Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1.. THAT Report WD-13-97 be received; and
2. THAT the Director of Public Works be authorized to issue a 'Certificate of
Acceptance' for the Tributary Stormwater Management Works and the
Stormwater Detention and Water Quality Works constructed within Plan 40M-
1669.

2.1 The former Town of Newcastle entered into a subdivision agreement
registered on September 20, 1991, with 708545 Ontario Limited to develop
lands by plan of subdivision, located in Courtice and described as Plan
40M-1669 (Attachment No. 1). The agreement required the developer to
construct all roadworks, including hot-mix paving, curb and gutter,
sidewalks, boulevardsodding and street trees; a storm. drainage system and
street lights, hereinafter referred to as the 'WOYka'.
2.2 The subdivision agreement provides for the separation of the Works into
four (4) stages:
(a) Storm Sewer Svstem,
(b) Roads and Above Ground Services;
(c) Tributarv Stormwater Mana4ementWOrks, and ~'
(d) Stormwater Detention Work and Water Oualitv Work.

2.3 Council previously approved Report WD-6-94, which authorized the issuance
of a 'Certificate of Acceptance' for the Storm Sewer System for plan 40M-
1669, and also Report WD-7-95, which authorized the issuance of a
'Certificate of Acceptance' and road assumption by-law for the Roads and
Above Ground Services for Plan 40M-1669.
2.4 The Tributary Stormwater Management Works and Stormwater Detention Work
and Water Oualitv Work were completed simultaneously and a 'Certificate of
Completion' was issued dated July 1, 1992. The Works were placed on a
four (4) year maintenance period which expired on July 1, 1996. These
Works were subsequently inspected and all deficiencies have now been
rectified to the satisfaction of the Director of Public Works.
2.5 It is now appropriate to issue a 'Certificate of Acceptance' for the
Tributary Stormwater Management Works and Stormwater Detention Work and
Water Quality Work. The subdivision agreement provides for this
certificate to be issued by the Director of Public Works, subject to the
approval of Council.
