Prout, seconded by Mayor Rickard THAT Report P-171-79, relative to the Soper Creek Neighbourhood Plan be endorsed and: 1. The report be received Soper 2. The Soper Creek Neighbourhood Plan be adopted, Creek as revised, and forwarded to Durham Region, with Neighbourhood all relevant background material, for their approval; and Plan 3 The draft plans of subdivisi-allocated within the Soper Creek Neighbourhood, and dealt with under separate reports, be considered for Draft Plan approval conditional upon the provision of services, and specifically of sewage capacity. "CARRIED" Resolution #PD -445-79 Moved by Con. Prout, seconded by Mayor Rickard THAT Report P-172-79 be endorsed and relative to reserve capacity at the Soper Creek Water Pollution Control Plant, 1. The report be received Reserve 2. The existing commitments of sewage capacity which Capacity have been allocated but remain unused, be reaffirmed Soper Creek for a period of one year at which time they shall again Water be reviewed and, if necessary, reallocated; and that Pollution 3. Prout Rezoning THAT Rezoning Z-A-2-6-3, Brooking, be considered Z-A-2-6-3 by the Committee. Brooking "CARRIED" Conflict Councillor Holliday declared a conflict of interest of Interest in the Brooking rezoning and withdrew from the table. Resolution #PD-448-79 Moved by Con. Prout, seconded by Con. Hobbs THAT the Committee support the application for rezoning, Z -A-2-6-3, Lot 10, Concession 2, Bowmanville, A. "CARRIED" Resolution #PD -450-79 Moved by Mayor Rickard, seconded by Con. Holliday Rezoning THAT the recommendations in Report P-175-79, application Z -A-1-16-1 for Rezoning Number Z -A-1-16-1, part of lots 32 and 33, Roti Concession 8, former Township of Darlington - Salvatore Roti, be endorsed and the application be approved and the attached by-law be forwarded to Council for approval subject to corrections on Schedule "X". "CARRIED" Planning and Development Committee - 8 - October 5, 1979 Resolution YiPD-451-79 Moved by Mayor Rickard, seconded by Con. Barr THAT the recommendations in Report P-176-79 relative to Application for Plan of Subdivision Number 18T-76011, part of Lot 9, Concession 2, Bowmanville, Penwest Developments Ltd., be endorsed and: 1. That Draft Plan of Subdivision Number 18T-76011, dated March 26, 1979 and revised on June 1, 1979, be further revised as follows: 1. That sufficient lands to complete Road 'D' as proposed in Draft Plan of Subdivision Number 18T-76038 be incorporated into Block "A" and designated for road purposes. 2. That Lots 55, 56, 57, 58, 64, 65 and part of Lots XX and YY be incorporated into Block "E" measuring 130 feet by 230 feet, and designated for park purposes. 3. That Lots 203 to 210 be revised to provide minimum lot frontages of 15 metres. 4. That all other lots proposed for single family uses be revised to provide minimum lot frontages of 12.5 metres. 5. That a 3 metre block be created between lots DD and EE to be used as a pedestrian walkway, and designated Block "D". 6. That Block "K" be renamed "Street 'H". 7. That Lots 12, 13, 17 and 18 be redesignated Blocks P, G, H, and I, respectively, and designated for future development. 8. That Street "B" intersect with Street "C" instead of Street "A" and that the lotting be revised accordingly. 9. That Block 'P' be designated for future development. 10. That 0.3 metre parcels of the northern limit of Street "F" the western limit of Street "H" and the widened limits of Mearns Avenue be shown on the Plan as Blocks "C", "F", and "G", respectively. 2. That 5 copies of a revised plan of subdivision incorporating these revisions be submitted to the Town of Newcastle Planning Department for review. 3. That once these revised plans have incorporated the required requested revisions, staff be authorized to inform the Minister of Housing that the Town of Newcastle recommends approval of the application for plan of subdivision Number 18T-76011, subject to the following conditions: 1. That this approval applies to draft plan, dated March 26, 1979, as revised on June 1, 1979 and further revised according to the recommendations of Report P-176-79 of the Corporation of the Town of Newcastle. Planning and Development Committee - 9 - October 5, 1979 2. That the road allowances in this draft plan shall be dedicated as public highways. 3. That Block "A" shall be conveyed to the Town of Newcastle for road purposes. 4. That a 3 metre parcel of land abutting Mearns Avenue shall be dedicated to the Town of Newcastle for road widening purposes. 5. That a 3 metre parcel of land abutting Concession Street shall be dedicated to the Town of Newcastle for road widening purposes. 6. That Blocks "C", "F" and "G" be deeded to the Town of Newcastle as 0.3 metre reserves. 7. That Blocks N, 0, P, F, G, H and I shall be reserved for future development in conjunction with abutting lands. 8. That the Owners shall convey Blocks "L" and "M" to the Town of Newcastle for conservation and open space purposes. 9. That Block "E" shall be conveyed to the Town of Newcastle for park purposes, under the provisions of Section 33(5)(a) of The Planning Act. 10. That Block "B" shall be conveyed to the Bowmanville Public Utilities Commission for an electrical substation. 11. That Block "D" be conveyed to the Town of Newcastle for public purposes. 12. That the existing Bell Telephone Easement on the site, and associated cables thereon, shall be relocated, at the owner's expense, to the satisfaction of Bell Canada. 13. That a temporary turning circle shall be provided adjacent to the 0.3 metre reserve abutting Street "F". 