RAILWAY TRACKS, BOWMANVILLE Reco~meidstlore'spectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-25-94 be received; 2. THAT the staff be authorized, FORTHWITH, to call tenders for the supply and erection of a 6 foot chain link fence on the south side of the C.P.R. tracks, as illustrated on Attachment No. 2 to Report WD-25-94; 3. THAT the required funds, estimated to be $17,000, be obtained from the Lot Levy Reserve Fund, Account No. 1110-00157-X; and 4. THAT Rrista Dales be advised of Council's decision and be provided with a copy of Report WD-25-94. REPORT 1.0 ATTACHMENTS No. 1: Petition dated Monday, April 25, 1994 - Proposal for Fencing Along Railway Tracks on Old Bighway No. 2 No. 2: Key Map 2.0 BACKGROUND 2.1 At a regular meeting of Council held on Monday, April 25, 1994, Rrista Dales appeared as a delegation to advise Council of her concerns about the need for a fence on the south side fLP"t-~L.x~ ~.oE °®~U. ~.... REPORT NO.: WD-25-94 PAGE 2 of the C.P.R. tracks (north side of Old Bighway No. 2) from Rhonda Boulevard to Waverly Road. Ms. Dales also provided Council with a petition signed by residents of .the area (Attachment No. 1). 3.0 REVIEW AND COMMENT 3.1 Location of the Fence The location of the proposed fence referred to in the petition is illustrated on Attachment No. 2. The existing chain link fence shown on the drawing was constructed by and paid for by the developer of the plan of subdivision to the south (Sagewood). 3.2 Validity of Concern 'When one examines the area referred to by Ms. Dalea, it is easy to understand her concern about the safety of the children as it relates to the C.P.R. tracks. 3.3 Cost Estimate The estimated cost to construct a 6 foot link fence, as illustrated on Attachment No. 1 is $17,000. 3.4 Responsibility The responsibility as it relates to the construction of the fence would be very difficult to determine and would also take considerable time. It is highly unlikely that the C.P.R. will acknowledge responsibility for the construction of the fence. 4.0 CONCLUSIONS AND RECOMMENDATIONS 4.1 The concern about safety expressed by Ms. Dales and the residents of the area is valid. It is therefore recommended that a fence be erected as requested. The .required funds, estimated to be $17,0.00, can be obtained from the Lot Levy Reserve Fund, Account No. 1110-00157-X. ,~~2 REPORT NO.: WD-25-94 PAGE 3 4.2 Since this is a safety issue, it is recommended that. the approval be given FORTHWITH. Stockwell, Chief Administrative Officer 1 x)03 Monday April 25, 1994 Proposal for Fencing Along Railway Tracks on Old Hwy #2 We the residents of the Sagewood Subdivision (at Waverly and Hwy #2) request that fencing be established along the railroad tracks along Old Hwy # 2. This stretch of open field goes from Rhonda Blvd. to Waverly Road. Although this area may not be directly in the subdivision, it is adjacent to it. Many of us have to walk to the area to receive our mail. The petition for this fence was started in late fall of 1993 by the writer (Krista Dales). As both a parent and a caregiver she was concerned about the safety of our children. Train tracks have always been an interesting place for play, flatten coins, wander, or ride bikes upon. The area in which these tracks lie have also been used as a short cut to Hwy #2 to go to school or catch the bus. The above noted are all potentially dangerous and life threatening, and toc easily accessible. The petition had been put to the wayside until the recent tragic death of our neighbour. But even more important and vital is that this incident has made the tracks a large area of interest for our older children. The noise of the trains can be heard by all ages, but do they have the concept of how close that train is and of the speed at which it is approaching? Numerous trains pass through day and night, and we feel that the potential for danger is too great for this matter to be ignored. Some of us have phoned various people in town to find out of any plans for the fence to be built. We have in turn received many different responses. We have heard that there are no plans for a fence at all. We have also heard that it was to be completed last summer. We also have heard it is CNCP that is responsible. So we are now approaching council in hopes of getting the correct answers and a prompt solution. Who is responsible? When will it be done? Thank you for your time and cooperation. These tracks are well used attd pass through each day. As a young th a number of small children, we feel that some sort of fencing established to keep the dangers of such a tempting play area. We would be interested to here of any plans or by-laws concertiing this type of construction.
