Res. # ~A- $1- ~'] JUNE 16, 1997 By-Law # ~~~ Report #: .~ File #: Wit. 0 0 2 Subject: HIGHLAND GARDENS 3UBDIV23ION, PHASE 2B, (PART OF) PLAN lOM-826, COURTICE, 'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW', ROADS, STREET LIGHTS AND OTHER RELATED WORKS Recommendations: It is .respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-39-97 be received; 2. THAT the Director of Public Works be authorized to issue a .'Certificate of Acceptance' for the roads, street lights and other related Works, constructed within Phase 2B of Plan lOM- 826; and 3. THAT Council approve the by-law attached to Report WD-39-97 assuming certain streets within Plan lOM-826 as public highways. REPORT 1.0 ATTACHMENTS No. 1: Key Map . No. 2: Road Dedication By-law for Phase 2B of Plan lOM-826 2.0 BACKGROUND 2.1 The former Town of .Newcastle entered into a subdivision agreement registered on June 30, 1988, with H. Kassinger Construction Limited to develop lands by plan of subdivision, P.o.~w~®w.~.~., - 1 1 15 R8tt01tT lt~i;, t 4YD-39-97 _~ PAO~ 2 located in Courtce and described as P1an;1OM-8~6-`~AttaChment No._1). The agreement required the developer to construct all roadworks, including hot-mix .paving, .curb and. gutter,.° sidewalks, boulevard sodding and street trees, a storm ' ~. drainage system and street lights, hereinafter referred to as the 'Works'. 2.2 'The subdivision agreement grovides for t~1e eGeeparatian of the Works. into two (2) stages: a) Storm Sewer system, and b) ~, and Above Ground ,ge^rvicea. ,~ 2.3 Council_~tirevously approved Report WD-30-92, which authorised the issuance of a 'Certificate of Acceptance' for the!Stortn° Sewer Svatem for Plan lOM-826. { 2.4 The $Q~a and Above: ~o~ Services for :Phase 2B were. completed and a 'Certificate of Completion' was i,saued:dated'- September 7, 1994. The Works were placed on a two .42) year maintenance period which expired on September 7, 1996. These Works were subsequently inspected and all deficiencies°have now been. rectified to the satisfaction of the !Director of Public Works. 25 It is now appropriate to issue a 'Certificate of Acceptance' for the Roads and Above Grannd Sg`rviceg for phase 2B only. The subdivision agreement provides for this certificate-to be issued by, the Director. of- Public Works, subject ,to the approval of Council. THAT the streets described in Registered Plan lOM-826, described in Schedule "A" attached hereto and forming part of this By-law, all being in the former Town of Newcastle, now known as the Municipality of Clarington, in the Regional Municipality of Durham, is hereby accepted by The Corporation of the Municipality of Clarington as public highway, and assumed by the said Corporation for public use. BY-LAW read a first and second time this 23rd day of June, 1997. BY-LAW read a third time and finally passed this 23rd day of June, 1997.
