Subject: DISABLED PARKING ISSUES
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-58-97 be received;
2. THAT Mr. Coady be advised of The Municipality of Clarington's
participation in the Region of Durham's review of "Parking for
the Disabled in Durham Region" and be provided with a copy of
this report;
3. That the Courtice Community Complex have four (4) designated
disabled parking spaces posted near the main entrance and be
included in Traffic By-law 91-58, Schedule XXX "OFF-STREET
PARKING FOR DISABLED PERSONS"; and
4. THAT the by-law attached to Report WD-58-97 be passed by
Council.

2.0 BACRGIRQDND
2.1 At a meeting' held on Suly 7, 1997, the Council of the
Municipality of Clarington passed the following resolution:
"THAT. the correspondence dated April 8, 1997 from Lyle
Coady regarding Disabled Parking Standards, be received;;
THAT the correspondence be referred to the Director of
Public Works for review and preparation of a report to be
submitted to the General Purpose and Administration-
Committee; and
..THAT Lyle Coady be advised of Council's decision."
3.0 RSVIE9q AND COEQ9sNT
3.1 Region of Durham Planning Department:
Mr. Coady's letter was distributed to every Municipality.
within Durham Region. The. Region of Durham has agreed. to act
as a central information gathering point. for the
Municipalities and have requested pertinent information which.
will be xe-distributed to the parties for comparison. The
Region has no authority or intention of dictating. how
individual municipalities deal with the various issues, but
will .provide. information as a framework for review of
uniformity to address the. needs of the d$abled. After this
information is received by Clarington's Planning Department,
it will be reviewed and any proposed changes to the Zoning By-
law will be incorporated into .the new Zoning By-law .currently
.being reviewed.
3.2 Preliminary Information on Uniformity of Standards:
General~.y, the signs which establish the legal authority o£
the designated parking spaces throughout Durham Region would
be uniform because the sign specifications are detailed by the

Province in the Manual of Uniform Traffic Control Devices.'
The Province did change the specifications several years .ago
and as a result both old and new styles are in existence on
private property.
The pavement markings have no legal authority, ,but are a
visual aid with the disabled symbol and often include blue..
coloration as an added emphasis. The. exact size and number of
disabled parking stalls has never been recommended by the
- Province nor detailed in the Municipality's Zoning By-law.
Perfect uniformity of .number and size of parking stalls would
be difficult to achieve due to individual site plan agreements
signed over the years which pre-date new policies,
Mr. Coady also had concerns. with regard to winter snow
removal,.: thereby making it impossible to occupy .disabled
parking spaces at a number of locations throughout Durham
Region. .Snow removal requirements are included for properties
with detailed site plan agreements but are only enforced on a
complaint basis.
3.3 Courtice Community Complex:.
The new complex has been provided with four. (4) disabled
parking spaces. These designated parking spaces on municipal
property should be included in Traffic By-law 91-58, Schedule
RXX "OFF-STREET PARKING FOR DISABLED PERSONS", through a by-
law amendment (Attachment No. 2).
4.0 CONCLII320NS
4.1` Fram the above, .it is concluded that Disabled Parking
Standards information being gathered by the Region of Durham
should be reviewed by the Clarington Planning Department, as
it relates to the Zoning By-law.

I have become increasingly aware of the inconsistency of
disabled parking spaces on both private and public lands.
As a user of these spaces, I have observed a wide
inconsistency in their width, signing and pavement
markings. In addition, over the past winter I have
noticed poor maintenance practices with snow removal
making it impossible to occupy disabled parking spaces at
a number of locations through out 'Durham Region.
This is a request that ycu direct your staff to
investigate the conditions of disabled parking stalls
within your jurisdiction on both private and public
lands. It is my opinion that this matter is the
municipality's responsibility under the Ontario Ffuman
Rights Code.
I have information on numerous existing sites where the
standards are not adhered to. It causes me undue
distress and at times presents safety concerns.
Please attend to this matter with urgency as it has
persisted for: some time now.

THE CORPORATION OF THE MiJNZCIPALITY OF CLARINGTON
BY-LAW 97-
Being a By-law to amend By-law 91-58, as
amended, being a By-law to Regulate Traffic on
Highways, Municipal and Private Property in
the Municipality of Clarington
WHEREAS the Council of the Corporation of the Municipality of
Clarington deems it desirable to amend By-law 91-58;
NOW THEREFORE the Council of the Municipality of Clarington
enacts as follows:
1) Schedule XXX "OFF-STREET PARKING FOR DISABLED PERSONS" of
By-law 91-58 is amended by;
A) Adding the following reference:

(Courtice)
2) This By-law shall come into force on the date that it is
approved by Council and when signs to the effect are
erected.
BY-LAW read a first and second time this day of
