R. Hewines Mr. Robert Hewines, of Plantario Group, was not present

Moved by Mayor Rickard, seconded by Councillor Taylor
P-160-81 THAT Mr. Edwards explain the report P-160-81 relative to
Group Homes 'Group Homes' and the delegations be invited to respond.
Conflict of Councillor Hubbard declared a possible conflict of interest
Interest in the matter of Group Homes and refrained from discussion
and voting in the matter.
Mr. Edwards made an explanation of the contents of the
report.
Sam Gust Mr. Sam Gust, operator of a Group Home, spoke for himself
and as a member of an Association for Homes for Special
Care. He stated that he had applied for a building permit
to enlarge his home on Queen Street and was told that he
would have to apply for rezoning. He spoke of the effect
of the licensing by the Municipality of Group Homes. He
stated that it would limit the number of residents to 10
and he presently had 12. He stated that he would like
to have more time to discuss the report with the other
operators in the Association and be given an opportunity
to respond.
Mr. Edwards explained that the Municipal Act now limited
the number of residents in Group Homes to 10.
Mr. Norton Mr. Norton who operates a Home for Special Care stated
that these homes are licensed under the Nursing Homes
Act and provincially inspected. He said that he had no
previous notification regarding the change in zoning. He
had understood when he purchased the property that it
had already been rezoned for the purpose of a Home for
Special Care. He also objected to local licensing and
stated that he needed time to respond to some of the
items in the report.
Mr. Edwards explained that the proposed rezonings would
legalize the status of these Homes which were presently
non -conforming.

THAT the recoamndation in Report P-160-81 be approved and
Group 1)
Report P-760-81 be received.

The draft zoning by-law amendments attached to this
report be forwarded to Council for approval;
3)
The draft by-law to register Group Hanes under
Section 383a of the Municipal Act be forwarded to
Council for approval;
4)
Mr. Sam Gust be advised that his application for rezoning
has been considered in conjunction with staff's review of
Group Homes and has been dealt with through incorporation
within the draft by-law amendments referred to by
recommendation 2 above;
5)
The Regional Municipality of Durham Social Services
Department and the Local Social Planning Council be
advised of the Town's actions.

structurally as a residence.

THAT the recommendation in Report P-167-81 be endorsed

and
1) Application for Plan of Subdivision Number 18T-SL008
be acoepte d as a formal application; and
2 ) The Region of Durham be advised that ih e Town of Newcastle
recommends draft approval of Application for Plan of
Subdivision Number 18T-810081 subject to the following
conditions:-

That this approval applies to the revised
Plan dated July 1981 by H. F. Grander Co.

That the "Road" shown on the Plan be named to
the satisfaction of the Regional Municipality of
Durham and the Tbwn of Newcastle; and
That Blocks 24 and 26 be dedicated to the 'Ibwn of
Newcastle for Parks Purposes and that Block 25
be developed in conjunction with adjacent lands
to the south.
That the necessary amendment to the Restricted
Area By-law of the former Village of Newcastle
shall be approved and come into effect pursuant
to Section 35(10) of The Planning Act.
That the owner shall enter into a subdivision agreement
with the Town of Newcastle to include, in addition to
the usual requirements, the following provisions:
The Owner agrees: -
(a) to submit a storm water management plan for the site
which is to be approved by the Ganaraska Conservation
Authority and the Town of Newcastle
(b) that the owner agrees in writing to satisfy all
requirements, financial and otherwise, of the
Region of Durham concerning the provision of
roads, sewers, water and other Regional services.
(c) % at the development of the Plan will be subject
to architectural control by the Tbwn of Newcastle.
( d) That all lands to be dedicated or conveyed to the
municipality for any municipal purpose shall be
dedicated or conveyed in.a form acceptable to the
municipality and further, the owners shall grade
and sod all lands to be conveyed for park purposes
and shall plant such trees or olhe r vegetative
matter as may be required in accordance with a
landscape plan prepared at the Owner's expense
by a landscape architect and submitted to the
Tbwn for approval.
That temporary turning circles be provided at the ends of
all dead-end streets.
That the owner provide the Town of Newcastle with a
'functional report' relative to the alignment and
development of the proposed temporary access to Old
Kingston Road and Highway 2.
