Gray, Secretary Also Present: Director of Planning, Don Smith Resolution #PD -191-81 Moved by Councillor Hubbard, seconded by Councillor Woodyard THAT the minutes of the meeting held on May 25, 1981 be adopted as read. II WAIV:#i 1� Resolution #PD -192-81 Moved by Councillor Hubbard, seconded by Councillor Prout THAT the agenda be altered to deal with Confidential Report P-93-81 at the end of the meeting. Resolution #PD -193-81 Moved by Mayor Rickard, seconded by Councillor Hubbard Courtice THAT Report P-94-81, relative to Courtice Environmental Environmental Impact Analysis be received for information and tabled for Impact Analysis one month to give the Region of Durham an opportunity to reply. Planning and Development Committee - 2 - May 25, 1981 Resolution #PD -194-81 Moved by Mayor Rickard, seconded by Councillor Prout Rezoning THAT the recommendation in Report P-95-81 relative to Z -A-3-11-7 Application for Rezoning Z -A-3-11-7, part of lot 25, Newcastle Broken Front Concession, former Village of Newcastle Shoreline Ltd. Newcastle Shoreline Limited, be endorsed and: 1) Application for rezoning 2-A-3-11-7 be approved; and 2) The attached by-law be forwarded to Council for approval. "CARRIED" Resolution #PD -195-81 Moved by Councillor Prout, seconded by Councillor Taylor Amendment to THAT the recommendation in Report P-96-81, request from Building by-law R. J. Rutherford to amend the Town of Newcastle Building By-law - File 2.1, be endorsed and: Policy re 1) the report be received; and Issuance of 2) the attached by-law amending by-law 76-24 be forwarded Building to Council for approval; and Permits 3) Council adopt the attached policy in respect of the issuance of building permits. "CARRIED" Resolution #,PD -196-81 Moved by Councillor Taylor, seconded by Councillor Hamre THAT the recommendation in Report P-97-81 be endorsed and: 1) report P-97-81 be received; 2) the following resolution be submitted to Council for adoption and forwarded to the Central Lake Ontario Conservation Authority: 'VBEREAS flood susceptible areas are recognized in the Durham Regional Official Plan and the Official Plans of the Town of Newcastle; and WHEREAS the Town of Newcastle further regulates development in flood susceptible areas through the provisions of its restricted area by-laws, and WHEREAS the Central Lake Ontario Conservation Authority administers regulations in respect of development in flood susceptible areas, and Planning and Development Committee - 3 - May 25, 1981 Resolution #PD -196-81 (Continued) Flood Plan WHEREAS the "Designation" of flood susceptible Mapping areas as subject to the Terms of a Federal/Provincial Agreement in respect of Flood Risk Mapping allows for C.L.O.C.A. the further mapping of flood susceptible areas, BE IT NOW RESOLVED THEREFORE that the Town of Newcastle endorses the Flood Risk Mapping Program, inasmuch as it recognizes existing and ongoing Provincial and Municipal efforts to control development in flood susceptible areas and to minimize future flood damage". Resolution #PD -197-81 Moved by Councillor Hubbard, seconded by Councillor Taylor Cedar Park THAT the recommendation in Report P-98-81, Cedar Park 7burist Site Plan Carrp Site Plan Agreement, File S -P-1-12, be endorsed and: Agreement S -P-1-12 1) Report P-98-81 be received; and 2) the attached Development Agreement in respect of the Cedar Park Tburist Canp be approved by Council; and 3) the Clerk bring forward the necessary by-law to execute the Agreement at the Council meeting of June 1, 1981. Resolution #PD -198-81 Moved by Councillor Prout, seconded by Councillor Hamre Oshawa THAT the reconmendation in Report P-99-81 be endorsed and By-law 32-81 By-law 32-81 of the City of Oshawa be received and filed. Resolution #PD -199-81 Moved by Councillor Hubbard, seconded by Councillor Prout Hope By-law THAT the recommendation in Report P-100-81 be endorsed and 1968 By-law 1968 of the Township of Hope be received and filed. Planning and Development Committee - 4 - May 25, 1981 Resolution #PD -200-81 Moved by Councillor Hubbard, seconded by Mayor Rickard THAT the recommendation in Report