MEARNS AVENUE STORM SEWER OVERSIZING AND TRIBUTARY STORMWATER
MANAGEMENT WORKS, SUBDIVISION AGREEMENT
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-55-97 be received for information;
2. THAT Staff be authorized to publish a notice pursuant to the
Development Charges Act to notify interested persons that
Council will hold a public meeting to hear submissions of
interested persons respecting an amendment to the Development
Charges By-law to add to the designated services the external
and oversized works described in the report from G.M. Sernas
and Associates Limited and Valdor Engineering Inc. entitled
"Mearns Avenue Storm Sewer Oversizing and Tributary Stormwater
Management Works Subdivision Agreement of April 3, 1991,
18T-89041" dated June 1997.
REPORT
1.0 BACKGROUND
1.1 In the Subdivision Agreement made between the Municipality of
Clarington and Eiram Development Corporation dated April 3,
1991, respecting the lands in Bowmanville within Draft Plan of
Subdivision 18T-89041, certain external and/or oversized
services are referred to which the Owner agreed to construct
at its cost and the Municipality of Clarington expressed its

intention to take the necessary legal actions in order to
enter into a Front-ending. Agreement with the Owner following
approval by the Director of Public Works of _a coat-sharing,
report.
S.2 G.M. Sernas and Associates and Valdor Engineering Inc.. have
submitted a cost-sharing .report for these external,; and/or
oversized services dated June 1997 and entitled "Hearne Avenue
`Storm-Sewer Oversizing and Tributary Stormwater Management
Works Subdivision Agreement of April 3, 1991, >18T-89041".
This report which has been reviewed and approved by the Public
Works Department identifies the Owner and other benefitting ;
owners in respect of each of these services.

in order to enter into a Front.-ending Agreement it will be
necessary for Council to amend the Municipality's Development
Charge By-law to add the external and/or oversized services in
question to the list of designated services referred to in the-
