Call Present were: Councillor Ann Cowman, Chairman Councillor Keith D. Barr, Member Councillor William Clarke, Member, at 9:45 a.m. Councillor Ivan M. Hobbs, Member Councillor Jasper W. Holliday, Member Mayor G. B. Rickard, Member, at 9:35 a.m. Councillor Maurice Prout, Member Deputy Clerk, G. Gray, Secretary Also Present: Director of Planning, Don Smith Planner, Current Operations, Norma Forrest Resolution #PD -463-79 Moved by Con. Prout, seconded by Con. Barr Adoption THAT the minutes of the meeting held on October 1, 1979 of Minutes be adopted as read. "CARRIED" Delegations Mr. Jim Rowat, Resources Manager for the Ganaraska Region Conservation Authority and Mr. Roy Forrester, Chairman of Ganaraska the Authority were present. Mr. Rowat explained the Region Valleyland Mapping in the Authority's portion of the Town Conservation of Newcastle, which is basically former Clarke Township. Authority He explained Flood and Fill Line mapping for the areas, Valleyland Wilmot Creek, Foster Creek and the Lake Ontario Area. Mapping He explained that a set of maps was in the Municipal Office and in Hampton for the use of the Building and Planning Regulations Departments and asked that the municipality approve the implementations of the Regulations of the Authority. Mr. Forrester explained the method of funding should a municipality wish to turn over land to the Authority. He explained that the Authority would develop the property andlease it back to the municipality for care. He stated the improvement to the Ganaraska River in the past.25 years and stated that the summer flow had increased 40%. Planning and Development Committee - 2 - October 15, 1979 Rezoning Mr. John Starzynski spoke to Report P-163-79. Z -A-10-3 Leo Watson Rezoning Z -A-10-3, and stated that his Watson client was willing to put in a retaining wall to Mr. Starzynski prevent erosion. Mr. Paul Stagl Mr. Paul Stagl of Marshall Macklin Monaghan, representing Danad Dr. Zacharow and Danad Properties, addressed the Committee. Properties Conflict Councillor Holliday declared a Conflict of Interest and of Interest withdrew from the Committee Table. Mr. Stagl presented a proposed plan of subdivision for the property, west of Liberty Street and North of Concession, in Bowmanville. He explained the number of units and the kinds of housing which would include Single family, semis, townhouses and apartments and some commercial, on 133 acres of land; 22 acres in the first phase. Mr. Ekland Mr. Ekland explained the engineering and servicing of the proposed subdivision. Mr. Hammer Mr. Hammer of the Planistics Group presented a proposed Planistics plan of subdivision for estate residential, Lots 3 and 4, Group Concession 4. He spoke for Mr. McLellan, one of the for principals. There was a total of 150 acres, 50% could McLellan be developped for a total of 41 lots with areas up to 4 acres. The Plan is in circulation and is the subject property of O.P.A. 75-29/D. Resolution #PD -464-79 Moved by Con. Prout, seconded by Con. Clarke Mr. Walter THAT Mr. Walter Grieve be heard. Grieve "CARRIED" Washington Mr. Grieve spoke for Washington Gardens Cemetery Gardens Proposal and stated that they agree with Staff Cemetery report P-184-79. Proposal Resolution #PD -465-79 Moved by Con. Prout, seconded by Con. Barr Recess THAT there be a 10 minute recess. "CARRIED" Planning and Development Committee - 3 - October 15, 1979 Resolution #PD -466-79 Moved by Con. Hobbs, seconded by Con. Holliday THAT the recommendations in Report P-163-79, Watson Rezoning, be endorsed and Application 1. Application for rezoning number Z -A-10-3 be denied and for Rezoning Z -A-10-3 2. the Town Solicitor and appropriate Town Staff be (Watson) instructed to proceed with the mandatory injunction granted by the Supreme Court of Ontario, on December 15, 1978, in respect of the subject lands. Clarke THAT the matter be referred to the meeting of November 8, 1979, in order that the erosion controls, verbally presented to this meeting may be presented to the Ganaraska Region Conservation Authority for their perusal and a recommendation to this Committee. "CARRIED" Planning and Development Committee - 4 - October 15, 1979 Resolution #PD -470-79 Moved by Con. Prout, seconded by Con. Holliday McEwen THAT Report P-179-79, McEwen purchase from Town, Purchase part of Lot 14, Concession 1, Bowmanville, be From Town tabled to the meeting of November 8, 1979 so that the applicants may attend if they wish to do so. "CARRIED" Resolution #PD -471-79 