Adoption THAT the minutes of the meetings of June 11, 1979 and June
of Minutes 20, 1979, be adopted as read.

Delegations Mr. Hugh Macklin, representing Schickedanz Ltd., appeared
before the Committee to request that Report P-108-79, O.P.A.
Mr. H. Macklin part Lot 7, Conc. 1, Darlington, be tabled until his Company
Schickedanz can assemble the information required to submit a brief to
Report P-108-79 the Committee.

THAT Report P-108-79 be held in abeyance pending a submission
from Mr. Macklin.

Mr. G.Gabourie Mr. G. Gabourie appeared in opposition to the recommendation
O.P.A. of Planning Report P-107-79, that O.P.A. re pt lot 35,
pt lot 35, Conc. 3, be denied as premature. He felt that in light of
Conc. 3 the increase in his assessment, his property should be zoned
Darlington Residential.

O.P.A. THAT it be recommended to Council that Report P-107-79
79-6/D) be received and the Region of Durham be advised that
Gabourie the Town of Newcastle recommends that proposed amendment
(79-6/D) affecting part of Lot 35, Concession 3, former
Township of Darlington be denied as premature.

Mrs. Mackie Mr. Irwin Hamilton, representing Mrs. K. Mackie spoke to
Mr. I. Hamilton the Town Manager's report on Mrs. Mackie and Solina
Investments and informed the Committe that Mrs. Mackie
was not in agreement with deeding over 10 feet of her
land to the Municipality, in return for a fence.

THAT this matter be deferred until the next meeting of
the Committee for a report from Mayor Rickard.

Mr. J. Stirling Mr. Stirling, speaking for Mrs. R. Beaucage was present
re O.P.A. to speak in opposition to O.P.A. Application, Part of
76-35/D Lot 24, Conc. 9, Clarke, (Waverly Heights (Oshawa) Limited)
Waverly Heights but had been advised that the applicant was withdrawing
(Oshawa) Ltd. the proposal.
Mr. J. Courey Mr. Jerry Courey, of Marshall Macklin Monaghan, spoke on
for M. Veltri behalf of Mr. Mario Veltri relative to Application for
Burketon Hills Subdivision 18T-75362, part of Lots 18 and 19, Conc. 10,
Development Darlington, (Burketon Station) - Burketon Hills Developments
18T-75362 and in support of the recommendation in Report P-111-79.

THAT the following recommendation, in Report P-111-79 re
Application for Subdivision Number 18T-75362, part lots 18
and 19, Conc. 10, Darlington (Burketon Station) - Burketon
Hills Development, be endorsed:

THAT application for plan of subdivision number 18T-75362
be recommended to the Minister of Housing for approval,
subject to the following revisions and conditions:
Revisions:
1. That Street "D" be redesigned to provide a
second access to the site from the Darlington -
Cartwright boundary road.
2. That Street "A" be redesigned to intersect with
the 10th Concession Road approximately 150 feet
to the west of its presently proposed location.
3. That the southerly limit of Lot 19 be extended
to include the northern 100 feet of Lots 20.
4. That sufficient land to increase the road
allowance width of Scugog Road to 66 feet, from
Street "A" to the 10th Concession Road, be
incorperated into a Block for road widening
purposes.
5. That sufficient land to provide vehicular and
pedestrian access to the lands proposed for
"Community Facility" use be incorporated into
a Block for municipal purposes.
Conditions:
1. That this approval applies to the draft plan,
dated January 1979, by Marchall Macklin Monaghan
Limited, to be revised according to the recommen-
dations of Report P-111-79 of the Corporation of
the Town of Newcastle.
2. That the road allowances in this draft plan shall
be dedicated as public highways.
3. That the streets on the plan shall be named to
the satisfaction of the Regional Municipality of
Durham and the Town of Newcastle.
4. That a 0.3 metre reserve along that portion of
the southern limits of the Road Allowance between
the former Townships of Darlington and Cartwright
abutting Block "A" shall be conveyed to the Town of
Newcastle.
5. That the Block of land designated for Municipal
purposes on the revised plan be conveyed to the
Town of Newcastle.
6. That the Block of land designated for road widening
purposes on the revised plan, along the east limits
of Scugog Road, shall be dedicated to the Town of
Newcastle.

