Hobbs, Member Councillor Jasper W. Holliday, Member Councillor Maurice Prout, Member Mayor G. B. Rickard, Member Deputy Clerk, G. Gray, Secretary Also Present: Director of Planning, Don Smith Planner, Current Operation, Norma Forrest Town Manager, A.C.W. Guiler, at 10:00 a.m. Resolution G6PD -414-79 Moved by Con. Prout, seconded by Con. Barr Adoption THAT the minutes of the meeting held on September 6, 1979 of Minutes be adopted as read. "CARRIED" Public The meeting had been advertised as a Public Meeting Meeting to enable the Committee to hear the views of the Public Rezoning in respect of an application for Zoning By-law Amendment Williams for Williams Grove Orchards, part of Lot 34, Concession 3, Grove former Township of Clarke to permit the expansion of the Orchards uses permitted on this 32 hectare orchard to include apple packing and a business office accessory to the farming operation on the lot. Mr. Monty Fordham, Barrister and Mr. Walter Gibson appeared in support of the application. No person appeared to object to the application. Resolution G6PD -415-79 Moved by Con. Hobbs, seconded by Con. Clarke Delegations THAT the representative of the Ministry of Housing be heard following Mr. Bruce Brown who was the next listed delegations. "CARRIED" Planning and Development Committee - 2 - September 17, 1979 Windsweep Mr. Bruce Brown of Bruce Brown Associates Ltd., Farms on behalf of Windsweep Farms, spoke to the proposed Waterfront Waterfront Plan and gave further information relative Plan to the Financial and Economic Impact, taxation and - B.Brown employment etc., and.was asked to confirm his presentation in writing, with back up information. Resolution #PD -416-79 Moved by Con. Holliday, seconded by Con. Clarke Recess THAT there be a 5 minute recess. "CARRIED" Ministry of Mrs. Gwen Maloney, of the Community Housing Division Housing of the Ministry of Housing spoke to the Committee Rent -Geared- relative to Senior Citizens' Rent -Geared -To -Income To -Income programs. She explained that the Provincial Government Housing no longer provides this kind of housing but she -G. Maloney outlined the programs available to municipalities. Resolution #PD -417-79 Moved by Con. Hobbs, seconded by Con. Holliday THAT Mrs. Maloney's presentation be acknowledged and referred to Staff. "CARRIED" Resolution #PD -418-79 Moved by Con. Holliday, seconded by Con. Hobbs Lunch Recess THAT the meeting adjourn for lunch until 1:30 p.m. "CARRIED" The meeting reconvened at 1:30 p.m. with all members of the Committee present. Resolution #PD -419-79 Moved by Con. Clarke, seconded by Con. Prout Delegations THAT Mr. Doug Roy, Mr. Dan Russell and Miss Caverley be given 10 minutes each to address the Committee. "CARRIED" Planning and Development Committee - 3 - September 17, 1979 Mr. Doug Roy Mr. Doug Roy spoke to Planner's Report P-167-79 and suggested some revisions to the conditions. Mr. D. Russell Mr. Dan Russell spoke for Paramount Development Paramount Corporation and asked that Report P-161-79 Development be deferred to the next meeting so that Mrs. Corporation Gravely could be present. Miss Caverly Miss Caverley spoke to Report P-163-79, Leo Watson Leo Watson Rezoning, and asked that it be tabled until her Rezoning firm had a chance to review the report. Resolution #PD -420-79 Moved by Con. Holliday, seconded by Con. Prout Gabourie THAT the report on Dr. Michael's presentation re Application Gabourie application, be referred to the next meeting. "CARRIED" Resolution #PD -421-79 Moved by Con. Hobbs, seconded by Con. Holliday TM -95-79 THAT Report TM -95-79 , Policy re Processing and Subdivision Review of Subdivision Applications, be tabled Applications until the next meeting. Policy "CARRIED" Resolution #PD -422-79 Moved by Con. Prout, seconded by Con. Barr Parking THAT the recommendation in Report P-159-79, re Requirements Parking Requirements, Bowmanville, be endorsed Bowmanville and the attached by-law be forwarded to Council By -Law 1587 for approval. "CARRIED" Resolution #PD -423-79 Moved by Con. Prout, seconded by Con. Holliday P-160-79 THAT the recommendation in Report P-160-79 be Newcastle endorsed and the Newcastle Chamber of Commerce Chamber of be forwarded a copy of the report and requested Commerce re to arrange a meeting with Planning Staff to discuss Rezoning rezoning procedures in the Town. Planning and Development Committee - 4 - September 17, 1979 Resolution #PD -424-79 Moved by Con. Hobbs, seconded by Con. Holliday THAT the report be tabled and the letter writer be advised that until an application for rezoning is forwarded to the Planning Department by the owner of the property, no further action can be taken. "CARRIED" Resolution #PD -425-79 Moved by Con. Hobbs, seconded by Con. Holliday P-161-79 THAT Report P-161-79 - Paramount Development Paramount Corporation re O.P.A. 20, be held in abeyance Development Corp. until the next meeting. "CARRIED" Resolution #PD -426-79 Moved by Con. Prout, seconded by Mayor Rickard THAT the recommendation in Report P-162-79 re Soper Creek Water Pollution Control Plant Rezoning rezoning, be endorsed and the Region of Durham Soper Creek Works Department be advised that the Town agrees Water with the preclusion of Residential uses from the Pollution subject lands, but that an industrial zoning would Control be more appropriate and that the attached by-law Plant be forwarded to Council for approval and to the Region of Durham for information; subject to input from a Public Meeting to be held at the next Planning and Development Committee Meeting. Holliday P-163-79 THAT Report P-163-79 - Application for Rezoning Rezoning Z -A-3-10-3, part lot 28, Concession 