Minutes PRESENTATIONS DELEGATIONS PUBLIC MEETINGS ... - 2 - May 3, 2004 IIlIIIlI (a) Peter Watson, Manager, Waste Management, Region of Durham, provided a presentation on the waste management services in the Municipality of Clarington. Mr, Watson highlighted existing waste management services, recent waste successes and future plans for reducing garbage, He indicated that between May 2003 and February 2004, a 40 percent waste diversion has been realized. Comparisons from May 2002 to February 2003 show a 12 percent reduction in garbage disposal, an 18 percent increase in recyclables and a major increase in compostables. Commencing May 31, 2004, more materials will be introduced into the Blue Box program. Effective July 1, 2006, the garbage bag limit will be reduced to two bags per week and only clear plastic bags will be allowed, Effective in 2008, alternate week Blue Box recycling and bi-weekly garbage collection will be introduced. Durham Region has the fifth largest Blue Box program in Ontario and the possibility of a new recycling centre is being examined. ... ... ... IiIII .. The lands are currently designated urban residential subject to "Special Policy Area F - King Street Corridor". III 3.0 BACKGROUND 3.1 The By-law Enforcement Division received a complaint on September 16, 2003 concerning a business that was operating on the subject lands. After an investigation of the facility, Staff determined that the business was not permitted by the applicable Official Plan policies and zoning regulations. The applicant was advised to file the appropriate applications to legalize the day spa use. .. .. .. 3.2 On October 2, 2003, Staff received official plan amendment and rezoning applications from 988925 Ontario Inc. to permit a mixed use development consisting of retail in the existing building and two new buildings four and five storeys tall. Each building proposed retail commercial uses on the ground floor with residential condominium on subsequent floors. The applications were deemed incomplete and Staff met with the applicant on several occasions to discuss supporting documentation requirements for the proposal. The applications also proposed to legalize the existing day spa use. till - .. 3.3 On February 4, 2004, the applicant submitted revised official plan amendment and rezoning applications to legalize the existing spa use only. This report is considering the spa use in the existing dwelling at this time. .. - 602 .. .. - - - - - - - ... - - .. - - - - - - - REPORT NO.: PSD-053-Q4 PAGE 3 4.0 SITE CHARACTERISTICS AND SURROUNDING USES 4.1 The site is relatively flat but sloping towards the Slack Creek at the northem edge of the ,property. The Black Creek forms the northern limit of half of the property. The creek is in a well-defined valley, with majority of the creek edge and valley being vegetated with cedar trees. The property contains an existing residential dwelling that is currently being used for the purposes of a day spa. 4.2 Surrounding Uses: East: North: West: South: Residential Slack Creek, Courtice North Public School, and Birchdale Village Courtice Baptist Church Vacant lands and residential 5.0 OFFICIAL PLAN POLICIES 5.1 The Clarington Official Plan designates the property urban residential subject to "Special Policy Area F - King Street Corridor" and "Environmental Protection Area". The land use policies in this area of Courtice permit residential intensification to create a transit supportive environment. Medium and high density residential, recreation, community facilities, institutional, and limited office uses are permitted on these lands. As the proposed commercial use is not permitted within this designation, an amendment to the Clarington Official Plan was submitted for consideration. 5.2 Section 4.4.24 of the Clarington Official Plan requires that an environmental impact study be undertaken to assess development impacts where an application abuts a natural feature identified on Schedule C. The subject lands abut the Black Creek and its associated tableland woodlot and valley. The applicant will be required to fulfil this provision. 6.0 ZONING BY -LAW CONFORMITY 6.1 The property is currently zoned "Urban Residential Type One (R1) Zone" and "Environmental Protection (EP) Zone", which does not permit the proposed use. In order to consider the proposed development, a rezoning application was submitted for consideration. 7.0 PUBLIC NOTICE AND SUBMISSION 7.1 Public notice was given by mail to each landowner within 120 metres of the subject site and a public meeting notice sign was installed on the property's road frontage. 603 .. REPORT NO.: PSD-053-04 PAGE 4 .. 7.2 One general inquiry has been received on these applications to date. .. 8.0 AGENCY COMMENTS 8.1 The Clarington Engineering Services Department has no objections to the proposed official plan amendment and rezoning application provided that the following information is provided: .. till · A lot grading and drainage plan must be submitted for review. · An appropriate cash-in-Iieu of parkland contribution is necessary. · A building permit or change of use permit will be necessary for the spa use. .. 8.2 The Durham Region Health Department cannot provide comment until the applicant provides a site servicing report outlining the size and location of sewage system as well as sewage flow rates for the existing spa use. . 8.3 Due to the limited commenting period, comments from the Clarington Emergency Services Department, Durham Region Planning Department, Durham Region Public Works Department, Central Lake Ontario Conservation, and Hydro Networks Inc. have not been received to date. III ... 