Subject: ASPEN 3PRINGS SUBDIVISION, PHASES 2 AND 3, BOPPMANVILLE
PLANS 40M-1734 AND 40M-1796,
CERTIFICATE OF ACCEPTANCE, STORM 3ED~ER SYSTEM
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-3-97 be received; and
2. THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the storm sewer system
constructed within Plans 40M-1734 and 40M-1796.

2.0 BACKGROUND
2.1 On September 5, 1991, the former Town of Newcastle entered
into a subdivision agreement with Martin Road Holdings Limited.
and West Bowmanville Developments Ltd. to develop. lands by
plans of subdivision, located in Bowmanville, and described as
Plans 40M-1734 and 40M-1796 (Attachment No.l) The agreement
required the developer to construct all roadworks including
hot-mix paving, curb and gutter, sidewalks, boulevard sodding
and street trees, a storm drainage system, water quality works
and street lights, hereinafter referred to ws the 'Works'.

2.2 The Storm Sewer System for Plan 40M-1734 was completed and a
'Certificate of Completion' was issued dated November 15,
1993. The Storm Sewer System for Plan 40M-1796 was completed
and a 'Certificate of Completion' was issued dated November 2,
1994. Upon the expiration of the respective two year
maintenance periods for each project, the Works were re-
inspected and all deficiencies have now been corrected to the
satisfaction of the Director of Public Works.
2.3 It is now appropriate to issue a 'Certificate of Acceptance'
for the Storm Sewer Svstem for each project. The subdivision
agreement provides for these certificates to be issued by the
Director of Public Works, subject to the approval of Council.
