MUNICIPALITY OF CLARDYGTON REPORT Meeting: COUNCIL MEETING File # ~~b-~~p~O'~~~ Date: OCTOBER 27, 1997 Res. # ~~~ By-Law # Report #: AnMiN.4R-97i1e #: Subject: HYDRO EASEMENT - HETHERINGTON/QUINN Recommendations: It is respectfully recommended that Council approve the following: 1. THAT Report No. ADMIN-48-97 be received for information; and 2. THAT Council request the Region of Durham to give consideration to waiving the procedural by-law and allowing a single fee for the transfer of the former Hydro Easement in question. 1.0 BACKGROUND: 1.1 At a meeting held on January 13, 1997, Council referred the correspondence dated December 17th and the delegation of Andrew Jamieson to the Chief Administrative Officer to consult with the Solicitor regarding the request pertaining to the Land Division Committee fees (Attachment No. 1). 1.2 As Council is aware, the delegation approached Council to request their assistance in reducing the Land Division Committee fees for the families who are in negotiations to purchase the former hydro easement. The fees in question are $600.00 per parcel as established by the Regional Municipality of Durham. There are 23 parcels that are being considered and this represents $13,800.00 under the current fees by-law. 1.3 The Municipality could purchase the former easement land and then sell to the residents. However, in doing so, the Municipality would have to declare the property surplus, obtain an appraisal and then advertise for sale as specified in the Municipal Act. This is not a viable option for either the landowners or the Municipality. 1.4 The second option would be for Council to request to the Regional Planning Committee to amend the fees by-law to provide a single fee of $600.00 for the transfer of the former hydro easement to the abutting property owners. ../2 o.oE °° ®at~.~,E RRPORT ADMP(48-93 .2 - OCTOBER 27, M 1.5 Council could request that the Region of I3ztam Plstmisg . - law to provide a sine fee for the tramfer of the former hydro easelftent-to the abutting property owner.Council should be aware that it is the policy of the Rem of Durham IAnd Division Committee that a separate application with applicable fee be vAuWtftd for each consent transaction in accordance with By-law 35-92.The application pr fee for each,, application stibmitted is $600:00. -Respectfully submitted, Reviewed by, b, Fro th, .M.R.;R.R.F.A.
