Prout Adoption THAT the minutes of the meeting of February 19, 1979, be of Minutes adopted as read. "CARRIED" Resolution #PD -124-79 Moved by Mayor Rickard, seconded by Con. Prout Correspondence THAT the correspondence from Councillor Hobbs thanking Con. Hobbs the Town for flowers and cards, be accepted and noted in the minutes. "CARRIED" The meeting had been advertised as a Public Meeting to deal with the following Items: O.P.A. 70, Part of Lots 3 and 4, Conc. 4, former Township of Darlington change from Agriculture to Estate Residential. O.P.A.148 Part lot 13, Conc. 1, former Town of Bowmanville change from Industrial to Residential Rezoning - Redesignation of road allowance between lots 12 and 13, Conc. 10, Darlington from Class "B" Public Street to Class "A" Public Street Planning and Development Committee - 2 - March 19, 1979 Soper Creek Neighbourhood Development Plan South-West Quadrant Neighbourhood Plan for the Village of Newcastle n v A 7n O.P.A. 70 No person was present to speak to this Amendment. Resolution #PD -125-79 Moved by Con. Holliday, seconded by Con. Prout Report P-29-79 THAT Report P-29-79 be endorsed and it be recommended to the Region of Durham that no further approvals be given, related to this application to amend the Official Plan for the former Township of Darlington File 75-29 (Former File O.P.A.70), pending the Central Lake Ontario Conservation Authority's proposed acquisition of the subject lands. "CARRIED" O.P.A. 148 O.P.A. 148 - Bowmanville Official Plan, pt. lot 13, Conc. 1, Bowmanville, Change Industrial to Residential Mr. Fleischmann Mr. Fleischmann, Donevan & Fleischmann, spoke to the Committee for Wilswar on behalf of Wilswar, owners of the property, and stated that he felt it would be better to put residental rather than industrial development in that area because of possible objections by neighbouring residents. He said the Plan could be amended to provide that no lots fronted on Base Line Road. He also stated that the owners were unable to attend this meeting and asked that they have an opportunity to address the Committee. Resolution #PD -126-79 Moved by Con. Holliday, seconded by Con. Prout Report P-30-79 THAT Report P-30-79 be tabled pending completion and approval of the District Plan for Bowmanville. "CARRIED" Rezoning and Redesignation of Road Allowance between lots 12 and 13, Conc. 10, Darlington, from Class "B" Public Street to Class "A" Public Street There was no one present to speak to this rezoning. Planning and Development Committee - 3 - March 19, 1979 Resolution #PD -127-79 Moved by Con. Holliday, seconded by Mayor Rickard Rezoning THAT Report P-43-79 be endorsed and it be recommended Rd. Allowance to Council that the application for rezoning, Number between 12 and 13 Z -A-1-11-6 be approved, and that the attached amending Con. 10 Darling- by-law be forwarded to Council for approval. ton "CARRIED"` Soper Creeek Neighbourhood Development Plan The following were present relative to this Plan: Mr. Hugh MacAn, representing Schickedanz Development Limited who spoke in support of the Plan. Mr. Conroy Dowson, representing Penwest Developments who spoke in support of the Plan. Mr. M. Kelly, solicitor for Mr. W. R. Mutton - no comments Mr. Mario Veltri spoke in support of the Plan. Mrs. Vanderveer was also present. Delegations The Chairman announced that due to the length of time taken for the Public Meeting, Delegations would be at 1:30 p.m. Resolution #PD -128-79 Moved by Con. Holliday, seconded by Con. Prout THAT the following recommendation in Report P-34-79 be approved subject to agreement in principle by Central Lake Ontario Conservation Authority relative to floodlines and storm drainage: Soper Creek 1. That the Neighbourhood Development Plan for the Neighbourhood Soper Creek Neighbourhood, being Special Study Development Area 1 as defined within the Bowmanville Official Plan Plan, be adopted by Council; and that 2. The Neighbourhood Development Plan, as adopted be forwarded to the Region of Durham for information. "CARRIED" Planning and Development Committee - 4 - March 19, 1979 Resolution #PD -129-79 Moved by Mayor Rickard, seconded by Con. Prout THAT the previous resolution be amended by deleting "subject to agreement in principle by Central Lake Ontario Conservation Authority relative to flood lines and storm drainage". "MOTION LOST" Newcastle Village Development Plan for the Southwest Quadrant Proposed Plan Ms Milena Protich representing Milani and Milani, for South West spoke to the Committee relative to this Plan and Quadrant stated that she had presented her comments, in writing Village of to the Planning Staff pmAously. She stated that she Newcastle had two difficulties with the plan; one was the question of the sight line for access to Highway #2 and the other was the general proposal for all of the land north of Milani and Milani's present subdivision. She felt that