THATReport WD-41-97 be received; 2. THAT parking within 3 metres of a mail box be prohibited unless actually engaged in delivery, posting or obtaining mail; and 3. THAT the by-law attached to Report WD-41-97 be passed by Council. REPORT 1.0 ATTACHMENTS No. 1: Prppoaed By-law 2.0 BAC&C;•ROIIND 2.1 The Public Works and By-law Departments have received complaints from a number of residents from Courtice, Bowmanville and Newcastle Village concerning vehicles parked for extended periods of time in front of mail boxes. 3.0 REVIEW AND COMMBAIT 3.1 Parking in front of mail boxes interferes with both the delivery of mail by Canada Post and the ability of residents to access their mail boxes. 3.2 There is presently no section in Traffic By-law 91-58 or the Highway TrafficAct which prohibits the obstruction of mail boxes. By-law Enforcement staff must presently rely on Section 4(6)(2): ....a~®aE~.~~,. 1 13 4 I u; RSPORT ~O.a WD-41-97 PA08 2 "NO person shall on any highway park any vehicle for a period longer than three (3) hours unless otherwise indicated by official signs." This method of enforcement is time consuming and permits the obstruction to continue for a minimum of three (3) hours be#ore the vehicle can be issued. with a parking violation. 3.3 The proposed by-law (Attachment No. 1) will prohibit parking within three ' (3) metres of a mail box, unless the motorist is actually engaged is accessing the mail box. To educate the public and improve compliance, signs w$11 be installed`indicating "lso Parking 1Pithia 3 llrtres, Mail Box Aacsss Zaae". The signs will be installed at locations where complaints have been received or regular violations have been observed. 4.0 CONCLIISION' 4Y From the above, it is concluded that the proposed by-Saw will assist mail- delivery and access by residents while. the proposed signing will help educate the gublic. Stockwell Chief Administrative Of#ces ,_ THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW 97- Being a By-law to amend By-law 91-56 being a By-law to Regulate Traffic on Highways, Municipal and Private Property in the Municipality of Clarington WHEREAS the Council of The Corporation of the Municipality of Clarington deems it desirable to amend By-law 91-58. NOW THEREFORE the Council of the Municipality of Clarington enacts as follows: 1) By-law 91-58, Section 4, of the General Parking and Stopping Regulations, under Subsection (6) No person shall on any highway park any vehicle, is amended by, Adding the following references: (K) adjacent to or within three (3) metres of any mail box or so as to interfere with other motorists or pedestrians from stopping to access such mail box. (i) Notwithstanding Subsection (K) of this section, motorists are permitted to stop at a mail box zone while actually engaged in delivering, posting or obtaining mail. 2) This By-law shall come into force and take effect on the date of the passing thereof.
