Recommendations:
It is respectfully recommended that the General Purpose and
Administration Commu.ttee recommend to Council the following:
1. THAT Report Wiz-21-96 be received;
2. THAT the request for a five (5) mile NO STOPPING radius around
Mosport Park lie denied;.
3. THAT a NO PARKING area be considered based on a one (1) mile
radius of Mosport Park,
4. THAT a NO STOPPING area be considered on the section of
Mosport Road Which has a clear view of the race track;
5. THAT extension of the one (1) mile based NO PARKING radius or
NO STOPPING areas be considered at a later date if conditions
warrant such .Action;
6. THAT Mosport 'Park Limited formally agree to pay all costs
associated with the installation and maintenance of the
proposed N0 PARKING/STOPPING zones based on a one (1) mile
radius and futrther extensions if required at a later date;

7 THAT Mosport Perk Limited forward a certified cheque to the
Municipality in the amount of $19,000.00 before the required
by-law is foranally approved or signs are purchased and
installed;
8. THAT the By-law attached to Report WD-21-96 to create the NO
PARKING/STOPPING zones be passed by Council after Mosport Park
has agreed to the above conditions; and
9. THAT Bernard J,. Kamin be advised of Council's decision.

2.0 BACKGROUND
2.1 At a meeting held on April 15, 1996, the Council of the
Municipality of Clarington passed the following resolution:
"THAT the correspondence dated March 25, 1996, from
Bernard J. Kamin, Solicitor, Mosport Park Limited,
requesting that the Municipality enact a by-law
which wpuld prohibit parking and stopping and
permit Mowing within a five mile radius of Mosport
Park, be received;

THAT the correspondence be referred to the Director
of Public Works for review and preparation of a
report to be submitted to the General Purpose and
Administration Committee FORTHWITH; and
THAT Bernard J. Kamin be advised of Council's
decision."
3.0 REVIEW AND COAIMSNT
3.1 Requested Five (51 Mile Radius for NO STOPPING
Public Impact:.
As shown on Attachment No. 1, the five (5) mile NO STOPPING
radius would impact thousands of .residents and several
communities within Clarington. The five (5) mile NO STOPPING
radius would include the hamlets of Leskard, Kirby, Tyrone,
Haydon, Enniskillen and half of Orono for 365 days a year.
This parking restriction is only being considered in order to
address several events a year at Mosport Park. It is highly
likely that the public would consider these signs an eyesore,
a waste of money, and resent unrealistic stopping restrictions
in their communities.
Cost:
To be legally enforceable in 80 km/hr speed zones, oversized
(60 x 60 cm) Ra-155 NO STOPPING signs must be installed every
150 metres on .both sides of the roadway. The estimated cost
of posting a five (5) mile radius would be approximately
$100,000.
Effect on Neighbouring Jurisdictions:
If a five (5),mile radius is being considered, Mosport Park
Limited must also negotiate with the Township of Scugog, the
Township of Manvers and the Region of Durham to introduce
stopping restrictions on roadways under their jurisdictions.

3.2 Existing Parki~a Regulations
The existing NO PARKING sianina was originally requested and
paid for by Mosport Park Limited in 1976. The NO PARKING
signing is limited to portions of Concession Road 10 and
Mosport Road, as indicated on Attachment No. 1. The
Municipality, since that time, has made annual expenditures
.upgrading and repairing the NO PARKING signs in this isolated
area. Events. at Mosport Park over the past few years,
including a concert on May 21, 1994, did not produce parking
problems on the roadways. In all areas of the Municipality
there is an unposted three (3) hour parking limit as per
Traffic By-law 91-58. Although posted signs may improve
compliance and.. public awareness, the police can still tag and
tow vehicles which park over three (3) hours in the general
area of Mosport Park during concert events without NO STOPPING
signs being installed.
3.3 Prior Request For NO STOPPING Within a One (11 Mile Radius
A previous letter, dated April 28, 1994, from Mosport Park
Limited (Attachment No. 3) requested a one (1) mile NO
STOPPING radius and suggested that all costs should be borne
by the Municipality on the premise that it benefits the
community.
3.4 Effect On Other Jurisdictions
If a one (1) mile NO PARKING/STOPPING radius is introduced,
the Township of Manvers should be advised thirty (30) days in
advance of the proposed NO PARKING/STOPPING restrictions
affecting the Darlington-Manvers Townline Road, as per Item 9
of the Boundary Road Agreement forming part of the
Municipality of Clarington By-law 93-160. Mosport Park
Limited must negotiate directly with the Region of Durham
Works Department to review stopping restrictions on Regional
Road 20.