Moved by Mayor Rickard, seconded by Con. Hobbs O.P.A. 75-29/D THAT Report P-181-79, Proposed Official Plan Brooks Amendment 75-29/D, Part of Lots 3 and 4, Concession Lovell 4, former Township of Darlington, Brooks, Lovell McLellan McLellan, be received for information. "CARRIED" Resolution #PD -472-79 Moved by Mayor Rickard, seconded by Con. Prout O.P.A. 76-35/D THAT Report P-182-79, Proposed Official Plan Waverly Amendment 76-35/D (Revised) part of Lot 24 Heights Concession 9, former Township of Clarke, Subdivision Waverly Heights Subdivision (Oshawa) Limited, (Oshawa) Ltd. be received for information. "CARRIED" Conflict Councillor Holliday declared a possible Conflict of of Interest in the previous matter and withdrew Interest from the Committee Table. Resolution #PD -473-79 Moved by Con. Prout, seconded by Con. Holliday Durham THAT the recommendation in Report P-183-79 be adopted Region and the Town Clerk be instructed to forward a copy of Development the Terms of Reference for the Financial Analysis and Association Development Strategy Study to the Durham Region Development Association and to advise them to make further inquiries of the Planning Department in respect of this matter. Prout Rezoning THAT Report P-186-79 be endorsed and application Z -A-1-8-2 for Rezoning Z -A-1-8-2, part Lot 11, Concession 3, Rills of former Township of Darlington, East Woodbridge Liberty Developments (Rills of Liberty North) be approved North and the amending by-law be forwarded to Council for approval. "CARRIED" Resolution #PD -480-79 Moved by Con. Prout, seconded by Con. Holliday Rezoning THAT the recommendation in Report P-187-79 be Z-0-19-1 endorsed and the amending zoning by-law be Splash forwarded to Council relative to Application Z-0-19-1, Proposed Swimming Pool and Recreation Complex. Resolution #PD -481-79 Moved by Con. Holliday, seconded by Con. Clarke THAT the foregoing resolution be amended by adding "and the third reading of the by-law be withheld until final fund raising has taken place". "CARRIED" On being put to a vote, Resolution #PD -480-79, as amended, was lost. Resolution #PD -482-79 Moved by Mayor Rickard, seconded by Con. Hobbs THAT the recommendation in Report P-187-79 be endorsed and the amending by-law be forwarded to Council for approval. Clarke THAT Item A72/79 of the minutes of the meeting of the Committee of Adjustment held on September 26, 1979 be appealed and Staff review this application and report to the next meeting. Barr THAT the recommendation in Report P-90-79 be endorsed and the Region of Durham be advised that the Town of Newcastle recommends denial of Official Plan Amendment No. 75-32/D/ND affecting part of Lot 7, Concession 1, former Township of Darlington, on the basis that it is premature. Pollution Control Plant "CARRIED" It was noted that the Port Darlington Control Plant and the Soper Creek Water Pollution Control Plant are two separate Plants. Resolution G6PD -489-79 Moved by Con. Hobbs, seconded by Con. Barr Bowmanville THAT Report P-190-79 relative to Site Plan Mall Agreement and Rezoning by-law for Bowmanville. Rezoning Mall, be received for information. "CARRIED" Resolution #PD -490-79 Moved by Con. Clarke, seconded by Con. Barr Valleyland THAT Council support the Ganaraska Region Regulations Conservation Authority in implementing Valley- Ganaraska Region land Regulations as provided for in Section 27 Conservation of the Conservation Authorities Act, Revised Authority Statutes of Ontario, 1970. "CARRIED" Resolution G6PD -491-79 Moved by Con. Holliday, seconded by Con. Clarke Lamb's THAT this Committee support a delegation to Road Regional Council on October 17 with regard to Arterial Lamb's Road as the arterial road, in support Road of this project and Councillor Holliday be delegated as spokesman. "CARRIED" Conflict of Mayor Rickard declared a Conflict of Interest in Interest the foregoing matter and retired from the Committee Table. Hobbs, seconded by Mayor Rickard Floodline THAT Committee concur with the recommendation in the Mapping report of the Director of Public Works re Floodline Project Mapping Project Robinson Creek Federal -Provincial Robinson Flood Damage Reduction Program and the subject Creek document be referred to: (a) The Finance and Administration Committee for review of costs relevant to a municipality. (b) The Public Works Committee for a review of the physical factors and implications contained therein. "CARRIED" Resolution #PD -493-79 Moved by Con. Hobbs, seconded by Con.
