TEAT Report WDrl-96 be received; and 2. THAT the Diregtor of Public Works be authorized to issue a 'Certificate o,f Acceptance' for .the roads, street lights and other related ~orks, constructed within Plan 40M-1675 and 40M- 1693; and 3. THAT Council ajpprove the by-laws attached to Report WD-1-96 assuming certain. streets within Plans 40M-1675 and 40M-1693 as public highway. No. 3: Road~,Dedication By-law for Plan 40M-1693 2.0 BACKGROUND 2.1 The former Town of Newcastle entered into two (2) subdivision agreements daged September 3, 1991,. and November 18, 1991,. 2~~~ o.oE °®r~.~,. REPORT NO.: WD-1-96 PAGE 2 with Macourtice Developments Inc. to develop lands by plan of subdivision, located in Courtice and described as Plans 40M- 1675 and 40M-1693 (Attachment No. 1). The agreements required the developer to construct all roadworks, including hot-mix paving, curb and gutter, sidewalks, boulevard sodding and street trees, a storm drainage system and street lights, hereinafter referred to as the 'Works'. 2.2 Plan 40M-1675 (Phase 1) subdivision agreement provides for the separation of the Works into three (3) stages: a) Storm Sewer System, b) Roads and Above Ground Services, and c) Water Quality Work. 2.3 Council previously approved Report WD-7-94, which authorized the issuance of a 'Certificate of Acceptance' for the Storm Sewer System for Plan 40M-1675 (Phase. 1). 2.4 Plan 40M-1693 (Phase 2) subdivision agreement provides for the separation of the Works into two (2) stages: a) Storm Sewer System, and b) Roads and Above Ground Services. 2.5 Council previously approved Report WD-42-94, which authorized the issuance of a 'Certificate of Acceptance' for the Storm Sewer System for Plan 40M-1693 (Phase 2). 2.6 The Roads and Above Ground Services for both Phase 1 and Phase 2 were completed simultaneously, and a 'Certificate of Completion' was issued dated November 15, 1993.- The Works were placed on a two (2) year maintenance period which expired on November 15, 1995. These Works were subsequently inspected 1002 REPORT NO.: WD-1-96 PAGE 3 and all deficiencies have now been rectified to the satisfaction of the Director of Public Works. 2.7 It is now appropriate to issue a 'Certificate of Acceptance' for the Road and Above Ground Services for both Phase 1 and Phase 2. The subdivision agreements provide for this certificate to be issued by the Director of Public Works, subject to the approval of Council. 2.8 Further to the issuance of a 'Certificate of Acceptance', by- laws are required to permit the Municipality to assume certain streets within .Plans 40M-1675 and 40M-1693 as public highways (Attachment Nod. 2 and 3). NOW THERHFORE, the Council of The Corporation of the Municipality of Clarington enacts as follows: 1. THAT the lands described as Block 87, Plan 40M-1675, in the Municipality of Clarington, Regional Municipality of Durham, are hereby established, laid out, dedicated as public highway and assumed by the said Corporation for public use. 2. THAT the streets and road widening Block 86, described in Registered Plan 40M-1675 (described in Schedule "A" attached hereto and forming part of this By-laws, all being in the Municipality of Clarington, in the Regional Municipality of Durham., are hereby accepted by The Corporation of the Municipality of Clarington as public highways, and assumed by the said Corporation for public use. BY-LAW read a first and second time this 15th day of January, 1996. HY-LAW read a third time and finally passed this 15th day of January, 1996. Municipality of Clarington, in the Regional Municipality of Durham, are hereby accepted by The Corporation of the Municipality of Clarington as public highways, and assumed by the said Corporation for public use.