the proposed design did not take advantage of the natural features such as the valleyland and present orchards and that the road pattern was limiting. Clarke Report P-37-79 THAT Report P-37-79 be received and referred back to Staff and there be further dialogue with the landowners and area residents relative to the layout and road access and there be a report back to the Committee. "CARRIED" Resolution #PD -131-79 Moved by Con. Holliday, seconded by Con. Prout THAT the meeting adjourn for lunch at 12:20 p.m. "CARRIED" The meeting reconvened at 1:30 p.m. Delegations Mr. S. Leonardi for Braemor Gardens, presented a proposed plan for estate residential lots on 92.7 acres located on lots 27 and 28, Conc. 3 former Township of Darlington. This area contains an abandoned gravel pit which would be rehabilitated and owned by the property owners in the proposed estates. Planning and Development Committee - 5 - March 19, 1979 Resolution #PD -132-79 Moved by Mayor Rickard, seconded by Con. Holliday S. Leonardi THAT this matter be referred to Staff to report back. Braemor Gardens "CARRIED" Japanese Mr. Ayukawa, Mr. Chas. Ogaki, President of the Japanese Canadian Canadian Cultural Centre and Mr. Owaso, Chairman of the Cultural Land Committee were present. Centre Mr. Ayukawa reviewed the proposal for a Recreational Centre in the former Township of Clarke. Resolution #PD -133-79 Moved by Con. Clarke, seconded by Mayor Rickard THAT the proposal by the Japanese Canadian Cultural Centre to establish a Recreation Centre on part of lots 17, 18 and 19, Conc. 5, former Township of Clarke be given approval in principle subject to support of necessary public hearings and involvement. "CARRIED" Resolution #PD -134-79 Moved by Con. Prout, seconded by Con. Holliday THAT the Director of Planning and Development be authorized to process this application as quickly as possible and bring back a report to Council. "CARRIED" Mr. Palter Mr. Palter, spoke to the Committee on behalf of Mr. Stan for Gujda regarding the status of a proposed subdivision in Stan Gujda the former Village of Newcastle, north of Highway #2, behind the NelGor Nursing Home. The Director stated that the District Plan for the Village of Newcastle would be prepared by the end of March and at that time, a neighbourhood plan can be prepared for this area. Resolution #PD -135-79 Moved by Mayor Rickard, seconded by Con. Clakre THAT the presentation be received and referred to Staff and responded to in the Neighbourhood Plan for the Village of Newcastle. "CARRIED" Planning and Development Committee - 6 - March 19, 1979 Mr. T. Huzar Mr. Tom Huzar addressed the Committee relative to Plan of Subdivision in the former Village of Newcastle, pt. lot 28, Conc. 1 and showed a plan which had been revised when Ontario Hydro had purchased the southern portion of the property. Resolution #PD -136-79 Moved by Mayor Rickard, seconded by Con. Clarke Subdivision THAT the Committee approve of the realignment of 18T76021 the road in Subdivision 18T-76021, part lot 28, Conc. 1, former Village of Newcastle, as presented. "CARRIED" Mr. Huzar Mr. Huzar also apoke relative to implementation of re Hamlet the Durham Regional Official Plan re Hamlets - Plan for specifically Newtonville and the difference between Newtonville the local and Regional planning departments and was referred to the Public Meeting to be held in Newtonville on March 27, 1979, relative to the Newtonville Hamlet Plan. Mr. M. Veltri Mr. Mario Veltri presented a proposed Plan of re Proposed Subdivision for 39.75 acres in the Hamlet of Subdivision Newtonville comprised of estate residential lots, Newtonville between #2 Highway and Highway 401, lot 10, Conc. 1, former Township of Clarke. Resolution #PD -137-79 Moved by Con. Clarke, seconded by Con. Holliday THAT the matter be referred to staff for a report following the Public Meeting in Newtonville on March 27th, 1979. "CARRIED" Resolution #PD -138-79 Moved by Mayor Rickard, seconded by Con. Holliday P-43-79 THAT Report P-48-79 be endorsed and it be recommended Objections to Council that the Ontario Municipal Board be advised to By-law that the Town of Newcastle has considered the objections 79-7 submitted to By-law 79-7 and that the issues raised by (Papanikolopoulos)the residents can be resolved through proper site design and the provisions of the Development Agreement between the Developer and the Town of Newcastle. Hearing THAT Report P-35-79 be endorsed and Staff and the re By-law 78-60 Town Solicitor be authorized to attend the Ontario (Stephenson) Municipal Board Hearing in support of By-law 78-60 (Stephenson's Salvage Yard) on April 12th, 1979. The Town Clerk be requested to submit By-law of Newcastle 73-15 of the former Village of Newcastle to the Zoning By-law Ontario Municipal Board for approval, together with 73-15 all amendments thereto which have been approved by Council to date, and all