Barr, Member Councillor William Clarke, Member Councillor Ivan M. Hobbs, Member Councillor Jasper W. Holliday, Member, at 9:50 a.m. Councillor Maurice Prout, Member Mayor G. B. Resolution #PD -246-79 Moved by Con. Hobbs, seconded by Con. Barr Adoption THAT the minutes of the meeting held on May 14, 1979, be of Minutes adopted as read. "CARRIED" Delegations Resolution #PD -247-79 Moved by Con. Hobbs, seconded by Con. Barr THAT Mr. Gascoyne be heard. "CARRIED" Mr. Gascoyne Mr. Gascoyne spoke to the Committee objecting to the rezoning of Mr. Dawson property, O.P.A. 77-13, from Residential to Commercial to permit Mr. Hermann trailer sales. He complained that people are now living in trailers on the site and felt that the rezoning would result in the neighboring property being downgraded. Mr. Dawson also objected and noted that the rear yardlof the present commercial properties in that area are unsightly. Mr. Hermann who lives south of the property to be rezoned, also objected to the rezoning and the present trailers parked on the site and the litter. Planning and Development Committee - 2 - June 11, 1979 Conroy Mr. Conroy Dowson spoke to Committee regarding Penwest Dowson Developments proposal - draft plan of subdivision which is part of the Soper Creek Neighbourhood bounded by Penwest Concession Street, Mearns Avenue and Highway #2. He Developments presented a letter from the Region of Durham stating Subdivision that there is now sewage capacity for over 3,000 persons in the area and asked Council to assign capacity to the development. Resolution #PD -248-79 Moved by Con. Holliday, seconded by Con. Hobbs THAT the matter be referred to Staff to report back, taking into consideration the updated information from the Region regarding available sewage capacity. "CARRIED" Milena Ms Protich presented a plan for Rills of Liberty North Protich which had been revised according to the conditions in Report P-100-79. She advised that Milani and Milani had no further interest in any properties in the Region of Durham and the interests were now known as East Woodbridge Developments Limited. She stated that the Town would be receiving a list of the present principals in the Company. Mr. Gleiberman Mr. Gleiberman addressed the Committee relative to O.P.A. re Mr. Zygocki 76-35/D. Waverley Heights Subdivision and explained that he felt there was a misunderstanding regarding the type of use for the land - it was for a Mobile Home Park and not a Trailer Park. Mr. Chicoyne Mr. Chicoyne spoke to Committee regarding Report P-81-79 Official Plan Designation of property in B.F. Concession, part lot 24, former Township of Clarke. He has objected to the designation as "agriculture" in the Regional Official Plan and wishes it to be "light industrial". He explained that he had a suitable building on the site and was in the business of custom conveyer assembly. He asked for Council's support at the Ontario Municipal Board Hearing. Mr. Gust Mr. Gust spoke relative to an application for rezoning Z -A-1-12-1, Scugog Street Hampton to permit Mr. Urbanowicz to build a house on the lot. As the line, indicating the floodline has now been changed, he felt there was sufficient area to build a house. Prout THAT the foregoing resolution be amended by adding ' and this be implemented at the next Planning and Development Meeting. Clarke Amendment to THAT the Chief Building Official's report relative to By-law 76-24 Renewal fees for building and demolition permits be renewal fees endorsed and the attached by-law, amending the building building & by-law, to provide for the renewal of building and demolition demolition permits at a flat rate, be forwarded to permits Council. THAT Report P-78-79, Official Plan Amendment Application 76-35/D 76-35/D, Waverly Heights Subdivision Ltd., be referred Waverly back to Staff for clarification. Heights "CARRIED" Delegation Mr. Ted Whiting spoke to the Committee relative Whiting to O.P.A. 77-13, supporting the amendment. Resolution #PD -253-79 Moved by Con. Holliday, seconded by Con. Barr THAT Report P-79-79 be received and the Region of Durham be advised that the Town will consider Official Plan Amendment Application, 77-13 further at such time as the Regional Planning and Development Committee - 4 June 11, 1979 O.P.A. Official Plan has been approved as it applies to Courtice 77-13 upon completion of the Courtice Urban Area Plan and on completion of the "Special Commercial Study", as included within the proposed Courtice Urban Area Plan. "CARRIED" Resolution #PD -254-79 Moved by Con. Hobbs, seconded by Con. Barr Town of THAT Report P-80-79, Town of Newcastle Interim District Newcastle Plan, be received and it be recommended to Council that Interim they pass the attached by-law (79-54) repealing by-law District Plan 75-32 of the Town of Newcastle, being a by-law to adopt the "Interim District Plan for the Town of Newcastle". "CARRIED" Resolution #PD -255-79 Moved by Con. Hobbs, seconded by Con. Barr By-law 34-79 THAT Report P-82-79 be endorsed and by-law 34-79 of Township of the Township of Scugog be received and filed. Clarke Maintenance THAT the committee reconfirm the resolution of the Finance and Occupancy and Administration Committee that Council take the necessary By-law action to have a Maintenance and Occupancy by-law prepared, Resolution #PD -257-79 Moved by Con. Prout, seconded by Mayor Rickard THAT the matter be tabled until the By-law Enforcement Officer and the Chief Building Official could be present after the lunch recess. Holliday Sec. 3 and 16.10 THAT Report P-89-79 be endorsed and it be recommended Durham Official to Council that the letter from the Ministry of Housing Plan addressed to the Regional Clerk and dated May 11, 1979, regarding Sections 3 and 16.10 of the Durham Regional Official Plan be received for information. Barr O.P.A. 79-6/D THAT Report P-83-79 be endorsed and the