Roll Call: Present were: Councillor Ann Cowman, Chairman Councillor Diane Hamre, Member Councillor Marie Hubbard, Member Councillor Maurice Prout, Member Councillor R. Bruce Taylor, Member Councillor E. R. Woodyard, Member Deputy Clerk, G. Gray, Secretary Absent: Mayor G. B. Rickard, Member, on Municipal Business Also Present: Director of Planning, Don Smith Resolution #PD -107-81 Moved by Councillor Taylor, seconded by Councillor Woodyard THAT the minutes of the meeting held on March 16, 1981 be adopted as read. "CARRIED" Delegations Andrew Orr Mr. Andrew Orr, representing Ridge Pine Park Inc. commented Ridge Pine on Reports P-60-81 and P-62-81. He agreed with the Park Ihc. recommendations in the reports. He stated that there was agreement with the Region of Durham relative to servicing but not the timing of the payment of the lot levies. Resolution #PD -108-81 Moved by Councillor Hubbard, seconded by Councillor Woodyard THAT Mr. Al Strike be heard at this time. "CARRIED" Al Strike Mr. Strike stated that the Bowmanville Business Centre was Bowmanville supportive of the recommendations 1, 2 and 4 in Report B.I.A. P-65-81 relative to Property Standards By-law, Mainstreet Revitalization Program and off-street parking. He said that the Bowmanville Business Centre would make a submission regarding the Property Standards by-law and were willing to make an application to the Ministry of Housing for a Mainstreet Revitalization loan. Planning and Development - 2 - April 13, 1981 J. Cameron Mr. Jerry Cameron of the Region of Durham Planning Regional Department addressed the Committee regarding the Planning servicing agreement with Ridge Pine Park Inc. and agreed Department. with the comments made by Mr. Orr. Mrs. Mastroianni Mr. S. Fischman representing Mrs. Mastroianni spoke to rezoning report P-64-81 and stated that she wished to have the Z -A-3-3-6 land rezoned as it was not viable for a farming operation. Mr. David Lawson addressed the Committee regarding conservation of Bowmanville Creek. He objected to David Lawson the dumping of town snow and other problems at the re creek. He presented a petition with approximately Conservation 1,000 names regarding Bowmanville Creek's future. of Bowmanville "This petition is to have the Central Lake Ontario Creek Conservation Authority or the Town of Bowmanville change the valley south of Highway #2 in Bowmanville from an eyesore and wasted land into a outdoors recreational area for family picnics, cross country skiing, sport fishing, jogging bird watching and many more outdoor activities". Resolution #PD -109-81 Moved by Councillor Hubbard, seconded by Councillor Taylor THAT there be a 10 minute recess. "CARRIED" Resolution #PD -110-81 Moved by Councillor Taylor, seconded by Councillor Hamre THAT the recommendation in Report P-56-81 be endorsed and: 1. Report P-56-81 be received; 2. The attached amendment to Restricted Area By-law 2111 as amended, be forwarded to Council for approval upon execution of a Development Agreement between the applicant and the Town of Newcastle which shall include, but shall not be specifically limited to, provisions in respect of the following: (i) That the owner dedicate to the Corporation of the Town of Newcastle a 3.0 metre (10 ft.) road widening along the entire frontage of the property abutting Baseline Road; Planning and Development - 3 - April 13, 1981 (i i) That a site grading and drainage plan be approved by the Town's Director of Public Works, the Central Lake Ontario Conservation Authority and the M.T.C. prior to the issuance of any building permit on the subject lands; (iii) That the Town shall require site plan agreements as a condition of development of all or part of the subject lands. Rezoning (iv) That such easements as may be required for Z -A-1-7-4 utility or drainage purposes shall be granted, part lots 31 and 32 free and clear of all encumbrances, to the B.F. Conc. appropriate authority; former Darlington (v) That the owner agrees to provide, on