CERTIFICATE OF ACCEPTANCI~j, STORM SEDPER SYSTEM
Recommendations:
It is respectfully recommended that the General Purpose and
Admini tration Committee recommend to Council the following:
1. THAT Report WD-1-97 be received; and
2. THAT the Director of -Public Works be authorized to .issue a
.'Certificate of Acceptance' for the storm sewer system
constructed within Plan 40M-1676.

2.0 BACKGROUND
2.1 On October 24, 1991, the former Town of Newcastle entered into
a subdivision agreement with Ashdale Capital Corporation Ltd.
to develop lands by plan of subdivision, located in
Bowmanville, and described as Plan 4DM-1676 (Attachment No.l);
..The .agreement required the developer to construct all
roadworks including hot-mix paving, curb and gutter,
sidewalks, boulevard sodding and street trees, a storm
drainage. system,. water quality works and street lights,
hereinafter referred to as the 'Works'.

2.2 The Storm Sewer System for Plan 40M-1676 was completed and a
'Certificate of Completion' was issued dated April 27, 1992.
The system was placed on a two year maintenance period which
expired on April 27, 1994.
2.3 During that time, the developer defaulted in the performance
of his obligations under the Subdivision Agreement. In
accordance with the recommendations contained in report WD-37-
95, the Municipality then entered into a subsequent agreement
with the developer's surety, Royal Bank of Canada. The
subsequent agreement requires Royal Bank to complete all
outstanding Works, in accordance with the Subdivision
Agreement. Royal Bank is proceeding in a timely manner to
complete those Works.
2.4 The Storm Sewer System has been reinspected and all
deficiencies have been corrected to the satisfaction of the
Director of Public Works.
2.5 It is now appropriate to issue a 'Certificate of Acceptance'
for the Storm Sewer System for Plan 40M-1676. The agreement
with Royal Bank provides for this certificate to be issued by
the Director of Public Works, subject to the approval of
Council.