9.0 COMMENTS - 9.1 The applicant has retained a consultant to prepare a development concept for the remaining property. A separate Public Meeting will be scheduled when this application is submitted. .. 9.2 As per the requirements of the Clarington Official Plan, Staff will prepare the terms of reference for a scoped Environmental Impact Study to determine the impacts of the current proposal on the Black Creek and the associated woodlot and valley system. The study will determine appropriate development setbacks from the natural feature. Additional information, specifically a Phase 1 Environmental Site Assessment and a Functional Servicing Report were required before the applications could be considered complete. On March 1, 2004 the applications were deemed complete and subsequently circulated to agencies for comment and a public meeting was scheduled. 4.0 SITE CHARACTERISTICS AND SURROUNDING LAND USES 4.1 The subject lands consists of a mixture of vacant agricultural and forested lands with storage sheds. 4.2 Surrounding Uses West - vacant, Draft Approved Plan of Subdivision 18T-92014 East - Courtice Auto Wreckers, rural residential North - vacant, Draft Approved Plan of Subdivision 18T-92014 South - vacant, rural residential ..,. 608 .. .. .. .. .. .. .. .. .. .. ... .. ... '. ... .. .. .. .. - REPORT NO.: PSD-054-04 PAGE 3 - 5.0 SUPPORTING DOCUMENTATION - 5.1 Phase I Environmental Site Assessment, dated February, 2004. - The consulting firm of Golder Associates were retained by the applicant to undertake a Phase 1 Environmental Site Assessment. The primary objective of the assessment is to document site conditions on the day of the site reconnaissance and if possible identify former or current practices on the subject property that may present issues of potential environmental concern. - 5.1.1 Potential environmental concerns were identified with the following: - - ~ According to interpretation of aerial photographs, Courtice Auto Wreckers was established some time between 1954 and 1964. Typically, activities carried out at an auto recycling facility include the handling and storage of solvents and/or hydro-carbon based materials, which have the potential to impact the subsurface. Aboveground storage tanks containing unknown contents were also observed on the site. Based on the anticipated hydraulically upgradient location and close proximity of the auto recycling facility to the subject property there is potential for impacts of the subsurface at the site. - .. - ~ Various sheds on the subject property where identified containing items such as solvents/fuel containers, a freezer, chairs, mattresses and scrap metal. The exterior of some but not all sheds were covered with suspected asbestos- containing siding. - ~ Six 45 gallon drums were present at various locations across the subject property with the exception of one sealed drum, suspected to be empty, all others contained items such as snow, ashes, wood, scrap metal, cardboard and rags. - - The Ministry of the Environment was contacted to determine if approvals, permits or licences for the property have been issued or if any control orders or violation notices have been issued for the property. At the time the Phase 1 Report was prepared a response from MOE had not been received. Depending on the comments an addendum to the Phase 1 report may be required. - 5.2 Functional Servicing report .. The consulting firm of Sernas Associates was retained to prepare a Functional Servicing Report. The report concluded that the site can be adequately serviced with municipal sanitary sewer and water once services are extended to Draft Approved Plan - of Subdivision 18T-92014 and provided along Nash Road. Minor storm drainage can be accommodated in the storm sewer design for Draft - Approved Plan of Subdivision 18T-92014. Major overland flow can be accommodated with outfall to Nash Road via local streets and outlet to. the stormwater management facility located at the south-east corner of Nash Road and Courtice Road. - 609 ... REPORT NO.: PSD-054-Q4 PAGE 4 6.0 OFFICIAL PLAN POLICIES 6.1 Durham Region Official Plan 6.1.1 Within the Durham Regional Official Plan, the lands are designated as Living Area, with an indication of Environmentally Sensitive Areas. Lands designated as Living Area permit the development of communities with defined boundaries, incorporating the widest possible variety of housing types, sizes and tenure. Environmentally Sensitive Areas refer to those natural areas containing wetlands, aquifer recharge areas, headwater areas, unique plants, wildlife, breeding habitats, vital ecological functions, endangered species or Natural Areas of Scientific Interest. The subject property is bounded by Nash Road Street, which is designated as a Type "B" Arterial. 6.2 Clarington Official Plan 6.2.1 Within the Clarington Official Plan, the subject lands are designated as Urban Residential and Environmental Protection Area. The use of land in the Urban Residential designation is predominantly for single and semi detached housing. The lands are within the Hancock Neighbourhood, which has a population allocation of 2900 and a housing unit target of 975. 