site, one Amyotte. or more reservoirs for fire fighting purposes, to the satisfaction of the Fire Chief for the Town of Newcastle; (vi) That no Occupancy Permits shall be issued for any building until such building is connected to and serviced by a potable supply of water and a sanitary sewage disposal system approved by the authority having jurisdiction; and (vii) That an overall site plan incorporating visual buffering of the future industrial uses adjacent to Hwy. 401, has been approved by the Town of Newcastle. "CARRIED" Resolution #PD -111-81 Moved by Councillor Taylor, seconded by Councillor Prout Building THAT Report P-57-81 be received and filed and Section 2.5 by-law 79-8 of By-law 79-8 be amended by adding the following words after "or a certificate of an Ontario Land Surveyor" "or such other evidence satisfactory to the Chief Official" "LOST" Resolution #PD -112-81 Moved by Councillor Woodyard, seconded by Councillor Hamre THAT by-law 79-8 be amended by adding the following words after "or a certificate of an Ontario Land Surveyor ""or such other evidence satisfactory to the Chief Official on lands with a minimum area of 50 acres"and staff be directed to bring forth the amending by-law to the next Council meeting. "LOST" Planning and Development - 4 - Resolution #PD -113-81 April 13, 1981 Moved by Councillor Woodyard, seconded by Councillor Taylor THAT the matter be referred back to staff to consult with the Solicitor to consider satisfactory arrangements in the case of Mr. Rutherford. "CARRIED" Resolution /FPD -114-81 Moved by Councillor Prout, seconded by Councillor Hamre Ontario Building THAT the recommendation in Report P-58-81 be endorsed Code 1974 and: Construction of Farm Buildings 1. Report relative to Ontario Building Code, 1974 Construction of Farm Buildings - correspondence from E.C.Aldridge, Valuation Manager, Assessment Region No. 13, be received for information. 2. A copy be forwarded to Mr. E. C. Aldridge; and that 3. No further action be taken. "CARRIED" Resolution #PD -115-81 Moved by Councillor Taylor, seconded by Councillor Woodyard Designation of THAT Report P-59-81 be received for information and C.L.O.C.A. council members avail themselves of the invitation Flood Plain to attend the presentation on April 21, 1981 at the Maps Region of Durham Planning Committee and the Director of Planning report back to a subsequent meeting. "CARRIED" Resolution #PD -116-81 Moved by Councillor Hubbard, seconded by Councillor Woodyard THAT the following recommendations in Report P-60-81 re Ridge Pine Park Inc. application to amend the Official Plan for the Township of Darlington be endorsed: Planning and Development - 5 - April 13, 1981 Resolution #PD -116-81 (Continued) 1. Report P-60-81 be received for information. 2. The following resolution and attached information be forwarded to the Regional Municipality of Durham in respect of application 81-9/ND: Ridge Pine Park Inc. "WHEREAS, the Durham Regional Official Plan designates amendment to part of Lots 1, 2 and 3, Broken Front Concession, Darlington former Township of Darlington, "for use as a mobile home Official Plan park development for adults", and 81-9/ND WHEREAS, the Town of Newcastle has adopted Restricted Area By-law 1181-15, rezoning the above-mentioned lands in acrcrdance with the Durham Regional Official Plan, and WHEREAS, the Durham Regional Official Plan prevails to the extent of any conflict between itself and any existing Official Plan, until such time as such existing Official Plans are amended or repealed,(Section 16.3.2) BE IT NOW RESOLVED THEREFORE that Regional Council be advised that Newcastle Town Council has "no objection" to the approval of application 81-9/ND and hereby requests the Region of Durham to undertake the preparation and processing of the requested amendment to the Official Plan of the former Township of Darlington". "CARRIED" Resolution #PD -11 Moved by Councillor Hubbard, seconded by Councillor Woodyard THAT the recommendation in