THAT Report No. ADMIN-33-97 be received; and 2. THAT the lease agreement with the Oshawa Clazington Association for Community Living for use of the apparatus bay be approved; 3. THAT the Youth Committee, John Howazd Society and Ad Hoc Committee for Youth be advised of Council's direction; and 4. THAT the attached by-law marked Attachment No. 1 be approved authorizing the Mayor and Clerk to execute the necessary agreement. 1.0 BACKGROUND: 1.1 Further to Report ADMIN-21-97 regarding the Oshawa Clarington Association for Community Living, staff have met with the vazious groups and agencies in finalizing an agreement for a youth centre and program serving by the Oshawa Clazington Association for Community Living for the former appazatus bay at 132 Church Street, Bowmanville. 2.0 TERMS OF THE AGREEMENT: 2.1 The terms of the agreement allows the Oshawa Clarington Association for Community Living to utilize daytime use Monday to Friday and the Youth Council to utilize weeknights and weekends. 2.2 The Oshawa Clazington Association for Community Living will be responsible for general maintenance and the two groups will monitor to assess costs appropriately. 2.3 The agreement is based on a one yeaz term with no chazges for rent and utilities. ../2 o.orw°®°"r~eE ~ 2 m~a $e~ ~`1v, ;: ' REPORT ADMIN-33.97 : 2 • diJLY 9,1997 -s 2.4 The Youth Cotutcil will have to obtain appropriate insurance during the existence of the lease. 3:0 F JOHN HOWARD SOGIETlt: ° 31 The Iohn Howard Society is an important agency that serves the youth of the exrmntunity. ' 4:0 THE YOUTIi COUNCIL: 4.1 The Youth Council is in the process of being established: The terms ofthe:-agreement does not prohibit the Youth Council insetting their agenda for a successful Centre. S.0 APPARATUS BAY: 5.1 As the buBdigg's major occupancy will. be changed from a storage garage to a community hall and the o«:upation load will be imxeased, it was necessary to evaluate and upgrade deficienmes as it relates to the Ontario Building Code. This review has bees armpletad and the fallowing items will have to be addressed:. i) Ramp. entry to the south exterior door for handicap aex~ss; ii) Mollify exitdoors and stair enclosures; iii). Add washrnom facilities suited o ocxupancy; iv} Replace existing lower floor heating; and v} increase fire. safety equipment. ~ 5.2 Funds can be derived from the Infrastructure Funds and Capital Program: in 1995.. THAT this Lease Agreement attached hereto as Schedule "A" form part of this By-law. ADMIN-33-97 AGREEMENTbetween THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON and THE OSHAWA CLARINGTON ASSOCIATION FOR COMMUNITY LIVING "CLARINGTON PROJECT" 1: For use of the former apparatus bay and kitchen area at the Fire and Court Building, 132 Church Street,Bowmanville for a period of one year beginning September 1st, 1997 and expiring August 31st, 1998. 2. To operate Monday to Friday from 8:30 a.m. to 4:30 p.m. for recreational and educational activities for their clients and at other times in co-operation with the Youth Centre including evenings and weekends. 3. To permit access to the Clarington Youth Council Monday to Friday from 6:00 p.m. to 10:00 p. m. and Saturday and Sunday from 12:00 noon to 10:00 p. m. 4. The Oshawa Clarington Community for Adult Living Association to be responsible for general maintenance including janitorial, lights etc. 5. The Oshawa Clarington Adult Living Association to be responsible for security of the building. Total occupancy is not to exceed 90 persons. 6. No internal or external renovations, alterations or repairs will be allowed unless approved by the Property Manager. 7. Music, noise and related activities must be kept to reasonable levels in respect to the quiet of the community. 8. The Municipality will not be held responsible for personal injury or loss by anyone engaging in activities of the Centre. 9. The parties may terminate this lease by giving notice in writing and that the effective dates of such termination shall be 60 days after such notice is received. Notice of termination shall be in writing and shall be delivered to the Clerk of the Municipality of Clarington, 40 Temperance Street, Bowmanville, Ontario L1 C 3A5. In the operation of the Centre, the parties will respect all Municipal and Provincial codes and in particular By-law #91-20. No drugs, alcohol or smoking will be allowed in the premises.