6.2.2 The Environmental Protection Area is in consideration of a significant woodlot and wetland identified on Map C1, Natural Heritage System. The subject site is within the Lake Iroquois Beach. The wetland is a portion of the Black/Farewell Wetland Complex, a Provincially Significant Wetland. An Environmental Impact Study (EIS) is required for development applications located on lands within or adjacent to the Lake Iroquois Beach and/or, any natural heritage feature identified on Map C1. In addition, as condition of draft approval, plans of subdivision within the Lake Iroquois Beach shall contain provisions to implement the recommendations of any EIS , watershed study or subwatershed study to maintain or enhance groundwater functions including but not limited to special house and infrastructure design requirements, stormwater management or construction techniques. .. .. .. .. .. .. .. till ... .. .. till ... will 6.2.3 Prior to municipal approval of any draft plan of subdivision, the municipality will prepare ... a sub-watershed plan. Where a master drainage plan has been approved, the master drainage plan will substitute for the requirement for a subwatershed plan. A master plan was prepared and submitted for the approval of the Municipality and the Central Lake .. Ontario Conservation Authority in 1991. 6.2.4 Map 0 shows a symbol for a Waste Disposal Assessment Area immediately east of the .. subject site. Waste Disposal Assessment Areas shall include all lands that may be influenced by a site on which waste has been deposited, or by a site on which waste will be deposited under a Provisional Certificate of Approval issued under the ... Environmental Protection Act. The area of influence shall be defined as 500 metres from the lands containing wastes unless otherwise determined by the Province. ~..o .. - REPORT NO.: PSD-054-04 PAGE 5 ... - Development within these areas shall be regulated in order to protect public health and safety and to ensure land use compatibility. New development will not be permitted within a Disposal Assessment Area unless the following requirements are met: - a) written approval is received from the Province that the provisions of the relevant legislation are satisfied; b) studies of gas, leachate, hydrogeology and structural stability, soil and ground water contamination, presence of hazardous wastes and safety are completed which show the development is compatible and can safely take place; and; c) measures are taken to the satisfaction of the province in consultation with the Municipality to control any problems identified through the above study. .. - - 6.2.5 Hancock Neighbourhood Plan - The proposed Plan of Subdivision is located within Hancock Neighbourhood. A neighbourhood design plan was prepared and approved by the Director of Planning and Development and the Director of Public Works in September 1998. The plan provides a visual interpretation of the future development of the neighbourhood. The proposed plan of subdivision has been prepared in keeping with the approved neighbourhood plan. .... - 7.0 ZONING BY-LAW - .. 7.1 Within Comprehensive Zoning By-law 84-63, as amended the lands are zoned "Agricultural (A)" and "Environmental Protection (EP)". A zoning by-law amendment will be required in order to implement the proposed plan of subdivision. - 8.0 PUBLIC NOTICE AND SUBMISSIONS - 8.1 Public Notice was given by mail to each landowner within 120 metres of the subject site. A Public Meeting sign were installed on Nash Road. - 8.2 On March 14, 2004 Ms. Libby Racansky appeared before Council to express concerns with urban sprawl particularly in relation to development in and adjacent to the Hancock Neighbourhood. Her concerns specifically quote the applications submitted by Headgate and the applications to amend the Durham Region Official Plan, Clarington Official Plan and Hancock Neighbourhood Plan submitted by Nash Road Development to expand the urban boundary of Courtice. Ms. Racansky on behalf of the Hancock residents requested the following: a) no further development applications be dealt with until the draft Zoning By-law identifies areas for development, taking into consideration Ministry of Natural Resources wetland boundary; - - - 611 - REPORT NO.: PSD-054-G4 PAGE 6 b) refine the Hancock Neighbourhood Plan taking into account the wetland boundary; c) planning practices should curb low density urban sprawl by permitting high density along Nash Road and thereby avoiding expansion to the urban area boundary. Council referred the correspondence to the Planning Department for consideration through the Headgate application. 8.3 On April 5, 2004 Council considered and referred a letter from Udo and Heather Stevens dated March 16, 2004, regarding development in the Nash/Hancock Road area to the Planning Department. Mr. and Mrs. Stevens are concerned with the proposed Highway 407 linkage and development within and adjacent to the Hancock neighbourhood and the impact it will have on the wetland, farmland and their quality of life. 9.0 AGENCY COMMENTS 9.1 Comments have not been received from the following departments and agencies: . Region of Durham Planning Department . Region of Durham Works Department . Ministry of Culture . Ministry of Environment . Public School Board 9.2 The following agencies offered no objections: · The Clarington Emergency Services Department · Engineering Services- Building Division . Region of Durham Health Services Department 9.3 The Clarington Engineering Services Department Engineering and Parks Division offered the following comments. · Actual development cannot proceed until such time as suitable road connections and all related urban services have been constructed within the adjacent draft plan of subdivision. Suitability of road accesses anp timing of development will be made at the sole discretion of the Director of Engineering Services. · Nash Road is designated as a Type 'B' Arterial in the Clarington Official Plan. A 5.00 metre road widening is