TART Report WD-15x96 be received; 2. TBAT the Municipa~'iity of Clarington enter into anagreement to purchase the Bailey Sri¢ge (Jackman Road Bridge) from the Ministry of .Transportation fob $6,806; 3. THAT the proposediBy-law (Attachment No. 3 to Report WD-15-96) be passed authorizing the Mayor and Clerk to execute the purchase agreement; 4. THAT By-law 93-19~ (Attachment No. 2 to Report WD-15-96), being a by-law to authorize the execution of an Agreement between The Corporation of the Municipality of Clarington and the Ministry of Transportation of Ontario, be rescinded; 5. .THAT the total ofl $6,808 be deducted from the. Subsidy payment currently due to the Munici~iality by the Ministry; and ' 6. THAT Mr. Fausto IConforti, Ministry of Transportation of Ontario, be advised of Counci~L'e decision. No. 1 RepOr~ WD-52-93 No. 2 By-la{v 93-198 No. 3 By-la~rr authorizing the Mayor and Clerk to execute the purchase agreement REPORT NO.: WD-15-96 PAGE 2 2.0 BACKGRODND 2.1 The JacJvnan Road Bridge is a temporary modular structure which the Municipality currently leases from the Ministry of Transportation of Ontario. The Ministry has indicated to staff that they wish to dispose of the structure and have offered to sell it to the Municipality. 3.0 REVIBN AND 3.1 Lease Aoreement In 1993, Council endorsed the recommendations in Report WD-52-93 (Attachment No. 1) and passed By-law 93-198 (Attachment No. 2) authorizing the Mayor and Clerk to execute a Lease Agreement between the Municipality of Clarington and the Ministry of Transportation of Ontario. inadvertently, the Lease Agreement was not executed; however, the funds were provided for in the 1995 Budget and the proposed 1996 Budget. 3.2 Cost of Lease The rental amount to lease the bridge was $3,658.26 per year. 3.3 Payment of Lease, The Municipality currently owes the Ministry $3,658.26 for rental of the structure for 19195. The Draft 1996 Budget presently provides for the rental payment of $3,658, for a total of $7,316. 3.4 Offer to Sell .The temporary modular structure is estimated to be worth $34,030. Since bridge structures are normally aubsidizable at 808, the Ministry of Transportation has verbally agreed to sell the structure to the Municipality for. 208 of the estimated value, which is $6,806. 3.5 Method of Paymeiyt Payment of $7,316 for rental for 1995 and 1996 ie owing to the Ministry. if Clarington proceeds with the purchase, the Municipality will own the structure. The Ministry of Transportation has verbally agreed to accept $6,806 in lieu of the rental fees awing for 1995 and 1996. It is recommended that $6,806 be deducted from the subsidy payment currently owing to the Municipality from the Ministry. The present subsidy payment due is $614,605. THAT Report WD-52-93 be received; 2. THAT the Municipality of Clarington enter into a rental or lease agreement with the Ministry of Transportation Ontario to reimburse the Ministry for the loan of the Temporary Modular Bridge material located on Jackman Road; 3. THAT the proposed By-law attached to Report WD-52-93 be passed authorizing the Mayor and Clerk to execute the appropriate Lease Agreement; 4. THAT provision be made in the 1995 current Budget for payment of the lease in the amount of $3,658; and 5. TBAT S. E. Gwartz, P.Eng., Assistant District Engineer - Municipal, Ministry of Transportation Ontario, be advised of Council's decision. REPORT 1.0 ATTACHMENTS No. 1: Key Map ATTACHMENT N0. 1 WD-15-96 ....:°0..~a:. ~ ~ ~ 1 REPORT NO.: WD-52-93 PAGE 2 No. 2: Correspondence dated October 25, 1993, from the Ministry of Transportation Ontario No. 3: Proposed By-law authorizing the Mayor and Clerk to execute the appropriate Lease Agreement 2.0 BACRGROUND 2.1 The Jackman Road Bridge was acquired by the former Town of Bowmanville in 1970. In 1970, the former Town of Bowmanville installed a bailey bridge over the Bowmanville Creek on Jackman Road. The bridge was loaned to Bowmanville by the Ministry of Transportation Ontario. 2.2 In 1983, the structure was considered unsafe and was replaced with the existing bailey bridge loaned to the former Town of Newcastle by the Ministry of Transportation Ontario. 2.3 Correspondence dated October 25, 1993, from the Ministry of Transportation Ontario (Attachment No. 2) provided the Municipality with three (3) options: i) To return the temporary modular components (bailey bridge) to the Ministry of Transportation Ontario by November 1, 1995; ii) Enter into a Purchase Agreement with the Ministry of Transportation Ontario to be effective November 1, 1995, at a purchase price of $34,030; or iii) Enter into a rental or lease agreement with the Ministry of Transportation} Ontario of which payments would l~i~ REPORT NO.: WD-52-93 PAGE 3 commence on November 1, 1995. Rental payments are approximately $3,658 per year. 3.0 REVIEW AND COMMENT 3.1 Future Development The Northwest Bowmanville Development Group has proposed development plans for the area bounded by Scugog Street to the west, Concession Road 3 to the north, and Liberty Street to the east (Attachment No. 1). It is proposed that, when this development occurs, a new bridge will be constructed north of the existing bridge. The existing Jackman Road will be closed and a cul-de-sac constructed where Jackman Road is terminated. The bailey bridge will they, be returned to the Ministry of Transportation Ontario. 3.2 Development Chartres Policy Report The Development Charges Policy Report, dated February 5, 1992, indicates probable development of this site in five (5) to ten (10) years; subsequently, construction of the new bridge should occur in approximately the same time frame. 3.3 Funding The major source of funding for construction of the new bridge will be acquired from the Development Charges Reserve Fund. 4.0 RECOMMENDATIONS 4.1 It is, therefore, recommended that, since reconstruction of the Jackman Road Bridge is proposed in the five to ten year plan and the bailey bridge will no longer be required, the Municipality endorse Option 3 which requires that a rental or lease agreement be made with the Ministry of Transportation Ontario with payments commencing on November 1, 1995. 1013 REPORT NO.: WD-52-93 PAGE 4 4.2 Rental payments of approximately $3,658 have been calculated in accordance with Schedule B-(B3) of QST-B-20 as summarized in the table attached to correspondence of October 25, 1993. Option 1 - Return the Temporary Modular Components to MTO by November 1, 1995. Option 2 - Enter into a purchase agreement with MTO to be effective November 1, 1995. The purchase price (depreciated value) of $34,030.00 has been calculated in .accordance with Schedule B-{B2) of Directive QST-B-20, as summarized in the attached table. Option 3 - Enter into a rental or lease agreement with MTO of .which payments would commence on November 1, 1995. Rental payments of approximately $3,658.00 per year has been calculated in accordance with Schedule B-(B3) of QST-B-20 as summarized in the attached table. It would.be appreciated if you could review these options and provide MTO with your selected plan by December 1, 1993.