relevant support material, and 2. the staff be authorized to obtain the assistance of the solicitor in this regard if and when such assistance is deemed necessary. Prout S -A-1-15-6 THAT Report P-39-79, dated March 5, 1979 be endorsed Subdivision and the Minister of Housing be advised that the Town 18T24002 of Newcastle approves of the proposed revision to Draft approved Plan of Subdivision Number 18T24002, as shown on the Plan drafted by M.D. Brown, O.L.S. and dated January 12, 1979. Prout Development THAT Report TM -33-79, dated March 10, 1979, be endorsed Strategy and the Terms of Reference re Development Strategy Growth Growth Management Program be approved and the Committee Management recommend to Council that proposals be invited from Program Consultants to develop such a program. Clarke Liability THAT Town Manager's Report TM -31-79, dated March 10, of Building 1979 relative to Liability of Building Officials, Officials be received for information. "CARRIED" Planning and Development Committee - 10 - March 19, 1979 Resolution #PD -154-79 Moved by Mayor Rickard, seconded by Con. Holliday Barber THAT it be recommended that the Clerk liaise further with Creek L.A.C.A.C. regarding information received from the Ontario Geographic Names Board and report back to this Committee. "CARRIED" Resolution #PD -155-79 Moved by Con. Holliday, seconded by Con. Prout Bowmanville THAT Report P-42-79 be endorsed and that T.A.T.O.A. to Whitby be advised that the Town of Newcastle favours Option 2 Bus Service of the proposed Bowmanville to Whitby service, and that this service be implemented as soon as possible with ridership being monitored annually to permit re -assessment of the options, in light of expected changes to user preference related to Commercial activity within Newcastle. "CARRIED" Resolution #PD -156-79 Moved by Con. Holliday, seconded by Con. Prout THAT Report P-44-79 be endorsed and: O.M.B. Hearing 1. Planning Staff or the Town Clerk be directed to April 17/79 request the Ontario Municipal Board to defer the subject Pythagorus hearing sine die, to be rescheduled at the mutual request Group of the municipality and the applicants affected and that 2. The Ontario Municipal Board be further requested to hear all three Commercial applications, Bowbrook, Pythagorus and the Bowmanville Mall, at the one hearing and that 3. All concerned parties be notified of the resultant response to these requests. "CARRIED" Conflict of Councillor Holliday indicated that he had a possible conflict Interest. of interest relative to the property in the area and refrained from discussion or voting on Report P-45-79. Planning and Development Committee - 11 - Resolution #PD -157-79 March 19, 1979 Moved by Mayor Rickard, seconded by Con. Clarke Report P-45-79 THAT Report P-45-79, relative to Special Study Area 11 - Durham Regional Official Plan, be endorsed and Special Study the Region of Durham be advised that the Town of Area 11 Newcastle prefers either a 'Deferred Industrial' or 'Dry Industrial' designation for Special Study Area 11 and for those lands North of Highway 401, west of the north -south Hydro Corridor from Darlington and east of the existing Industrial designation as outlined on the attached map. Holliday Report P-46-79 THAT Report P-46-79, Purchase from Town of Newcastle - Part lot 14, Conc. 1, Bowmanville - McEwen, John McEwen Purchase and Mary, be endorsed and the Solicitor for Mr. and from Town of Mrs. McEwen be advised that their request will be part lot 14, considered in conjunction with the preparation of the Conc. 1 Bowmanville Urban Area Plan and that they shall be Bowmanville advised by Staff of any further actions required on their part relative to this request. Clarke Report P-47-79 THAT Report P-47-79, Amendment to Durham Regional Official Plan - Future North-South Arterial Road in Bowmanville, North-South be endorsed and the Region of Durham be requested to Arterial Road defer a decision on the proposed amendment to the Durham Bowmanville Regional Official Plan regarding the location of a future Planning and Development Committee - 12 - March 19, 1979 north -south arterial road in east Bowmanville pending the completion of the Bowmanville Urban Area Plan. Holliday Decision of THAT the following recommendation contained in Report the Ontario #6 to the Council meeting of February 23, 1979, relative Municipal to Ontario Municipal Board Decision in the Matter of an Board Appeal by Messrs. McEvoy and Cooper Against a Decision re McEvoy and of the Town of Newcastle Committee of Adjustment, be Cooper endorsed and the Planning Department be authorized to obtain a legal opinion regarding the issues raised in this report and pending the results of this legal opinion from the solicitor, staff be authorized to submit an appeal to the Ontario Cabinet against this decision of the Ontario Municipal Board, in the name of the Town of Newcastle.
