R. Woodyard, Member Mayor G. B. Rickard, Member Deputy Clerk, G. Gray, Secretary Absent were: Councillor Marie Hubbard, Member, due to illness Councillor R.B.Taylor, Member Also Present: Director of Planning, Don Smith Resolution #PD -28-81 Moved by Con. Prout, seconded by Con. Woodyard THAT the minutes of the meeting held on January 5, 1981, be adopted as read. "CARRIED" Delegations The Director advised that Mr. Sucee did not wish to speak to the Committee. Resolution #PD -29-81 Moved by Mayor Rickard, seconded by Con. Woodyard THAT Mr. I. Gleiberman be heard. "CARRIED" I. Gleiberman Mr. Gleiberman requested that the Committee reconsider Waverly the recommendation made to Council regarding the Waverly Heights (Oshawa) Heights (Oshawa) Subdivision as he had not received Subdivision notice that the matter would be on the Agenda on January 5th. He and his client wished to make further representations. Planning and Development Committee - 2 - January 19, 1981 Resolution #PD -30-81 Moved by Mayor Rickard, seconded by Con. Prout THAT Mr. L. Beaupre be heard. "CARRIED" L. Beaupre Mr. Beaupre spoke relative to Report P-22-81, Rezoning Z -A-3-7-1 Z -A-3-7-1. He gave a history of his business in that Part Lot 24 location since 1967. He asked when his property would Conc. 8, Clarke be rezoned. Resolution #PD -31-81 Moved by Con. Prout, seconded by Mayor Rickard THAT Mr. R. Ashton be heard. "CARRIED" R. Ashton Mr. Ashton spoke to the Committee regarding Report P-19-81 Redesignation redesignation of Boundary Road, Newcastle/Scugog, and Boundary Road supported the recommendation in the report. Resolution #PD -32-81 Moved by Con. Prout, seconded by Con. Woodyard By-law 80-80 THAT the recommendation in Report P-12-81 be endorsed Township or and By-law 80-80 of the Township of Scugog, be received Scugog and filed. Prout Courtice THAT the recommendation in Report P-13-81 be endorsed Staging and it be recommended to Council that there be no limit File 2.2 placed upon the amount of residential development within the Courtice Urban Area for the year 1981. "CARRIED" Planning and Development - 3 - January 19, 1981 Resolution #PD -34-81 Moved by Con. Prout, seconded by Con. Hamre Rezoning THAT the recommendation in Report P-14-81, relative to Z -A-1-4-3 Rezoning Z -A-1-4-3, part lot 21, Cone. 2, Darlington, (Bob's (Bob's Towing) be endorsed and: Towing) 1. The report be received for information. 2. The request for rezoning of Part 3, Plan IOR-1190 be approved; and 3. The attached by-law be forwarded to Council for approval. "CARRIED" Resolution #PD -3 Moved by Con. Prout, seconded by Con. Hamre THAT the recommendation in Report P-15-81 be endorsed and: 1. The report be received O.P.A. 2. The Region of Durham be advised that the Town of Newcastle Amendment would have no objection to Oshawa's proposed amendment to Oshawa the Durham Regional Official Plan, File 80-37/D, provided 80-37/D that the minimum size for a Local Central Area is not Sec. 8.2.3.4 greater than 1000 square metres (10,765 square feet) and Regional that a mechanism is established for requiring a retail Plan analysis for commercial proposals of less than 1000 square metres where sufficient concern about potential impacts exist to warrant such an analysis. "CARRIED" Resolution #PD -36-81 Moved by Mayor Rickard, seconded by Con. Woodyard THAT the recommendation in Report P-16-81 be endorsed and: 1. The report be received for information; 2. The Ontario Municipal Board be advised that the Council of the Town of Newcastle has reviewed By-law 80-148 in light of the objection filed, and wishes to proceed with the said by-law, as approved by Council on November 3, 1980, and 3. Staff be authorized to attend any Ontario Municipal Board Hearing which may be held in respect of the said By-law, accompanied by the Town's Solicitor, if deemed necessary; 4. In the event that the appeal is not successful, that Staff be authorized to request the