If a NO PARKING area is created based on a one (1) mile
radius, with some extensions and a NO STOPPING area on a
section of Mosport Road as shown on Attachment No. 1 , the
estimated cosh would be as follows:

for information purposes only. The Region of
Durham's costs could differ from the estimate
shown. The above prices do not include taxes or
overhead.
3.7 Will There Be a Problem?
The requested NO STOPPING zone is not required based on the
present volume of Mosport Park customers. The number of
future events, as well as future attendance figures of 40,000
to 50,000 persons, are estimates only. Parking problems
should not occur on the adjoining roads if Mosport Park has or
develops additional parking on site at zero or minimal cost to
patrons, combined with proper security and fencing around the
property. It may be premature for either Mosport Park or the
Municipality tro spend approximately $24,000, plus maintenance
costs, towards signing a problem which may not occur. Only
proper security will prevent motorists from driving on road
allowances, then parking on private property to access Mosport

Park property. Mosport Park is also concerned about
unlicensed vendors parking in the area during events, but
those concerns can be addressed through the Hawkers-Peddlers
By-law 92-230 without the introduction of NO STOPPING
restrictions.
3.8 No Stoooina Rgguirement
Staff is not convinced that the restrictive NO STOPPING zone
as requested by Mosport Park is required and feel the
expansion of the NO PARKING areas may be more appropriate.
Staff would support a NO STOPPING area along a section of
Mosport Road which has a clear sight line of the race track.
This area is on an elevated grade and staff has witnessed
motorists stopping for a quick look at the activities, while
approaching motorists are also looking towards the track
rather than a~ the stopped vehicles ahead of them. The NO
PARKING and NO STOPPING proposals were discussed with
.Inspector Jim Adams of Durham Regional Police who supports
staff's revised proposal to Mosport Park.
3.9 Resnonsibilityi For Costs
If either NO PARKING or NO STOPPING signs are installed, based
on the one (1) mile radius, Mosport Park Limited could save
money on fencing, security, and lost ticket sales. Illegal
parking and trespassing, if they occur, will be the direct
result of interest generated by Mosport Park events. Mosport
Park, in its .own best interest, may volunteer to pay for
installation and maintenance of the signing based on the one
(1) mile radius. Mosport Park may also wish to pay to extend
the NO PARKING radius further if required at a later date. If
Council decides to approve the request without financial
commitments from Mosport, the funds should be allocated from
a reserve fund. The traffic sign budget, which was not
increased for'. 1996, will already be hard pressed to stay

within allotment due to recent government regulations
requiring the use of more expensive reflective materials on
many signs.
4.0 CONCLUSIONS
4.1 From the above, it is concluded that the request for a five
(5) mile NO STOPPING radius around Mosport Park be denied due
to negative impacts on surrounding communities.
4.2 That a NO PARKING area be considered based on a one (1) mile
radius of Mosport Park, with extension of the one (1) mile
radius being considered at a later date if conditions warrant
such action.
4.3 That a NO STOPPING area be considered only for a section of
Mosport Road which has a clear view of the race track.
4.4 That Mosport Park Limited agree to pay all costs associated
with the installation and maintenance of the NO PARKING zone
based on a one (1) mile radius, and further extensions, if
required, and .the NO STOPPING section on Mosport Road before
a by-law is formally approved or signs are purchased and
installed.

In connection with the proposed musical concerts to take place
at Mosport Park on July 12, 13..and 19, 1996, I would request
that the municipality enact a by-law which will prohibit parking
and stopping and permit towing within a 5 miles radius of
Mosport Park. I would request the appropriate by-law be enacted
as quickly as possible as it might be enforced for our opening
motor racing Weekend an May 17, 18, 19 and 20.

Dear Madame Mayor and [dembers of Council:

In view of the recent discussion and residents input, my client,
the above, requests that the `Pawn immediately enact the necessary
by-laws to prohibit "stopping" and "parking" on any Municipal and
Regional roads within a 1 mile radius of the above such by-law to
provide for "towing" offenders, and that the necessary signage be
erected.
t9y client views this matter as one which should be dealt with by
the Town as quickly as possible. IP same is enacted the
necessary provisions for enforcement should be taken commencing
on the forthcoming victoria Day Weekend.
The road located on the west side namely Townline is a Region
Road, the same to all intents and purposes is, save for about
500' running south from the northern intersection, unopened and
impassable. The Town on its own or the Region, at the request of
the Town should close the same commencing May 1st to November 1st
in each year. This closing will assist in the prevention of
trespassing onto private property, assist in the prevention of
damage to crop, and may reduce the possibility of incidents of
fire.
Lastly, as has been discussed for many years, my client believes
that more and larger directional signs should be placed upon both
Town and Region roads directing traffic to Mosport Park. Once
again, my client believes that this will greatly assist in
traffic flow and reduce the number of requests for assistance
made to the local residents.

Municipal and Private Property in the

WHEREAS the Council of The Corporation of the Municipality of
Clarington deems it desirable to amend By-law 91-58.
