Subject: COURTICE CROSSING SUBDIVISION,
PHASES lA AND 1B, COURTICE, PLAN 40M-1746,
'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION SY-LAW',
FINAL WORRS INCLUDING ROADS AND OTHER RELATED WORKS
Recommendatlans:
It is respectfully recommended that the General Purpose -and
Administration Committee recommend to Council the following:
1. THAT Report WD-38-97 be received;
2. THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the Final Works, which include
final stage roads and other related Works, constructed within
Plan 40M-17.46; and
3. THAT Council approve the by-law attached to Report WD-38-97,
assuming the streets within Plan 40M-1746 as Public Highways.

2.0 BACKGROUND
2.1 The Corporation of the Municipality of Clarington entered into
a Subdivision Agreement, registered November 23, 1993, with
290572 ONTARIO LIMITED to develop lands by plan of
subdivision, located in Courtice and described as Plan 40M-

1746 (Attachment No. 1). The agreement required the developer
to construct all roadworks, including hot-mix paving, curb and
.gutter, sidewalks, boulevard sodding and street trees, a storm
drainage system and street Sights, hereinafter referred to as
-the 'Works'.
2.2 The subdivision agreement provides for the separation of the
Works into four (4) tages:
a) Initial irks;
b) ~.#.'..~.r 7 ; crht i no System;
c) F;.,a~ Works and
d) ~rmwater Manaaemez+r System.
2.3 The In~t~a~ Works and Street Liahtina Works. were, issued
'Certificates of Completion' and subsequent 'Certificates of
Acceptance' by the Director of Public- Works,.. as .per the
maintenance requirements set out in the Subdivision Agreement.
2.4 There are no ,S1s-ormwate~ManaQement Svatem Works as9ociated
with this phase of the project.
2.5 The Final Works were issued a 'Certificate of Completion'
dated November 30, 1995 . This initiated a one (1) year
maintenance period which expired on November 30, 1996. The
Works have been reinspected and all deficiencies have now been
rectified to the satisfaction of the Director of Public Works.
2.6 It is now .appropriate to issue a 'Certiā¬icate of Acceptance'
for the final Works. The. subdivision agreement requires:
Council approval. prior to the issuance of any 'Acceptance
Certificate' for Final Works.

2.7 Further to the issuance of a 'Certificate of Acceptance', a
- by-law is required. to permit the Municipality to assume
certain streets within Plan 4oM-1746 as public .highway
(Attachment No.-2).

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NUMBER 97-
Being a By-law to assume certain streets
within the Municipality of Clarington as
public highways in the Municipality of
Clarington.
NOW THEREFORE, the Council of The Corporation of the Municipality
of Clarington enacts as follows:
1. THAT the lands described as Blocks 64, 65 and 66, Plan 40M-
1746, in the Municipality of Clarington, Regional Municipality
of Durham, are hereby laid out and established as public
highway.
2. THAT the streets and Blocks described in Registered Plan 40M-
1746, described in Schedule "A" attached hereto and forming
part of this By-law, all being in the Municipality of
Clarington, in the Regional Municipality o£ Durham, are hereby
accepted by The Corporation of the Municipality of Clarington
as public highways, and assumed by the said Corporation for
public use.
BY-LAW read a first and second time this 23rd day of June, 1997.
BY-LAW read a third time and finally passed this 23rd day of June,
1997.
