THAT Report WD-12-97 be received; 2. THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the Final Works, which include final stage roads and other related Works,. constructed within Plan 40M-1740; and 3. THAT .Council approve the by-law attached to Report WD-12-97, assuming the streets within Plan 40M-1740 as Public Highways. REPORT 1.0 ATTACHMSNT3 1.1 No. l: Key Map No. 2: Road Dedication By-law 2.0 BACKGROUND 2.1 The Corporation of the Municipality of Clarington entered into a Subdivision Agreement, dated May 31, 1993, with 812716 ONTARIO LIMITED to develop lands by plan of subdivision, located in Courtice and described as Plan 40M-1740 (Attachment No. 1). The agreement required ~he developer to construct all roadworks, including hot-mixi paving, curb and gutter, ...E •~ ®aE~.~~E > > a ~ TMs~oa .~op.~ REPORT NO.: WD-12-97 PAGE 2 sidewalks, boulevard sodding and street trees, a storm drainage system and street lights, hereinafter referred to as the 'Works'. 2.2 The subdivision agreement provides for the separation of the Works into four (4) stages: (a) Initial Works; (b) Street Liahtina Svstem; (c) Final Works; and (d) Stormwater Management Svstem. 2.3 The Initial Works and Street Liahtina Works were issued 'Certificates of Completion' and subsequent 'Certificates of Acceptance' by the Director of Public Works, as per the maintenance requirements set out in the Subdivision Agreement. 2.4 The final Works were issued a 'Certificate of Completion' dated October 12, 1995, by the Director of Public Works. This initiated a one (1) year maintenance period which expired on October 12, 1996. The Works have been reinspected and all deficiencies have now been rectified to the satisfaction of the Director of Public Works. 2.5 It is now appropriate to issue a 'Certificate of Acceptance' for the Final Works. The subdivision agreement requires Council approval prior to the issuance of any 'Acceptance Certificate' for Final Works. 2.6 Further to the issuance of a 'Certificate of Acceptance', a by-law is required to permit the Municipality to assume certain streets within Plan 40M-1740 as public highway (Attachment No. 2). 1102 REPORT NO.: WD-12-97 PAGE 3 2.7 For Council's information, the Stormwater Manavement Svstem was issued a 'Certificate of Completion' dated October 12, 1996, by the Director of Public Works. This initiated a two (2) year maintenance period which expires on October 12, 1998. At that time, those Works will be reinspected and, subject to all deficiencies being rectified to the satisfaction of the Director of Public Works, a 'Certificate of Acceptance' will be issued by the Director of Public Works. THAT the street described in Registered Plan 40M-1740 (described in Schedule "A" attached hereto and forming part of this By-law all being in the Municipality of Clarington, in the Regional Municipality of Durham, is hereby accepted by The Corporation of the Municipality of Clarington as public highways, and assumed by the said Corporation for public use.
