HomeMy WebLinkAbout1981-04-13 ReportREPORT #.3 Mayor Rickard and Members of Council: The following is a report of the meeting of the Planning and Development Committee held on April 13, 1981: 1. Rezoning Z -A-1-7-4 (Amyotte) It was recommended to Council that : 1) Report P-56-81 be received. 2) The attached amendment to Restricted Area By-law 2111, as amended, be forwarded to Council for approval upon execution of a Development Agreement between the applicant and the Town of Newcastle which shall include, but shall not be specifically limited to, provisions in respect of the following: (i) That the owner dedicate to the Corporation of the Town of Newcastle a 3.0 metre (10 ft.) road widening along the entire frontage of the property abutting Baseline Road: (ii) That a site grading and drainage plan be approved by the Town's Director of Public Works, the Central Lake Ontario Conservation Authority and the M.T.C. prior to the issuance of any building permit on the subject lands; (iii) That the Town shall require site plan agreements as a condition of development of all or part of the subject lands; (iv) That such easements as may be required for utility or drainage purposes shall be granted, free and clear of all encumbrances to the appropriate authority; (v) That the owner agrees to provide, on site, one or more reservoirs for fire fighting purposes, to the satisfaction of the Fire Chief for the Town of Newcastle; (vi) That no Occupancy Permits shall be issued for any building until such building is connected to and serviced by a potable supply of water and a sanitary sewage disposal system approved by the authority having jurisdiction; (vii) That an overall site plan incorporating visual buffering of the future industrial uses adjacent to Highway #401, has been approved by the Town of Newcastle. 2. Ontario Building Code 1974 - Construction of Farm Buildings It was recommended to Council that the report relative to Ontario Building Code 1974 Construction of Farm Buildings - correspondence from E. C. Aldridge, Valuation Manager, Assessment Region No. 13, be received for information, a copy be forwarded to Mr. Aldridge and no further action be taken. 3. Designation of C.L.O.C.A. Flood Plan Maps It was recommended to Council that Council members avail themselves of the invitation to attend the presentation on April 21, 1981 at the Region of Durham Planning Committee and the Director of Planning report back to a subsequent meeting. - 2 - Report No. 3 4. Ridge Pine Park Inc. Amendment to Official Plan for Darlington It was recommended to Council that Report P-60-81 be received for information and the following resolution and attached information be forwarded to the Regional Municipality of Durham in respect of application 81-9/ND: "WHEREAS, the Durham Regional Official Plan designates part of Lots 1, 2 and 3, Broken Front Concession, former Township of Darlington, "for use as a mobile home park development for adults" and WHEREAS, the Town of Newcastle has adopted Restricted Area By-law 81-15 rezoning the above-mentioned lands in accordance with the Durham Regional Official Plan; and WHEREAS, the Durham Regional Official Plan prevails to the extent of any conflict between itself and any existing Official Plan, until such time as such existing Official Plans are amended or repealed, (Section 16.3.2) BE IT NOW RESOLVED THEREFORE that Regional Council be advised that Newcastle Town Council has "no objection" to the approval of application 81-0/ND and hereby requests the Region of Durham to undertake the preparation and processing of the requested amendment to the Official Plan of the former Township of Darlington." 5. By-law 81-15 - Ridge Pine Park Inc. It was recommended that Report P-62-81 be received and the following resolution be forwarded to Council for adoption and submission to the Ontario Municipal Board: "WHEREAS the Ontario Municipal Board has considered the matter of the use of the lands subject to Town of Newcastle By-law 81-15 and labelled R-60 on Schedule A (Map 5) of the Durham Regional Official Plan; and WHEREAS the Municipal Board has decided that the lands labelled R-60 are designated for use as a mob ile home park development for adults; and WHEREAS the Ontario Municipal Board's decision was appealed to the Ontario Cabinet: and WHEREAS the Ontario Cabinet upheld the Decision of the Municipal Board; and WHEREAS the Town of Newcastle has adopted Restricted Area By-law 81-15 and has entered into an agreement with the proponents of the Mobile Home Park in respect of the proposed development; and WHEREAS By-law 81-15 and the Development Agreement, are in the opinion of the Town in conformity with the Durham Regional Official Plan BE IT NOW RESC[VED THEREFORE THAT the Town of Newcastle hereby respectfully requests the Ontario Municipal Board to approve Restricted Area By-law 81-15 of the Town of Newcastle. - 3 - Report No. 3 6. Sign By-law 76-25 It was recommended to Council that Report P-63-81 be received and the attached amendment to By-law 76-25, as amended, be forwarded to Council for approval and Staff be authorized to publish a public notice advising the public of the deadline for compliance with the provisions of by-law 76-25, as amended. See By-law 81-46. 7. Rezoning Z -A-3-3-6, part lot 30, Cone. 4 - Clarke (Mastroianni) It was recommended to Council that: 1) Application for rezoning Z -A-3-3-6 be denied due to non -conformity with the provisions or intent of the Durham Regional Official Plan. 2) The Region of Durham and the applicant be advised of Council's actions. 3) Mrs. Mastroianni be advised that Planning Staff is available to discuss other alternatives within the same fee structure. 8. It was recommended to Council that Report P-65-81 be received. 9. Maintenance and Occupancy By-law It was recommended to Council that the Town implement a property standards program through the adoption of a Maintenance and Occupancy By-law for the Town of Newcastle. 10. Main Street Revitalization Proeram Loan for Bowmanville B.I.A. It was recommended to Council that the Town support an application for a Mainstreet Revitalization Program Loan from the Bowmanville Business Improvement Area Board of Management and in that regard consider adopting off-street parking policies for the Main Central Area of Bowmanville in conjunction with the preparation of a downtown project proposal required by the Main Street Revitalization Program, said considerations to include examination of the possibility of establishing a Municipal Parking Authority. 11. Administrative Facility Study It was recommended to Council that they request the Directors of Planning and Works and the Clerk and Administrator to bring forward terms of reference for a study of the Town's administrative facility requirements within one month. 12. Sale of Bowmanville Creek Valley Lands to C.L.O.C.A. It was recommended to Council that the Town offer those municipal lands situate in the Bowmanville Creek Valley, south of Highway Number 2 to the Central Lake Ontario Conservation Authority for a nominal ($2.00) provided that all legal and survey expenses are borne by the Central Lake Ontario Conservation Authority. - 4 - Report #3 13. Long Range Planner It was recommended to Council that Report P-71-81 relative to the filling of the position of Long Range Planner in the Planning and Development Department be received for information. 14. Rezoning Z -A-2-6-5, (Bolahood) It was recommended to Council that Report P-72-81 be received and application for rezoning Z -A-2-6-5, part of lot 9, Concession 2, former Town of Bowmanville, John Bolahood, be denied due to non -conformity with the provisions of the Durham Regional Official Plan and the Official Plan of the former Town of Bowmanville and the Region of Durham and the applicant be advised of Council's actions. 15. Committee of Adiustment It was recommended to Council that the minutes of the meetings of the Committee of Adjustment held on February 25, 1981 and March 25, 1981, be received for information. 16. Land Purchase from M.T.C. It was recommended to Council that certain lands adjacent to the Main Central Area of Bowmanville be purchased from the Ministry of Transportation and Communications in an amount not exceeding $10,000. to be taken from the Parking Reserve Account and the Town Solicitor be instructed to complete such transaction as soon as possible. 17. Land Purchase Itwas recommended to Council that certain other lands be considered for purchase by the Town in conjunction with those lands mentioned in (16) above on the basis of a property appraisal to be undertaken by the Town and hereby authorized.