Ontario Municipal Board to award the Town of Newcastle an amount equal to the Town's costs in respect of the said Hearing; and Plannning and Development Committee - 4 - January 19, 1981 By-law 5. Woodyard Rezoning THAT the recommendation in Report P-18-81, as corrected Z -A-3-7-5 by substituting Report P-15-80 for P-27-80 be endorsed (Irwin) and the report be received for information and the recommendations in Report P-15-80 be adopted and the application for rezoning Z -A-3-7-5, part lot 24, Concession 6, former Township of Clarke, Stuart Irwin, be denied. "LOST" Resolution #PD -38-81 Moved by Con. Hamre, seconded by Con. Woodyard THAT the Director of Planning contact Mr. and Mrs. Irwin and their Solicitor to discuss the matter and try to come to some kind of agreement and ascertain the current situation and report back. "CARRIED" Resolution #PD -39-81 Moved by Con. Prout, seconded by Mayor Rickard Rezoning THAT the recommendation in Report P-19-81 be endorsed and Z -A-1-11-10 Application for Rezoning Z -A-1-11-10, proposed redesignation (Ashton) of Boundary Road (Newcastle/Scugog) Lots 11 and 12, Concession Boundary 10, former Township of Darlington (Mr. and Mrs. R. Ashton) be Road approved and the attached by-law be forwarded to Council for approval. "CARRIED" Planning and Development Committee - 5 - January 19, 1981 Resolution #PD -40-81 Moved by Con. Woodyard, seconded by Con. Hamre Ridge Pine THAT the recommendation in Report P-20-81 relative Park Inc. to Ridge Pine Park Incorporated, Application for Rezoning Rezoning Z -A-1-7-5 (2), Development Agreement Z -A-1-7-5(2) S -P-1-5, Part of Lots 33, 34 and 35, Concession 1, and of the former Township of Clarke and Part of Lots Development 1, 2 and 3 of the Broken Front Concession of the Agreement former Township of Darlington, be endorsed and: S -P-1-5 1. Report P-20-81 be received. 2. Town Council adopt the attached zoning by-law and adopt the attached development agreement and instruct the Town Clerk to prepare the necessary by-law for execution of the said development agreement for consideration of Council at their meeting of January 26, 1981; and 3. Authorization be given to the Town Solicitor and the Director of Planning to attend the anticipated Ontario Municipal Board Hearing in respect of these matters and to request the Board on behalf of the Municipality to consider approval of the attached by-law and development agreement. Numbering "CARRIED" Planning and Development - 6 - January 19, 1981 Resolution #PD -43-81 Moved by Mayor Rickard, seconded by Con. Prout Rezoning THAT report P-22-81, Application for Rezoning Z -A-3-7-1 Z -A-3-7-1, part of lot 24, Concession 8, former Beaupre Township of Clarke, Margaret Beaupre, be tabled giving the Director of Planning an opportunity to discuss the matter in full with Mr. Beaupre. "CARRIED" Resolution #PD -44-81 Moved by Con. Woodyard, seconded by Con. Prout Manure THAT it be recommended to Council that Report P-23-81 Storage Manure Storage Facilities, File 28.1 be received for Facilities information. "CARRIED" Addendum Resolution #PD -45-81 Moved by Mayor Rickard, seconded by Con. Prout N. Forrest THAT the resignation of Ms Norma Forrest as Current Resignation Operations Planner, be accepted with regret. "CARRIED AS AMENDED" Resolution #PD -46-81 Moved by Con. Prout, seconded by Con. Hamre THAT the Mayor and Director of Planning prepare a formal acknowledgment from Council. "CARRIED" Planning and Development - 7 - January 19, 1981 Resolution #PD -47-81 Moved by Mayor Rickard, seconded by Con. Prout Waverly THAT the principles in Waverly Heights (Oshawa) Heights Limited, Mr. Gleiberman and Mr. Zygocki be given (Oshawa) the opportunity to present their case at the Limited next Planning and Development Committee meeting in light of the fact that they claim not to have received notice that the item was on the previous agenda and that the Regional Planning Department be so notified.
