Subject: LINCOLN GREEN SUBDIVISION, COURTICE, PLAN 40M-1742,
'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW',
FINAL WORKS INCLUDING ROADS AND OTHER RELATED WORKS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. TF~AT Report WD-56-97 be received;
2. THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the Final Works, which include
final stage roads and other related Works, constructed within
Plan 40M-1742; and
3. THAT Council approve the by-law attached to Report WD-56-97,
assuming the streets within Plan 40M-1742 as Public Highways.

2.0 BACKGROUND
2.1 The Corporation of the Municipality of Clarington entered into
a Subdivision Agreement, registered November 8, 1993, with
290572 ONTARIO LIMITED to develop lands by plan of
subdivision, located in Courtice and described as Plan 40M-

1742 (Attachment No. 1). The>agreement required the developer
to construct,all roadworks, including hot-mix. paving, curb and'
gutter, sidewalks, boulevard sodding and street trees, a storm
drainage system and street lights, hereinafter referred to as
the 'Works'.
The subdivision agreement provides for the separation of the
Works into four (4) stages:
(a) Initial Works;
(b) Street Lighting System; and
(c) Final Works;
(d) Stormwater.Management System
The Initial.. Works and Street Lighting Works were issued
.'Certificates of Completion' and subsequent 'Certificates of
Acceptance' by the Director of Public Works, as 'per the
maintenance requirements set out in the Subdivision Agreement;
The Final Works were. issued a 'Certificate of Completion'
dated December 16, 1995. This initiated a one (1) year
maintenance period which expired on December 16, I996. The
Works have been reinspected and all deficiencies have-now been
rectified to the satisfaction of the Director.
2.5 It is, now appropriate to issue a 'Certificate of Acceptance'
for the Final Works. The subdivision agreement requires
Council approval prior to the issuance of any 'Acceptance
Certificate' for Fina,~ Works.
2.6 Further to the issuance of a 'Certificate of Acceptance', a
by-law is required to permit :.the Municipality to assume
certain streets within Plan 40M-1742 as public highway
(Attachment No. 2).

2.7 For Council's information, the stormwater Management Svs~;em
was issued a 'Certificate of Completion' dated December 16,_
1995. This initiated a two (2) year maintenance period which
expires on December 16, 1997. At that time, those Works wi12
be' reinspected and, subject. to all deficiencies being
rectified to the satisfaction of the Director, a 'Certificate
of Acceptance' will be issued.

SHE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NUMBER 97-
Being a By-Law to assume certain streets
within the Municipality of Clarington as
public highways in the Municipality of
Clarington.
NOW THEREFORE, the Council of The Corporation of the Municipality
of Clarington enacts as follow:
1. THAT the streets described in Registered Plan 40M-1742
(described in Schedule "A" attached hereto and forming
part of this By-Law) all being in the Municipality of
Clarington, in the Regional Municipality of Durham, are
hereby accepted by the Corporation of the Municipality of
Clarington as public highways, and assumed by the said
Corporation for public use.
BY-LAW read a first and second time this day of
1997.
HY-LAW read a third time and finally passed this day of
1997.