P-101-81 relative to Proposed Site Plan Agreement Part of Lots 9 and 10 Concession 1, former 7bwnship of Darlington, Port Darlington Marina Hotel, File S -P-2-20 be endorsed and: Site Plan 1) report P-101-81 be received; and Agreement Port 2) the attached Agreement be executed; and D2rlington 3) the Clerk be directed to prepare a by-law for the Marina Hotel purposes of authorizing the execution of the attached Development Agreement for submission to and consideration by Council at its meeting of June 1, 1981. Resolution #PD -201-81 Moved by Councillor Prout, seconded by Councillor Hubbard Rezoning THAT the recommendation in Report P-102-81 relative to Z -A-2-13-1 Application for Rezoning part of lots 9 and 10, B.F. Port Darlington Concession, former Town of Bowmanville, Port Darlington Marina Marina - File Z -A--2-13-1 be endorsed and; 1) Report P-10?r 81 be received; and 2) application for rezoning Z -A-2-13-1 be approved; and 3) the attached by-law be forwarded to Council for approval concurrent with the execution of the Development Agreement referred to by Staff Report P-101-81. Resolution #PD -202-81 Moved by Councillor Hamre, seconded by Councillor Hubbard Reclassification THAT the recommendation in Report P-103-81 be endorsed and Queen's Hotel Newcastle from 1) Report P-103-81 be received; 'Hotel' to 2) Mr. R. R. Mills, Liquor Licence Board, Licence Officer 'Tavern' be forwarded a copy of this report in reply to his correspondence of April 30, 1981; and 3) the owners of the Queen's Hotel Ltd. be requested to file a rezoning application in respect of this matter. "CARRIED" Resolution #PD -204-81 Moved by Mayor Rickard, seconded by Councillor Prout Definition THAT the Solicitor be asked for an opinion on the definition of 'Frontage' of 'Frontage' in the Darlington Township By-law, where there is land abutting tvo roads, and the relevant section of the by-law. "CARRIED" Resolution #PD -205-81 Moved by Councillor Hubbard, seconded by Councillor Prout Noise By-law THAT whereas Staff, during the past year, prepared a draft and general noise by-law and some work on matters of general licensing, Licensing therefore be it resolved that the Director of Planning and the Town Clerk review this work and report back to the Committee. By-law 76-25 "CARRIED" Resolution #PD -207-81 Moved by Councillor Woodyard, seconded by Councillor Taylor THAT there be a 10 minute recess. 011 Planning and Development Comnittee - 6 - May 25, 1981 Resolution #PD -208-81 Moved by Councillor Hubbard, seconded by Councillor Woodyard THAT the meeting be 'in camera'. 01I Resolution #PD -209-81 Moved by Councillor Hubbard, seconded by Councillor Taylor Resolution #PD -210-81 Moved by Mayor Rickard, seconded by Councillor Prout Kirby Museum THAT Report P-91-81, referred from Council, be tabled for two weeks in light of the correspondence received to -day Morris House from the Ministry of Transportation and Communications. THAT the recommendation in Report P-93-81 be endorsed and: 1) Report P-93-81 be received; Exchange of 2) The Town Clerk be requested to bring forward the Property necessary by-laws for re -applying the Heritage Designation M.T.C. and to the Old Kirby School site, described as Part 2 of Town of Newcastle Plan 1OR-1289, and that on completion of that procedure; 3) The Town Clerk request the Town Solicitor to proceed with Redesignation of the conveyance of Parts 1 and 3 of Plan 1OR--1289 to the Heritage Site Ministry of Transportation and (bmrnmications in exchange for certain lands in Lot 25, Concession 6 (Clarke); Rezoning for 4) The attached restricted area by-law amendment applying to Commercial Purposes Part 3 of Plan 1OR--1289 be forwarded to Council and read a first and second time and tabled, to be lifted from the table and File G7 -Er 1 finally approved upon the completion of the Heritage Designation procedure described in point 2, above; and 5) The future possible owners of Part 3 of Plan 1OR--1289 be advised that the Town of Newcastle requires the owners of property to enter into site plan agreements prior to development taking place on commercially zoned land.
