THAT Report No. ADMIN-08-97 be received; 2. THAT the Municipality NOT accept title to the portion of Princess Street which includes the bridge over Wilmot Creek; 3. THAT the offer to purchase the Orono Forestry Centre as outlined in this report be DECLINED; 4. THAT the offer to purchase the equipment inventory as provided by the Province of Ontario be DECLINED; 5. THAT the Province of Ontario, through the Ontario Realty Corporation and the Ministry of Natural Resources, be advised of Council's decision; and 6. THAT Council express their thanks to the representatives of the Province of Ontario for supporting the decision to retain a major portion of the lands in question in public trust. 1.0 BACKGROUND: 1.1 The Province of On;ario announced its intention to sell the Crown asset known as the Orono Forestry/Tree Centre in October of 1995. In response to this announcement, representatives of the Ministry of Natural Resources were invited to attend a community driven meeting (July 16, 1996) hosted by concerned Orono citizens. Misters Wayne Nakamura, Thom McDonnough and Merrick Buck, representing the Ministry of Natural Resources, presented the Province's plan for the future of the Centre. Economic Uevelopmoat Officer), the Ministry of Nahtral Resources and the Ontario Realty Corporation (the agency responsible for the final dispositimr of the prapK,rty). At the first meeting; September 12, 1996, the Municipality was informed that the Province had decided to change the description of the land to be sold. Following tIre meeting in Orotro, the province'decided to alter rhea strategy by deciding to retain the Bested caeek and valley farms as "unmanaged" Crown :property.. The end result was that instead of selling the approximately 1,300 acres that currentiy makes up the site, the Province was rN1w going hr keep just under 1,000 acres. The remainder, roughly 3T2 acres, has been designated as surplus and therefore available-for private purchase. This. information was reported in-the Report No. ADMIN-25-96 (Attaclssneat No, i). 1:4 .The Ontario Rcaity Corporation was given the responsib7ity of preparing the property far. sale. To do this, the following actions :were taken: a) All Ministries were circulated a property descaiptioa to determine if there was any imerest, outside of the Ministry of Natural Resources, to retain aIl or any portion of the Orono Forestry Centre. site;. b} A full survey of the property was completed; e) A title search on the propertywas carried out; and- d) A property appraisal to establish the property's market value. The Municipality, when. it was workiwg an the Stat#in Street ancll.Gagh Street esnstrudion projects, dosed off the Princess Street access to Orono -; Park to vehicular fsaffic (ace cannot access Orono Park from Main Street via Princess as it is now a walkway access only). Mr. Printer has asked that the Municipality accept tine for the. roadway access from the former Princess Street which includes the bcidge,that traverses a portian of the Wilmot Creek. At the meeting, staff informed Mr. Printer. that the Municipality's Public Works Department would have to be consulted about this prior to the Municipality deciding on whether or not: to aa:ept title. Should Council decide to proceed with the purchase of the lands that art being offered, there are limited options available for Snarrcng. The Parkland- Cash-In-Liao Reserve Fund could have been the most logical :source, however, the current balance in ihsfund after prior year commitments and the approved 1499 cxtpitalbudgetdraw is approximately $(100,000. The balance in this fiordhasbees identified in tltt-five year :capital budget, to be used for Bowmaztvlle waterfront land. acquisition. e4lets> :due to the exclusion of eligibilityfor parkland acquisition from the proposed new Dexeloptnettt Charges Act (Bill 9$}, future planned eommumty parks must also be financed €rant this reserve fiord or other alternate sources (ie. tax levy}. :J6 ~. 12fl5 ,~~~ ~.e REPORT ADMIN-08-97 - 6 - APRIL 7, 1997 5.2 The old community services lot levy has been closed out through the 1997 budget report TR- 15-97 with the balance transferred to the new Parks Maintenance Reserve Fund. There is not a sufficient unwmmitted balance in this fund to finance the purchase of the Orono lands. Staff, therefore, would recommend that should Council decide to proceed with the purchase of these lands, that the purchase be financed through long term borrowing via a debenture issue. 6.0 SUMMARY: 6.1 Looking at the economics that currently structure society and given the new issues that Council is having to cope with, the timing of the offer to purchase the Orono Forestry Centre is not ideal. With the changes that are being mandated by the Provincial Government and the impact uncertainty that these changes may or may not have on our local residents, staff cannot recommend the purchase of the Orono Forestry Centre at this time. 6.2 It should be noted that as a result of Council's resolution (#C-638-96), which served to delay the disposal of the entire site, and the community's perseverance in pressing the Provincial Staff to retain the environmentally sensitive creek and valley lands, close to 1,000 acres will be retained in public ownership. This, in itself, is a major improvement of the final decision of the Provincial Government. 