Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommendtoCouncil the following:
L THAT Report.WD-38-96 be received;
2. THAT The Corporation of the Municipality of Claringtonenter into an
.Easement Agreement with Orono Fuel and Lumber Co. Ltd., Station Street
East in Orono, for a maintenance easement over property described as Part
1, Plan 40R-17206 (Attachment No. 1), for the nominal sum of$2.00, plus
all costs;
3. THAT The Corporation of the. Municipality of Clarington enter into. an
Easement Agreement with Danny Allen Bonikowsky and Ellen Marlyn
Bonikowsky, for a maintenance easement over property described as Part 1,
Plan 40R-17005 (Attachment No. 2), foY the nominal sum of $2.00, plus all.
costs;
4: THAT The Corporation of the Municipality of Clarington enter into an
Easement Agreement with the. Peterborough Victoria Northumberland
Clarington Roman Catholic Separate School Board (St. Joseph's School), for
a maintenance easement over property described as Part 2, Plan 40R-17005
(Attachment No. 2), for the nominal sum of $2.00, plus all costs;
5. THAT the three (3) Easement Agreements are to be to the satisfaction of
the Director of Public Worka;
6. THAT the three (3) proposed by-laws (Attachment Nos. 3, 4 and 5) be passed
authorizing the Mayor and Clerk to execute the three. (3) Easement
Agreements;

7. THAT the Municipality's Solicitor be directed to take the necessary action
to register the three (3) Easement Agreements;
8. THAT all funds associated with acquiring the three (3) Easements be
obtained from:
Mutton Court - 7205-96010-0169
Station Street - 7205-96003-0169; and
9. THAT Orono Fuel and Lumber Co. Ltd., Danny Allen Bonikowsky and Ellen
Marlyn Bonikowsky, and the Peterborough Victoria Northumberland Clarington
Roman Catholic Separate School Board be advised of Council's decision.

and The Corporation of The Municipality of Clarington
No. 5: By-law authorizing the execution of an Easement Agreement
between the Peterborough Victoria Northumberland and
Clarington Roman Catholic Separate School Board and The
Corporation of The Municipality of Clarington

2.1 The 1996 Capital Budget provided for drainage improvements to Station
Street in Orono at Orono Fuel and Lumber Co. Ltd. and a storm sewer
installation on Mutton Court in Bowmanville.
3.0 REVIEW AND COMMBNT
3.1 The drainage works have been completed in both locations, however, the
three (3) maintenance easements are now required to ensure the
availability of uninterrupted access for maintenance purposes.
3.2 The owners of the subject properties (Attachment Nos. 1 and 2) have agreed
to enter into Easement Agreements with the Municipality for the nominal

sum of $2.00 each. The funds for legal, survey and administration costs
have been included in the approved 1996 Budget.
4.0 RECOMMENDATION
4.1 It is, therefore, recommended that the proposed by-laws (Attachment Nos.
3, 4 and 5) be approved authorizing the execution of the three (3)
easement agreements.

Being a by-law to authorize the execution of