Region of Gabourie Durham be advised that the Town will consider Official Plan Amendment Application No. 79-6/D further at such time as the Regional Official Plan has been approved as it applies to the Courtice Urban Area. Prout Mapping THAT Report P-84-79 be endorsed and the Planning Department Assistance be authorized on behalf of the Town to request the Surveyor Ministry of General for the Ministry of Natural Resources to assign a Natural high priority to the mapping of the Bowmanville and Courtice Resource Urban areas of the Town of Newcastle as part of their current metric mapping program for the Durham area and Staff be further requested to investigate the comparative costs of obtaining mapping through the subject program. Holliday THAT Report P-92-79 be endorsed and it be recommended to Council that the following resolution be adopted: Application "The Corporation of the Town of Newcastle is concerned of the Ontario that the strict application of the Ontario Building Code Building Code to heritage buildings might seriously affect their to Heritage appearance and even their existence and that this Council Buildings supports the recommendations of the Canadian Building Officials Association and the Ontario Building Officials Association with respect to heritage buildings and the changes which would be required in the Ontario Building Code to accommodate these and further that copies of this resolution be forwarded to the Ministry of Consumer and Commercial Relations, the Ministry of Culture and Recreation and the Secretary of the Ontario Building Officials Association". Hobbs, seconded by Con. Holliday O.M.B. THAT Report P-94-79, Ontario Municipal Board Hearing Hearing of an appeal against a Decision of the Durham Land Appeal Division Committee - Ralph and Judy Hills - be endorsed against and: Decision of Land Division 1) the Town of Newcastle not be represented at the Committee - Ontario Municipal Board Hearing of the subject Hills appeal and that the Region of Durham be so advised and 2) Staff be authorized to submit a letter to the Ontario Municipal Board requesting the imposition of the appropriate lot development charges, in accordance with the provisions of By-law 78-58, if the appeal is upheld. Tomina, be recommended to Council as follows: Alternative 3 Mr. Tomina may withdraw his objection to the Durham Regional Official Plan and proceed with an Official Plan Amendment Application. The Official Plan Amendment Application may request an exemption from the provisions of the "Open Space" designation in the Regional Official Plan. Planning and Development Committee - 12 - June 11, 1979 (b) That the lands within the floodplain of the Soper Creek, as determined by the Central Lake Ontario Conservation Authority floodplain mapping, be placed under an appropriate zoning category which would have the effect of prohibiting all buildings or structures thereon other than those required for flood control. (c) That the Restricted Area (Zoning) bylaw contain a provision that no part of any dwelling is permitted within 100 feet of the westerly limits of Lots 4, 5, 6, 7, 8, 30, 31, 38, 39, 40 and 41. 7) That the owner enter into a subdivision agreement with the Corporation of the Town of Newcastle to include, in addition to the usual requirements, the following provisions: 1. That the owner agrees: a) to neither place nor remove fill of any kind, whether originating on the site or elsewhere, nor alter any existing vegetation, within the fill and construction limits of the floodplain of the Soper Creek, without the written consent of the Central Lake Ontario Conservation Authority. b) to construct bridge and stream crossings in a manner approved by the Central Lake Ontario Conservation Authority and the Ministry of the Environment. c) to erect a fence along the western boundary of Lots 4, 5, 6, 7, 8, 30, 31, 38, 39, 40 and 41, to the satisfaction of the Ministry of Agriculture and Food. d) to plant a vegetative screen along the western boundary of Lots 8, 38, 39, 40, 41 to the satis- faction of the Ministry of Agriculture and Food. e) to include restrictive covenants in the deeds to lots 2, 3, 6-17 inclusive, 24-40 inclusive and 43-46 inclusive to prevent any alteration to the watercourse and/or the cutting of healthy trees on the lots, without the written permission of the Central Lake Ontario Conservation Authority. f) that the owner agrees to inform all prospective purchasers that their children will only be picked up by the school bus on roads now in existence, or at another location convenient to the school board. Planning and Development Committee - 13 - June 11, 1979 'In Camera' Open Meeting 8) That such easements as may be required for utility or drainage purposes shall be granted to the appropriate authority. 9) That before final approval is given to the Plan, the matter of the provision of sewage treatment facilities be resolved to the satisfaction of the Durham Health Unit, if necessary by the redesign of the subdivision to increase usable lot areas, or by the registration of the Plan on the basis of aerobic sewage treatment facilities. 10) That the owner agrees in writing to satisfy all the requirements, financial and otherwise, of the Town of Newcastle concerning the provision of roads, installation of services and drainage. 11) That the owner enter into a subdivision agreement with the Regional Municipality of Durham, to include among other matters, provision for the installation of water storage and pumping facilities. Referral THAT Report P-81-79 be received and the Region of R-67 Durham be advised that the Town of Newcastle Chicoyne supports the "Permanent Agricultural Reserve" designation on the subject site (R-67); and Mr. D. Sims, Town Solicitor, be advised of the Town's position relative to this matter so that he may take appropriate action to inform the Ontario Municipal Board.