6.3 It is also recognized that once the 372 acres are presented for public tender, it is reasonable to assume that the public interest will be protected by way of the Municipal Land Use Policy process. THAT Report No. ADMIN«25-96 be received for information. 1.0 BACKGROUND: 1.1 In October of 1995 the Province of Ontario announced that it intended to sell the Orono Forestry Centre. As of July 1996 the property has been vacated and turned over to the Ontario Realty Corporation who is charged with the responsibility of selling this provincial asset. At a Special Meeting of Council held July 29,1996, Council passed the following resolution (#C-638- 96): "WHEREAS the Province of Ontario has made it known they will be disposing of the Orono Tree Nursery lands through public tender; NOW THEREFORE BE IT RESOLVED THAT the Municipality of Clarington advise the Province of Ontario that the Municipality wishes to be kept updated on the disposal method and all related events and that the Municipality be given the first right or refusal; and THAT a copy of this resolution be forwarded to Chris Hodgson, Minister of Natural Resources, John O'Toole, MPP, and Henry Sissons." 1.2 Pursuant to Resolution #C-638-96, on Thursday September 12, 1996 the Chief Administrative Officer, the Property Manager and the Acting Economic Development Officer met with representatives of the Ministry of Natural Resources and the Ontario Realty Corporation to discuss the Orono Forestry Centre. This report is intended to advise Council of this site's current status and the disposal process that will be implemented. ./2 o.oEa~®aE~:~aE 12 0 7 REPORT ADMIN-25-96 a COPY SEPTEMBER 16, 1996 2.0 THE PROCESS: 2.1 The representatives of the Ministry of Natural Resources have stated that the Province will be selling the production lands (western border of the property) and the parcel of land which includes the existing buildings and infrastructure. Provincial assets (eg. equipment) will also be sold but it will either be negotiated with one of the land sales or by a separate process. The forested lands (in the neighbourhood of 1,000 acres and includes the creek and valleylands) will be retained by the Province however, they will not be "actively" managed. 2.2 To dispose of the identified properties (see attached maps -original aerial is available from the Economic Development Office) the Ontario Realty Corp. will approach other Provincial Ministries to determine whether or not they have an interest in retaining all or portions of this site. This inquiry has been initiated and it is believed that the indication of interest, if any, will be known by the middle of October. Should there be no interest expressed then the Ontario Realty Corp. will then approach the Municipality of Clarington to determine what interest, if any, exists relative to the property. Please note that should interest be expressed by another Provincial Ministry, discussions with that Ministry must be concluded before the Municipality is approached. 2.3 If the Municipality does not express an interest in purchasing the Orono Forestry Centre the Ontario Realty Corp. will then proceed to initiate the selling of this site to private interests. The process to be used will be one of three options: a local real estate agent will be asked to facilitate the sale; the property will be sold by public auction; or the property will be sold by public tender. It is most likely that the third option will be the one exercised. In order to sell the property, an appraisal is to be carried out by an external agency for the Ontario Realty Corporation. This appraisal will enable the Province to establish the selling price of the Centre. The appraisal is to be initiated the week of September 16, 1996. The representative of the Ontario Realty Corporation used the term "fair market value" as a key theme to the selling of the property throughout the meeting. 3.0 SUMMARY: 3.1 The Orono Forestry Centre has been the subject of significant community interest and it has been a difficult procedure to determine how the Province was going to dispose of it. It should be noted that the Municipality's Official Plan and Zoning Policies will dictate future allowable use of the land once it is sold. The Province has indicated that it will not retain any interest in the property beyond the identified forested lands and a small parcel (unidentified at this point in time) to be retained for the purpose of continued research by the Fisheries Unit.