Report P-62-81 be endorsed and 1. Report P-62-81 be received and the following resolution be forwarded to Council for adoption and submission to the Ontario Municipal Board: "WHEREAS the Ontario Municipal Board has considered the matter of the use of the lands subject to Town of Newcastle By-law81-15 and labelled R-60 on Schedule A (Map 5) of the Durham Regional Official Plan, and WHEREAS the Municipal Board has decided that the lands labelled R-60 are designated for use as a mobile home park development for adults, and Planning and Development - 6 - April 13, 1981 WHEREAS the Ontario Municipal Board's decision was appealed to the Ontario Cabinet, and WHEREAS the Ontario Cabinet upheld the Decision of the Municipal Board, and By-law 81-15 WHEREAS the Town of Newcastle has adopted Restricted Ridge Pine Park Inc. Area By-law 81-15 and has entered into an agreement with the proponents of the Mobile Home Park in respect of the proposed development, and WHEREAS By-law 81-15 and the Development Agreement, are in the opinion of the Town in conformity with the Durham Regional Official Plan BE IT NOW RESOLVED THEREFORE THAT: The Town of Newcastle hereby respectfully requests the Ontario Municipal Board to approve Restricted Area By-law 81-15 of the Town of Newcastle". Staff be authorized to publish a public notice advising the public of the deadline for compliance with the provisions of By-law 76-25, as amended. "CARRIED" On being put to a vote, Resolution #PD -118-81 was "CARRIED" Planning and Development - 7 - April 13, 1981 Resolution #PD -120-81 Moved by Councillor Woodyard, seconded by Councillor Taylor Rezoning THAT the recommendation in Report P-64-81 be endorsed with Z -A-3-3-6 the addition of recommendation 3. as follows: part lot 30 Conc. 4 1. That Application for Rezoning Number Z -A-3-3-6 be Clarke denied due to non -conformity with the provisions or Mr. and Mrs. intent of the Durham Regional Official Plan; and Mastroianni 2. That the Region of Durham and the applicant be advised of Council's actions; and 3. Mrs. Mastroianni be advised that Planning Staff is available to discuss other alternatives within the same fee structure. Resolution #PD -122-81 Moved by Councillor Taylor, seconded by Councillor Hamre THAT the recommendations be divided into 7 subjects. "CARRIED" Resolution #PD -123-81 Moved by Councillor Taylor, seconded by Councillor Hamre THAT Report P-65-81 be received. "CARRIED" Resolution #PD -124-81 Moved by Councillor Taylor, seconded by Councillor Woodyard THAT recommendation 2. be approved as follows: Maintenance "THAT the Committee recommend to Council that the Town and Occupancy implement a property standards program through the adoption By-law of a Maintenance and Occupancy By-law and provide staff with direction as to the area to be covered and the budget for the program." 11CARRIED AS AMENDED" Planning and Development - 8 - Resolution #PD -125-81 April 13, 1981 Moved by Councillor Taylor, seconded by Councillor Hubbard THAT the previous resolution be amended by deleting all the word following " Maintenance and Occupancy By-law" and adding "for the Town of Newcastle". "CARRIED" Resolution #PD -126-81 Moved by Councillor Taylor, seconded by Councillor Woodyard THAT recommendation 3. in Report P-65-81 be adopted as follows: Main Street 3. That the Committee recommend to Council that the Town Revitalization support an application for a Mainstreet Revitalization Program Loan Program Loan from the Bowmanville Business Improvement for the Area Board of Management and in that regard consider Bowmanville adopting off-street parking policies for the Main B.I.A. Central Area of Bowmanville in conjunction with the preparation of a downtown project proposal required by the Main Street Revitalization Program, said considerations to include examination of the possibility of establishing a Municipal Parking Authority. "CARRIED" Resolution #PD -127-81 Moved by Councillor Hubbard, seconded by Councillor Taylor THAT recommendation 