It is respectfully recommended that the General .Purpose. and
Administration Commjittee recommend to Council the following:
1. TBAT Report WDr6-96 be received;
-2. THAT the bisector of Public works be authorized to .issue a
'Certificate of Acceptance' for the roads, street lights and
other related Works, constructed within Parts 2 and 4 on Plan
lOR-1145., Pars 3, 8 and 9 on Plan lOR-3237,. and Part.l on
Plan 40R-.165921,; and
3. THAT Council approve the by-law attached to Report WD-6-96
assuming the streets within Parts 2 and 4 on Plan lOR-1145,
Pasta 3, 8 an~ 9 on Plan 10R-3237, and Part 1 on Plan 40R-
16592 as public highways.

2.0 BACKGROUND
2.1 The former Town of Newcastle entered into a subdivision
agreement regi$tered on September 3, 1987, with Betty Jo King
and Archie Earl King to develop lands by plan of subdivision,
located in Cou~tice and described as Plan lOM-797 (Attachment
No. 1). The agreement required the developer to construct all
roadworks, including hot-mix paving, curb and .gutter,
sidewalks, boulevard sodding and street trees, a storm
drainage system and street lights, hereinafter referred to as
the 'Works'.
2.2 At a meeting of Council held Monday, March 14, 1988, the
following resolution was passed:
"THAT Report PD-57-88 be received; and
THAT the application, submitted by Dr. A. E.
Ring to amend the Courtice South Neighbourhood
Developmet-t Plan, to delete a local road in
order to permit the construction of two ( 2 )
single family dwellings, be approved
conditional upon the applicant constructing a
permanent road connection to the satisfaction
of the Director of Public Works, over the
presently existing temporary emergency
access."
2.3 The permanent road connection (Whittaker Avenue) was completed
and a 'Certificate of Completion' was issued dated May 31,
1991. The Works were placed on a one (1) year maintenance
period which expired on May 31, 1992. The Works were
inspected and all deficiencies have now been rectified to the
satisfaction of the Director.

2.4 it is now appropriate to issue a 'Certificate of Acceptance'
for the Whittaker Avenue roadworks. The subdivision agreement
.provides for this certificate to be issued by the Director of
Public Works, subject to the approval of Council.
2.5 Further to the issuance of a 'Certificate of Acceptance', a
By-law (Attacihment No. 2) is required to permit the
Municipality to assume Whittaker Avenue, constructed within
Parts 2 and 4 pn Plan lOR-1145, Parts 3, 8 and 9 on Plan lOR-
3237 and Part 1 on Plan 40R-16592, as public highway.

BY-LAW NO. 96-
Being a By-law to lay out, establish and
assume Whittaker Avenue and part of
Prestonvale Road as public highway
NOW THEREFORE THR COONCIL OF THS CORPORATION OF THE MONICIPALITY OF
CLARIDTGTON HHREBY ENACTS AS FOLLOWS:
1. THAT the lands described in Schedule "A" hereto and forming
part of this Sy-law are hereby laid out and established as
public highway to be known~as Whittaker Avenue and assumed for
public use by the Corporation.
2. THAT the lands described as Part of Lot 33, Concession 2 and
Part of the road allowance between Lots 32 and 33, Concession
2, Geographic Township of Darlington, Municipality of
Clrlington, Regional Municipality of Durham designated as Part
9 on Plan 10R-3237 are hereby laid out and established as
public highway to be known ae part of Prestonvale Road and is
assumed for public used by the Corporation.
BY-LAW read a first and second time this 12th day of February,
1996.
BY-LAW read a third time and finally passed this 12th day of
February, 1996.
