THAT Report WD-2 X96 be received; 2. THAT the Director~of Public Norke be authorized to issue a •Certificate of Acceptance' for",the roads, street lights and other related Works, constructed within Plan 40M-1668; and 3. THAT Council approve the Sy-law attached to Report ND-2-96 assuming certain streets vtithin Plan 40M-1668 as public highways. RBPORT 1.0 ATTACHMSNTS 2.0 2.1 2.2 No. 1: Rey trap No. 2: Road'iDedication By-law for Plan 40H-1668 SaCRGROUITD ', The former Town of Newcastle entered into a Subdivision Agreement dated July 10, 1991, with 671461 Ontario Limited to develop lands by plan of subdivision, locpted in Bowmanville and described as Plan 40M-1668 (Attachment No. 1). The agreement required the developer to construct all roadworks, includ~nq hot-mix paving, curb and gutter, sidewalks, boulevard sodding and atre~t trees, a storm drainage system and street lights, hereinafter referred to as the •worke~. she subdivision Agreement provides for the separation of the works into two (2) stages: ,~uso. ®~~o>.PEA ~ ®11 7 1t8PORT No.: wD-2-96 pig 2 (a) storm sewer system, and (b) Roads and Above Ground services. 2.3 council previously approved Report WD-19-94, which authorized the issuance of a 'certificate of Acceptance' for the Storm Sewer system for Plan 40M- 1668. 2.4 The Roads and Above Ground services were completed and a 'certificate of Completion' was i~esued dated November 1, 1993. The works were placed on a two (2) year maintenance period which expired on November 1, 1995. These works were subsequently inspected and all deficiencies have now been rectified to the satisfaction of the Director. 2.5 It is now appropriate to issue a 'Certificate of Acceptance' for the Roads and Above Ground Services. The subdivision agreement provides for this certificate to be issued by the Director of Public works, subject to the approval of Council. 2.6 Further to the ipauance of a 'Certificate of Acceptance', a By-law is required to permit the Municipality to assume certain streets within Plan 40M-1668 as public highways (Attachment No. 2). Stockwell Chief Administrative officer O ~ 0 1011 THS CORPORATION OF THB MOMICIPALITY OF CLARIDIGTOM BY-LAW MOMBSR 96- Being a By-law to assume certain streets within the Municipality of Clarington as public highways in the Municipality of Clarington MOW THHRSPORH, the Council of The Corporation of the Municipality of Clarington enacts as follows: 1. THAT the streets described in Registered Plan 40M-1668 (described in Schedule "A" attached hereto and forming part of this By-law), all being in the Municipality of Clarington, in the Regional Municipality of Durham, are hereby accepted by The Corporation of the Municipality of Clarington as public highways, and assumed by the said Corporation for public use.