5, Clarke, Leo Watson Leo Watson, be tabled to the next meeting. "CARRIED" Planning and Development Committee - 5 - September 17, 1979 Resolution #PD -428-79 Moved by Con. Holliday, seconded by Con. Prout Ministry of THAT the recommendation in Report P-164-79 be Housing endorsed and it be recommended to Council that Annual The Town of Newcastle hereby endorses the housing Housing Review "targets" included within the Ministry of Housing's Questionnaire Annual Review questionnaire attached, and notes that the Town will be preparing a Municipal Housing Statement detailing its housing needs in the near future. "CARRIED" Resolution #PD -429-79 Moved by Con. Prout, seconded by Con. Hobbs Zoning THAT the recommendation in Deport P-165-79 be By-law endorsed and the by-law amending restricted area LDCM Investments by-law 1587, as amended, of the former Town of and Barmond Bowmanville (LDCM Investments and Barmond Builders Builders Ltd. Ltd., part of Lot 14, Concession 2, former Township of Darlington) be forwarded to Council for approval. "CARRIED" Resolution #PD -430-79 Moved by Mayor Rickard, seconded by Con. Holliday L & R THAT the recommendation in Report P-166-79 be endorsed Subdivision and the subdivision agreement between the Town and Agreement L & R Construction Ltd., be recommended to Council for approval including the necessary changes and further that a by-law be prepared for the purpose of executing the Agreement. Clarke Subdivison THAT the following recommendation 2.(b), as amended 18T-77002 in Report P-167-79 re Application for Subdivision D R Agencies Number 18T-77002, part lots 32 and 33, Concession 2 former Township of Darlington (D R Agencies) be recommended to Councils Planning and Development Committee - 6 - September 17, 1979 "THAT Application for Plan of Subdivision 18T-77002 be approved, subject to the following revisions and conditions: Revisions 1. That the radius of the cul-de-sac bulb on the Plan conform to Town of Newcastle design criteria. 2. That a 0.3 metre strip of land adjacent to the easterly limit of the road allowance between lots 32 and 33 be incorporated into a block. Conditions 1. That this approval applies to the draft plan dated May 8, 1979, drawn by D. G. Biddle and Associates Limited, and revised according to the recommendations of Report P-167-79. 2. That the road allowances included in this draft plan be dedicated as public highways. 3. That the streets on the plan be named to the satisfaction of the Regional Municipality of Durham and the Town of Newcastle. 4. That Block "B" be conveyed to the Town of Newcastle for conservation and open space purposes. 5. That the owner dedicate up to 5% of the land included in the proposed plan for park purposes, provided that the said park block shall not comprise creek valley lands, flood susceptible lands or lands with hazardous characteristics. The Town will accept cash -in -lieu of the parkland dedication, under the provisions of Section 33 (8) of The Planning Act. 6. That the necessary amendment to the Darlington Zoning By-law be approved by The Ontario Municipal Board. 7. That the owner enter into a subdivision agreement with the Town of Newcastle to include, in addition to the usual requirements, the following provisions: Planning and Development Committee - 7 - September 17, 1979 That the Owner agrees: (a) to neither place nor remove fill of any kind, whether originating on the site or elsewhere, nor construct any building or structure on the site without the written permission of the Central Lake Ontario Conservation Authority. (b) to inform all prospective purchasers that their children will only be picked up by the school bus on roads now in existence, or at another location convenient to the school board. (c) that the development of the plan will be subject to architectural control by the Town of Newcastle. (d) that the development of Block "A" for commercial uses will be premature until a development agreement, as described in Section 35 (a) of The Planning Act, is signed by the applicant and the Town of Newcastle. 8. That a 0.3 metre reserve be dedicated to the Town of Newcastle abutting that portion of the road allowacne between lots 32 and 33 which is to form the access road to the subdivision. 9. That such easements as may be required for utility or drainage purposes shall be granted to the appropriate authority. 10. That the owner agree in writing to satify all the requirements, financial and otherwise, of the Town of Newcastle concerning the provisions of roads, installation of services and drainage. 11. That all storm drainage works meet the require- ments of the Town of Newcastle as determined by the preparation of a Storm Water Management Plan for the Courtice Drainage Area". Barr Committee of THAT the minutes of the meeting of the Committee Adjustment of Adjustment held on August 22, 1979, be received for information. "CARRIED" Addendum Resolution IIPD-433-79 Moved by Con. Prout, seconded by Con. Clarke Report P-168-79 THAT the following recommendations in Report P-168-79 Application for Rezoning Number Z -A-3-2-3, Part of Rezoning Z -A-3-2-3 Lot 15, Concession 2, former Township of Clarke (Schweizer) (Brunhilde Schweizer) be endorsed, subject to an advertised Public Meeting being held for input: 1. That application for rezoning Number Z -A-3-2-3 be approved; 2. That the attached by-law, amending Restricted Area By-law,Namber 1592, as amended, of the former Township of Clarke, be forwarded to Council for approval and 3. That the Region of Durham be advised of Council's action in respect of the subject application. "CARRIED" Resolution #PD -434-79 Moved by Mayor Rickard, seconded by Con.
