Subject: MACOURTICE GARDENS SUBDIVISION, PHASE 2, PLAN 40M-1693,
CERTIFICATE OF ACCEPTANCE, STORM SEWER SYSTEM
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
Y ~..
1. THAT Report WD-42-94 be received; and
2. THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the storm sewer system
constructed within Plan 40M-1693.

2.0 BACKGROUND
2.1 On September 3, 1991, the former Town of Newcastle entered
into a subdivision agreement with Macourtice Developments Inc.
to develop lands by plan of subdivision, located in Courtice,
and described as Plan 40M-1693 (Attachment No.l). The
agreement required the developer to construct all roadworks
including hot-mix paving, curb and gutter, sidewalks,
boulevard sodding and street trees, a storm drainage system
and street lights, hereinafter referred to as the 'Works'.
2.2 The subdivision agreement provides for the separation of the
Works into three (3) stages:

a) Storm Sewer System;
b) Stormwater Quality Works; and,
b) Roads and Above Ground Services.
2.3 The Storm Sewer System was completed and a 'Certificate of
Completion' was issued dated June 12, 1992. .The system was
placed on a wo (2) year maintenance period which expired on
.June 12, 1994. The works were subsequently re-inspected and
all deficiencies have now been corrected to the satisfaction
of the Director.
2.4 It is now appropriate to issue a 'Certificate of Acceptance'
for the Storm Sewer Svstem. The subdivision agreement
provides for this certificate to be issued by the Director of
.Public Works, subject to the approval of Council.
