It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-37-97 be received;
2. THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the Initial Stage of Road
Construction, constructed within Plan 40M-1770.

2.0 BACKGROUND
2.1 The former Town of Newcastle entered into a subdivision
agreement on July 28, 1986, with Penwest Development
Corporation Limited to develop lands by plan of subdivision,.
located- in Bowmanville and described as Plan 40M-1770
(Attachment No. 1). The agreement required the developer to
construct all roadworks, including hot-mix paving, curb and
gutter, sidewalks, boulevard sodding and street trees, a storm.
drainage system and street lights, hereinafter referred to as
the 'Works'.

2.2 The subdivision agreement provides for the separation of the ;
Works into two (2) stages:.
a} Initial Staae of Road Cox~~truction, which includes the
storm sewer system, road granulars, base curb and base
asphalt pavement, and
b) Final Staae of Rgad Construction, which includes trees,
boulevard eod, sidewalks, top curbs, top asphal
pavement, streetlights and a1 L remaining works.
2.3 The initial Staae of Road Construction was completed and a
'Certificate of Completion' was issued dated August 10, x.994,
The Works were placed on a two (2) year maintenance period .
which expired on August 10, 1996. These Works were
subsequently inspected and all deficiencies-have now been
rectified to the satisfaction of the Director of Public Works.
2.4 It is now appropriate to issue a 'Certificate of Acceptance'
for the Initial Staae of oad Cq,~struction. This'particular
..subdivision agreement provides .for this certificate 'tb be
issued by the Director of Public Works, subject to the
approval of Council.
