Subject: CASTLE HBIGHTS SDBDIVISION, PLAN lOM-834, COIIRTICE,
'CBRTIFICATE OF ACCBPTANCB' AND 'ASSDMPTION BY-LAW',
ROADS, STORM DRAINAGE SYSTBM, STRBBT LIGHTS
AND OTHER RELATED WORKS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-18-94 be received;
2. THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the roads, storm drainage
system, street lights and other related Works, constructed
within Plan lOM-834; and
3. THAT Council approve the by-law attached to Report WD-18-94
assuming the streets within Plan lOM-834 as public highways.

2.0 BACRGROIIND
2.1 On February 14, 1990, the former Town of Newcastle entered
into a subdivision agreement with Ringsberry Properties to
develop lands by plan of subdivision, located in Courtice and
described as Plans lOM-834 (Attachment No. 1). The agreement
required the developer to construct all roadworks, including
hot-mix paving, curb and gutter, sidewalks, boulevard sodding

and street trees, a storm drainage system and street lights,
hereinafter referred to as the 'Works'.
2.2 The subdivision agreement provides for the separation of the
Works into two (2) stages:
(a) Storm Sewer Svstem, and
(b) Roads and Above Ground Services.
2.3 The Storm Sewer System was completed and a 'Certificate of
Completion' was issued dated August 31, 1990. The Works were
placed on a two year maintenance period which expired on
August 31, 1992.
2.4 The Roads and Above Ground Services were completed and a
'Certificate of Completion' was issued dated December 1, 1991.
The Works were placed on a two year maintenance period which
expired on December 1, 1993.
2.5 All of the Works were reinspected and all deficiencies were
corrected simultaneously and are now satisfactory.
Accordingly, it is now appropriate to issue a 'Certificate of
Acceptance' for both the Storm Sewer System and Roads and
Above Ground Services. The subdivision agreement provides for
this certificate to be issued by the Director of Public Works,
F~ subject to the approval of Council.

2.6 .Further to the issuance of a "Certificate of Acceptance', a
by-law is required to permit the Municipality to assume all
the streets within Plan lOM-834 as public highways.

THE CORPORATION OF THE MUNICIPALITY OP CLARINGTON
BY-LAW NUMBER 94-50
Being a By-Law to assume certain streets
within the Municipality of Clarington as
public highways in the Municipality of
Clarington.
NOW THEREFORE, the Council of The Corporation of the Municipality
of Clarington enacts as follow:
1. THAT the streets and Street Widening Block 44, described
in Registered Plan lOM-834 (described in Schedule "A"
attached hereto and forming part of this By-Law) all
being in the former Town of Newcastle, now known as the
Municipality of Clarington, in the Regional Municipality
of Ourham, are hereby accepted by the Corporation of the
Municipality of Clarington as public highway, and assumed
by the said Corporation for public use.
BY-LAW read a first and second time this day of 1994.
BY-LAW read a third time and finally passed this day of
1994.