14. That the necessary amendment to the Restricted Area (Zoning) By-law of the former Town of Bowmanvil�e shall be approved by the Ontario Municipal Board. 15. That the Plan proceed by two separate registrations; the registration to be composed of Streets A, B, C, D,E, F and H and the lots and Blocks abutting these streets and Concession Street and the second to be composed of Street G and all remaining lots. 16. That the registration of the second portion of the plan_. be permitted only when Street "F" is extended to Concession Street. 17. That such easements as may be required for utility or drainage purposes shall be granted free and clear of all encumbrances to the appropriate authority. 18. That before final approval is given to the plan, adequate sewer and water treatment facilities shall be available to service the site 19. That the owner agrees in writing to satisfy all the requirements, financial and otherwise, of the Town of Newcastle and the Region of Durham regarding the provision of roads, installation of services, and drainage. That the owners enter into a subdivision agreement with the Corporation of the Town of Newcastle to include, in addition to the usual requirements, the following provisions that the owners agree: (a) to neither place nor remove fill of any kind, whether originating on the site or elsewhere, nor alter any existing vegetation in Block "L" without the written permission of the Central Lake Ontario Conservation Authority. (b) That Blocks F, G, H. I, N, 0 and P shall not be developed except in conjunction with adjacent lands. Subdivision 21. That the plan conform with the land use designations 18T-76011 - and policies of the Soper Creek Neighbourhood Plan, Penwest as approved by the Town of Newcastle and the Region Developments of Durham. Limited 22. That an appropriate storm water management study be prepared, to the satisfaction of the Town of Newcastle and the Central Lake Ontario Conservation Authority and at the applicant's expense. 4. That staff be authorized to change the lot and block numbers cited in these conditions of draft approval to reflect the corresponding lot and block numbers of the revised plan required by (2) above. Prout THAT Report4178-79 be endorsed and, relative to Application for Subdivision Number 18T-72556, part of lot 8, Concession 1, former Town of Bowmanville, Schickedanz Developments Ltd. that the application be recommended to the Minister of Housing for draft approval, subject to the following revisions and conditions: Revisions 1. That Court D and Lots 130 to 138 be incorporated into a Block designated for park purposes. 2. That 3 metre parcels of land between lots 104 and 105, 116 and 117, 176 and 177, and 159 and 160 be incorporated into Blocks for pedestrian walkways. Planning and Development Committee - 11 - October 5, 1979 3. That the 6 metre access to Block "A" be deleted and that a 6 metre strip of land between Lots 25 and 26 form part of Block "A". 4. That Lots 199 to 203 be relotted as single family lots with a minimum frontage of 15 metres. 5. That the minimum lot frontage for all corner lots shall be 15 metres. Cnnrii H nnc 1. That this approval shall apply to a Plan by Marshall, Macklin, Monaghan, dated February 2, 1979, and revised on August 2, 1979, to be further revised according to the recommendations of Report P-178-79. 2. That .0.3 metre reserve abutting Streets "C", "F" and Mearns Avenue, as shown on the Draft Plan, be deeded to the Town of Newcastle. 3. That the road allowances in this draft plan shall be dedicated as public highways. Subdivision 4. That a 3 metre parcel of land abutting Mearns Avenue 18T-72556 shall be dedicated to the Town of Newcastle for road Schickedanz widening purposes. Developments 5. That a 3 metre parcel of land abutting Concession Street Ltd. shall be dedicated to the Town of Newcastle for road widening purposes. 6. That Blocks B, C, and D shall be reserved for future development in conjunction with abutting lands. 7. That the Owners shall convey Block "A" to the Town of Newcastle for conservation and open space purposes. 8. That the Park Block shown on the revised Plan shall be conveyed to the Town of Newcastle for park purposes, under the provisions of Section 33(5) (a) of The Planning Act. 9. That the 3 metre blocks between lots 104 and 105, 116 and 117, 176 and 177, and 159 and 160 shall be conveyed to the Town of Newcastle for public purposes. 10. That an appropriate storm water management study be prepared, to the satisfaction of the Town of Newcastle and the Central Lake Ontario Conservation Authority, and at the applicant's expense. 18. That the development of Lots 152 to 157 and 16 to 22 shall be contingent on the approval of an engineering report, prepared by the Owner at his expense, detailing the proposed cut and fill methodology for the modification of the Soper Creek Floodplain limits, and that the rear lines of Lots 16 to 22 be fixed as a result of the findings of this study. This report shall be subject to the approval of both the Central Lake Ontario Conservation Authority and the Ministry of Natural Resources. 19. That all works to service these lands be designed to the Town of Newcastle's Design Criteria and Standard Drawings. "CARRIED" Resolution #PD -453-79 Moved by Con. Prout, seconded by Con. Prout Rezoning THAT Report P-162-79, Rezoning Application Z-0-13-1 Z=0-13-1 Soper Creek Water Pollution Control Plant, be tabled Soper Creek until written confirmation is received from the Region Water of Durham that they are withdrawing the application.