4. in Report P-65-81 be approved as amended to read: Administrative 4. That the Committee request the Directors of Planning Facility and Works and the Clerk and Administrator to bring Study forward terms of reference for a study of the Town's administrative facility requirements within one month. "CARRIED" Planning and Development - 9 - April 13, 1981 Resolution #PD -128-81 Moved by Councillor Prout, seconded by Councillor Taylor THAT Recommendations 5 and 6, in Report P-65-81 be dealt with 'in camera' at the end of the meeting. "CARRIED" Resolution #PD -129-81 Moved by Councillor Hubbard, seconded by Councillor Woodyard THAT Recommendation 7. in report P-65-81 be approved as follows: Sale of 7. That the Committee recommend to Council that the Town Bowmanville offer those municipal lands situate in the Bowmanville Creek Valley Creek Valley, south of Highway Number 2 to the Central Lands to Lake Ontario Conservation Authority for a nominal ($2.00) C.L.O.C.A. provided that all legal and survey expenses are borne by the Central Lake Ontario Conservation Authority. "CARRIED" Resolution #PD -130-81 Moved by Councillor Hubbard, seconded by Councillor Hamre Long THAT Report P-71-81 relative to the filling of the position Range of Long Range Planner in the Planning and Development Planner Department, be received for information. "CARRIED" Resolution #PD - Moved by Councillor Hubbard, seconded by Councillor Taylor THAT the recommendation in Report P-72-81 be approved and 1. Report P-72-81 be received. 2. Application for Rezoning Z -A-2-6-5, part of lot 9, Concession 2, former Town of Bowmanville, John Bolahood, be denied due to non -conformity with the provisions of the Durham Regional Official Plan and the Official Plan of the former Town of Bowmanville; and Planning and Development - 10 - April 13, 1981 Rezoning Resolution #PD -131-81 (Continued) Z -A-2-6-5 part lot 9 3. That the Region of Durham and the applicant Conc. 2 be advised of Council's actions. Bowmanville (Bolahood) "CARRIED" Resolution #PD -132-81 Moved by Councillor Hubbard, seconded by Councillor Taylor THAT the minutes of the meetings of the Committee of Committee of Adjustment, held on February 25, 1981 and March 25, 1981 Adjustment be received for information. "CARRIED" Resolution #PD -133-81 Moved by Councillor Hubbard, seconded by Councillor Prout THAT the meeting be'in camera' to discuss Recommendations 5 and 6 in Report P-65-81. "CARRIED" Resolution #PD -134-81 Moved by Councillor Taylor, seconded by Councillor Hubbard THAT recommendation in Report P-65-81, No. 5, be approved as follows: Land Purchase 5. The Committee recommend to Council that certain lands from M.T.C. adjacent to the Main Central Area of Bowmanville be purchased from the Ministry of Transportation and Communications in an amount not exceeding $10,000. and that the Town solicitor be instructed to complete such transaction as soon as possible. "CARRIED" On being put to a vote, Resolution #PD -134-81 taas "LOST" Planning and Development - 11 - April 13, 1981 Resolution #PD -136-81 Moved by Councillor Taylor, seconded by Councillor Woodyard THAT Recommendation 5 in Report P-65-81 be adopted as amended as follows: Land Purchase 5. That Committee recommend to Council that certain lands from M.T.C. adjacent to the Main Central Area of Bowmanville be purchased from the Ministry of Transportation and Communications in an amount not exceeding $10,000. to be taken from the Parking Reserve Account and that the Town Solicitor be instructed to complete such transaction as soon as possible. "CARRIED" Resolution #PD -137-81 Moved by Councillor Taylor, seconded by Councillor Hubbard THAT Rec ommendation 6 in Report P-65-81 be adopted as follows: Land Purchase 6. That Committee recommend to Council that certain other lands be considered for purchase by the Town in conjunction with those lands mentioned in recommendation (5) above on the basis of a property appraisal to be undertaken by the Town and hereby authorized.
