Subject: TOWNLINE ESTATES SUBDIVISION (COURTICE), PLAN lOM-808,.
'CERTIFICATE OF ACCEPTANCE' AND 'ASSIIMPTION BY-LAW',
ROADS, STREET LIGHTS AND OTHER RELATED WORKS
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-2-97 be received;
2. THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the roads, street lights and
.other related Works, constructed within. Plan lOM-808; and

3. THAT Council approve the by-law attached to Report WD- 97,
.assuming the. streets within Plan lOM-808 as Public Highways.

2.0 BACKGROUND
2.1 The former Corporation of the Town of Newcastle entered into
a Subdivision Agreement, registered May 20, 1988, with 591415
ONTARIO-ENC. to develop lands by plan of subdivision, located
in Courtice and described as Plan lOM-808 (Attachment No. 1).
The agreement required the developer to construct a storm

sewer system including the topsoiling and sodding of all
ditches, all roadworks including hot-mix paving, street
lighting and street trees, hereinafter referred to as the
'Works'.
2.2 At a meeting held on May 29, 1995, Council passed the
following resolution:
"THAT Report WD-20-95 be received;
THAT the Director of Public Works be authorized
FORTHWITH to issue a "Final Notification Letter" to
591415 Ontario Inc. and their surety, stating a
completion deadline of June 23, 1995, for all
outstanding works'
THAT upon the expiration of the aforementioned
deadline, the Director of Public Works be
authorized to draw on the developer's securities in
the full amount and expend said monies pursuant to
all obligations incurred or to be incurred by the
Corporation of the Municipality of Clarington in
accordance with the Subdivision Agreement; and
THAT 591415 Ontario Inc. and their surety be
advised of Council's decision and be provided with
a copy of Report WD-20-95, FORTHWITH."
3.0 REVIEW AND COMMENT
3.1 All of the Works were completed prior to the specified
deadline, with the exception of acquiring a storm sewer
outfall easement. Although delays were encountered during
negotiations with the property owners, clear title has now

been obtained, to the satisfaction of the Municipality's
solicitor.
3.2 It is now appropriate to issue a 'Certificate of Acceptance'
for the Works. The subdivision agreement provides for this
certificate to be issued by the Director of Public Works,
subject to the approval of Council.
3.3 Further to the issuance of a 'Certificate of Acceptance', a
by-law is required to permit the Municipality to assume
certain streets within Plan lOM-808 as public highway
(Attachment No. 2).

THE CORPORATION OF THS MUNICIPALITY OF CLARINGTON
BY-LAW NUMBER 97-
Being a By-Law to assume certain streets
within the Municipality of Clarington as
public highways in the Municipality of
Clarington.
NOW THEREFORE, the Council of The Corporation of the Municipality
of Clarington enacts as follow:
1. THAT the streets and street widening Block 54, described
in Registered Plan lOM-808 (described in Schedule "A"
attached hereto and forming part of this By-Law) all
being in the Municipality of Clarington, in the Regional
Municipality of Durham, are hereby accepted by the
Corporation of the Municipality of Clarington as public
highways, and assumed by the said Corporation for public
use.
BY-LAW read a first and second time this 13th day of January, 1997.
BY-LAW read a third time and finally passed this 13th day of
January, 1997.
