Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report WD-45-97 bereceived;
2. THAT. Purchasing By-law 94-129, Section 5.06, be waived and that the
developers, Robert Russell Carruthers and Elizabeth Grace Smith, be
reimbursed in the amount of $40,423.24 for the costs of the. oversized
works on Middle Road; and
3. THAT the funds be obtained from AccountNO. 7205-96002-0261.

2.0 BACKGROIIND
2.1 The Municipality of Clarington entered into a servicing agreement dated
November 17, 1995, withRObert Russell Carruthers and Elizabeth Grace
Smith for the installation of municipal services necessary to facilitate
the development of the developer's lands and specifically the construction ,
ofthe St. Stephen's High School on Middle Road.
2.2 The servicingagreement required the developer to construct external
"Works", such as a Stormwater Management Pond, storm sewers,
reconstruction of Middle Road, and sidewalks. -

2.3 In .conjunction with the construction of storm sewers on Middle Road, the:
developer agreed to recoastruet Middle Road to a road ataadard that-
.~; accommodates the future urban road profile where possible, including
provisions for the future construction of sidewalks. ,fibs costs of any
road works, constructed at the future urban road proflie, would be the
responsibility of the Municipality,
2.4 t3. M.'Sernaa and Associates Limited, the engineeriag consultants for the-
developer, has prepared a coat summary. -They detezmined shat the coats of
the road works>on Middle Road. that are attributable to the Municipality
are $40,.423.24 (Attachment No. 3). Staff has reviewed the scat summary
from G. M. 8eraas and Associates and concur with the east..appprtionment.
2.5 The funding 8or hie work was originally provided €or is the 1996 £apital-`
Hudget (Attachment No. 2) and;was subsequently accrued into 1997.

2.6 In order to reimburse the developer for the cost, o£ the road works, a - `j
Purchase Order in the amount o€ $40,423.24 moat be issued by the
Municipality's Treasury Department, which requires that Purchas3ag 8y-law
' 94-i29, Section 5.06, be waived. -
2.7 The Treasurer-has reviewed the funding requiremeats ansi concurs with the
recommendation.