7. That the owners convey up to 5% of the land
included in the Plan to the Town of Newcastle
for park purposes under Section 33(5) of The
Planning Act; and that the Town will accept
cash -in -lieu of this parkland dedication under
the provisions of Section 33(8) of The Planning
Act.
8. That the necessary amendment to the Darlington
Restricted Area (Zoning) By-law shall be approved
be the Ontario Municipal Board.
9. That the owners enter into a subdivision agreement
with the Corporation of the Town of Newcastle to
include, in addition to the usual requirements, the
following provisions:
That the owners agree:
(a) to neither place nor remove fill of any kind,
whether originating on the site or elsewhere,
nor construct any building or structure on the
site, without the written consent of the Central
Lake Ontario Conservation Authority.
(b) to preserve significant vegetation on the site
in accordance with the "Forestry and Landscaping
Recommendations" prepared in respect of the
proposed development by Marshall, Macklin
Monaghan and dated April, 1979.
(c) not to apply for a building permit for a building
or structure on any lot unless a lot grading and
house location plan for the said lot has been
approved by the Town and the Central Lake Ontario
Conservation Authority.
(d) to inform all prospective purchasers that their
children will only be picked up by the school bus
on roads now in existence or at another location
convenient to the school board.
(e) to pay the cost of reconstructing the Darlington -
Cartwright boundary Road, for a distance and to a
standard acceptable to the Town of Newcastle.
(f) to pay half the cost of reconstructing Scugog
Road from Street "A" to the 10th Concession Road.
(g) to register on the title to lots 3 to 13 inclusive,
and 42 to 47 incluseive, a statement that because of
the proximity of the railway right-of-way, a
potential noise problem exists.

(h) to erect a 6 foot high chain link fence
along the rear of lots 4 to 9, 11 to 16,
19 to 21, and 42 to 48 inclusive, and that
a covenant be registered on the deeds to
each of these lots requiring the owner to
maintain the said fence.
(i) to register on the title to lots 12 to 21
inclusive notification that the lands immediately
east of the subdivision may be used for mineral
extraction..
10. That the subdivision shall be serviced by individual
drilled wells and private sewage disposal systems, to
the satisfaction of the authority having jurisdiction.
11. That such easements as may be required for utility or
drainage purposes shall be granted to the appropriate
authority.
12. That the owners agree in writing to satisfy all the
requirements, financial and otherwise, of the Town
of Newcastle concerning the provision of roads,
installation of services, drainage and fire protection.
13. That before final approval is given to the Plan, the
matter of provision of sewage disposal facilities to
lots 19, 25, 31, 32 and 37 be resolved to the satisfaction
of the Durham Health Unit and the Town of Newcastle, if
necessary by redesign to increase usable lot areas, or
by registration of the Plan on the basis of aerobic
sewage treatment facilities.
14. That the 9 m right-of-way shown on the draft plan
shall be removed from the title to the subject lands.
15. That the Road Allowance between lots 18 and 19 in
Concession 10 shall be closed and incorporated into
the lands proposed for development.

Mr. Sucee relative to Report P-110-79, Application for Subdivision
18T-76063, part of Lot 20, Conc. 10, Darlington and disagreed
with parts of the report, Revisions 1 and 2 and Condition (f).

and the Town of Newcastle Works Department be invited to attend.

Mr. C. Ewert Mr. C. Ewert spoke to Report P-104, Application for Rezoning,
re Rezoning part lot 10, Conc. 2, Bowmanville, (Brooking). He stated that
(Brooking) his client was prepared to move the proposed building so that
it would be sited 192' from existing residential area. He
also stated that the business had been a legal, non -conforming
use for 26 years.

THAT the recommendation in Report P-119-79 be endorsed

3. Council hereby advises the Ministry of Housing that upon
adoption of a Storm Water Management Plan for Courtice that
the Town may request revisions to the O.H.A.P. agreements
covering the development of lands in the Courtice Area, and
4. Council hereby advises Mr. R. Webb that an extension of
the time period for registration of the Courtice Heights
Subdivisions, Ministry of Housing files 18T-76027 and
18T-76048, to April 6, 1980 is agreeable to the Town on
the understanding that at that time a further renegotiation
of the subject subdivision agreements may be required.

1. The Council of the Town of Newcastle hereby requests
the Central Lake Ontario Conservation Authority to fund
55% of the additional $15,000. required to undertake the
Courtice Storm Water Management Study with terms of
reference to include an analysis of water quality, and

2. As the Council of the Town of Newcastle recognizes

that the adoption of a Storm Water Management Plan for

Courtice is a prerequisite of further development approvals

in Courtice, Town Council will not consider any development

proposals in the Courtice Urban Envelope until such time
as the Storm Water Management Study has been completed
and a Storm Water Management Plan adopted. Further,
Town Council will not consider any development proposals
in the Courtice Urban Envelope until such time as a
revised Courtice Urban Area Plan has been adopted by
Council and only at such time as Neighbourhood Development
Plans have been prepared and adopted for individual
neighbourhoods within the Courtice Urban Envelope, and
3. Council hereby advises the Ministry of Housing that upon
adoption of a Storm Water Management Plan for Courtice that
the Town may request revisions to the O.H.A.P. agreements
covering the development of lands in the Courtice Area, and
4. Council hereby advises Mr. R. Webb that an extension of
the time period for registration of the Courtice Heights

18T-76048, to April 6, 1980 is agreeable to the Town on
