Mayor Rickard and Members of Council: -
The following is a report of the meeting of the Planning and Development Committee
held on May 25, 1981.
1. Rezoning Z -A-3-11-7 - Newcastle Shoreline Limited
It was recomnended to Council that Application for rezoning Z -A-3-11-7, part of
lot 25, Broken Front Concession, former Village of Newcastle, Newcastle Shoreline
Limited, be approved and the attached by-law be forwarded to Council for approval.
See By-law 81-66.
2. Policy re Issuance of Building Permits
It was recommnded to Council that in response to correspondence from R. J. Rutherford,
Report P-96-81 be received, the attached by-law amending by-law 76-24 be approved and
Council adopt the attached policy in respect of the issuance of building permits.

Flood Plain Mapping - C.L.O.C.A.
It was recorm ended to Council that Report P-97-81 be received and the following
resolution be adopted and forwarded to the Central Lake Ontario Conservation Authority:
"WHEREAS flood susceptible areas are recognized in the Durham Regional Official Plan
and the Official Plans of the Town of Newcastle; and
WHEREAS the Town of Newcastle further regulates development in flood susceptible areas
through the provisions of its restricted area by-laws; and
WHEREAS the Central Lake Ontario Conservation Authority administers regulations in
respect of development in flood susceptible areas; and
WHEREAS the 'Designation' of flood susceptible areas as subject to the Terms of a
Federal/Provincial Agreement in respect of Flood Risk Mapping allows for the further
mapping of flood susceptible areas;
BE IT NOW RESOLVED THEREFORE that the Town of Newcastle endorses the Flood Risk Mapping
Program, inasmuch as it recognizes existing and ongoing Provincial and Municipal efforts
to control development in flood susceptible areas and to minimize future flood damage".
4. Cedar Park Site Plan Agreement - S -P-1-12
It was recommended to Council that Report P-98-81 be received, the attached Development
Agreement in respect of Cedar Park Tourist Camp be approved by Council and the Clerk
bring forward the necessary by-law to execute the Agreement at the Council Meeting of
June 1, 1981. See By-law 81-68.
5. Site Plan Agreement Port Darlington Marina Hotel
It was recommended to Council that Report P-101-81 be received and the attached
Site Plan Agreement for part of lots 9 and 10, Concession 1, former 2bwnship of
Darlington, Port Darlington Marina Hote, File S -P-2-20 be executed and the Clerk be
directed to prepare a by-law for the purposes of authorizing the execution of the attached
Development Agreement for submission to and consideration by Council at its meeting of
June 1, 1981. See By-law 81-69.

6. Rezoning Z -A-2-13-1 - Port Darlington Marina
It was recommended to Council that Report P-102-81 be received, application for
rezoning Z -A-2-13-1, part of lots 9 and 10, B.F. Concession former Town of Bowmanville,
Port Darlington Marina be approved and the attached by-law be approved concurrent
with the execution of the Development Agreement referred to by Staff Report P-101-81.

7. Reclassification of Queen's Hotel - Newcastle
It was reconmended to Council that Report P-103-81 be received, Mr. R. R. Mills,
Liquor Licence Board, Licence Officer be forwarded a copy of this report in reply to his
correspondence of April 30, 1981 and the owners of the Queen's Hotel Ltd., be requested
to file a rezoning application iniespect of this matter.
8. Receive for Information
It was recommended to Council that the following be received for information:
a) Oshawa By-law 32-81
b) Uywnship of Hope By-law 1968
c) Committee of Adjustment Minutes of May 6 and May 13, 1981.
9. Exchange of Property M.T.C. and Town Town of Newcastle
Redesignation of Heritage Site and Rezoning for Commercial Purposes
It was recommended to Council that:
a) Report P-93-81 be received
b) The Town Clerk be requested to bring forward the necessary by-laws
for reapplying the Heritage Designation to the Old Kirby School Site,
described as Part 2 of Plan 1OR--1289, and that, on completion of that
procedure;
3) The Town Clerk request the Town Solicitor to proceed with the conveyance
of Parts 1 and 3 of Plan IOR--1289 to the Ministry of Transportation and
Communications in exchange for certain lands in lot 25, Concession 6, Clarke.
4) The attached restricted area by-law amendment applying to Part 3 of
Plan 1OR--1289 be forwarded to Council and read a first and,second time and
tabled to be lifted from the table and finally approved upon the
conpletion of the Heritage Designation procedure described in point 2
above; and (See By-law 81-71)
5) The future possible owners of Part 3 of Plan 1OR--1289 be advised that
the Town of Newcastle requires the owners of property to enter into site
plan agreements prior to development taking place on commercially zoned
land.

TOWN POLICY
in respect of Section 2.5 of the
TOWN OF NEWCASTLE BUILDING BY-LAW
(BY-LAW 76-24)
1. On the receipt of a written request for relief from Section
2.5 of By-law 76-24 requiring a surveyor's certificate or
survey verifying the location of building foundations, the
Clerk shall refer such request directly to the Chief Building
Official, who shall report to the Planning and Development
Committee on the appropriateness of the request.
2. On considering the report of the Chief Building Official, the
Planning and Development Committee shall have regard for the
following items:
a) the size and location of the property in question,
b) the zoning of the property in question,
c) the required setbacks as specified in the zoning
by-law,
d) the proximity of the new use to existing uses on
adjacent lands,
e) the compatibility with adjacent uses, and
f) such other matters as the Committee may consider relevant.
3. The Planning and Development Committee shall make its recommendation
to Council and the Clerk of the Municipality will advise the appli-
cant as soon as practicable of the Council's decision.
