 All of the Works were re-inspected and all deficiencies have now been corrected and are satisfactory. In addition, a certification letter has been received from the project Geotechnical Engineers, Gibson & Associates Limited, certifying the integrity of the culvert slope stability (Attachment No. 2). 2.5 Accordingly, it is now appropriate to issue a 'Certificate of Acceptance' for both the Initial and Final Stage Works. The subdivision agreement provides for this certificate to be issued by the Director of Public Works, subject to the approval of Council. 9 t~~~7 REPORT NO.: WD-59-94 PAGE 3 2.6 Further to the issuance of a "Certificate of Acceptance', a by-law is required to permit the Municipality to assume that portion of Edward Street described as Blocks 99 and 111, Plan lOM-799, as public highways (Attachment No. 3). Creamer, Project Manager Re: Edward Street Culvert Newcastle, Municipality of Clarington Gentlemen: September 27, 1994 Our Fle No. F-tiW This letter preserrts the results of our review and assessment of the geotechnical aspects of embankment stability at the Edward Street Culvert in the urban community of Newcastle, Municpality of Clarington. The geotechnical assessment has been carried out as requested by your letter of August 31, 1994. Our geotechnical engineering assessment has included the following scope of work: • review of the project files concerning subsurface soil conditions, embankment stability, evaluation of the May, 1991 instability, the consequent plans for remediation and the actual remedial construction; • a review of background and more recent settlement hub data provided by Biddle & Associates; • plus a thorough walkover sfte examination on August 26, 1994 of the embankment and its slopes. The results of our geotechnical engineering assessment indicate that there are no apparent indicators of embankment slope instability or potential distress. Rather, the results clearly suggest that the embankment has reached a satisfactory level of slope stability from a geotechnical viewpoint. The current stability is expected to further improve with time in the future as the formerty soft and wet embankment soils in the outer shell are further weathered and dried. In conclusion, it is our opinion that the Edward Street embankment is in excellent overall condition. Remedial construction during the summer of 1991 to repair the damaged pavement and failed side slopes appears to have been successful. NOW THEREFORE, the Council of The Corporation of the Municipality of Clarington enacts as follow: 1. THAT a portion of Edward Street described as Block 111 and Block 99, in Registered Plan lOM-799 all being in the former Town of Newcastle, now known as the Municipality of Clarington, in the Regional Municipality of Durham, are hereby laid out and established by the Corporation of the Municipality of Clarington as public highway to be known as Edward Street, and assumed by the said Corporation for public use.