required. · All utilities such as hydro, telephone and cable within the streets must be installed underground. · Temporary turning circles will be required at the terminus of Street 'B' and 'C'. The proposed entrances must conform to all current zoning requirements. - · The developer is required as a condition of the subdivision agreement to make the front end payments to the Municipality for the amounts stated in the front end agreement entered into between the Municipality and Macourtice Developments Inc. for the storm water management facilities located at Courtice Road and Nash Road. - - · The storm water drainage works and facilities necessary for this development must be constructed in accordance with the Black Creek Tributary Master Drainage Study. ... · The applicant's engineer will be required to prepare a Preliminary Grading and Drainage Plan. - · Construction of the development cannot proceed until such time as the Municipality has approved expenditure of funds for the reconstruction of Nash Road to full urban standards from Courtice Road (Regional Road 34) to Hancock Road. - - · The owner will be responsible for 50% of cost for the reconstruction of Nash Road fronting Lots 29 to 32. The cost will include any works including storm water drainage improvements that are deemed necessary by the Director of Engineering Services. - . Block 36 (Park) must be provided gratuitously to the Municipality as parkland dedication. - 9.4 The Central Lake Ontario Conservation Authority advises that a portion of the Black/Farewell Provincially Significant Wetland Complex is located on the subject property. An Environmental Impact Study (EIS) will be required, to the satisfaction of the CLOCA, prior to issuance of positive comments on the applications for rezoning or Draft Plan of Subdivision. Once the EIS is completed and the developable portions of the property are determined, it will be necessary for the proponent to revisit the Hancock Neighbourhood Design Plan. - - - 9.5 Bell Canada does not require any easements or leases for its services. As a condition of draft plan approval the owner will be requested to enter into an agreement with Bell Canada complying with any underground servicing conditions imposed by the Municipality. 613 - - REPORT NO.: PSD-054-04 PAGE 8 1 0.0 STAFF COMMENTS 10.1 The applicant wishes to develop a 35 residential unit Plan of Subdivision consisting of 29 single detached dwellings and 6 semi detached dwellings. The draft plan also includes portions of a park block and a public elementary school block identified in the Hancock Neighbourhood Plan. The balance of the school and park blocks are shown on Draft Approved Plan of Subdivision 18T 92014. 10.2 The Hancock Neighbourhood has been identified for urban residential development in the Clarington Official Plan. It contains provisions for a neighbourhood park, public elementary school, single and semi detached residential units. A large portion of the neighbourhood is covered by an Environmental Protection Area in consideration of the Black/Farewell Wetland Complex and significant woodlots. The Hancock Neighbourhood Plan further defines the neighbourhood by identifying areas for existing and future development, roads, storm water facilities, woodlots and green space. The Neighbourhood plan was approved in 1998. 10.3 The subject property is immediately adjacent to Draft Approved Plan of Subdivision 18T-92014, also know as Courtice Heights Developments. In 1995 Council deferred consideration of the applications for draft plan of subdivision approval and rezoning for 18T-92014 and 18T-94027 until the approval of the Clarington Official Plan. The applicant appealed the applications to the Board on the basis of Council's refusal or neglect to make a decision of the applications. The applications were approved by the Ontario Municipal Board in July 1999. Development of the Headgate lands relies on the timing of service and road infrastructure for the Courtice Heights Development land. 10.4 In 1999 the Ministry of Natural Resources re-evaluated the wetland and identified additional areas as being ecologically significant and added them to the Complex. A portion of the wetland complex is identified on the school and park block on the Headgate lands. A large portion of the wetland is also west of 18T -92014 and south of 18T-94027. The Provincial Policy Statement states that no development will take place on a significant wetland, however development may be permitted on adjacent lands if it can be demonstrated that there will be no negative impacts on the natural features or on ecological functions. In keeping with the Provincial Policy Statement the Clarington Official Plan requires an EIS for development within 120 metres of a wetland or wetland complex. Staff met with Mr. Anderson of Headgate and Mr. Manson of Courtice Heights Developments to discuss the need for Environmental Impact Studies in the area. Mr. Anderson agreed to undertake the EIS for the wetland portion on the Headgate lands while Mr. Manson, by letter agreed to undertake an EIS for the area south of Plan of Subdivisions 18T-94027 and west of 18T-92014. - ... ... - - - .. .. .. .. .. ... .. .. - IIiII Once the recommendations for both EIS studies have been reviewed and deemed acceptable by the Municipality and the Central Lake Ontario Conservation, the Hancock .. REPORT NO.: PSD-OSS-Q4 PAGE 2 .. 1.0 BACKGROUND 1.1 In March of 2001 the firm of Totten Sims Hubicki Associates submitted a report entitled the Old Bowmanville Neighbourhood Streetscape and Infrastructure Implementation Plan that they had prepared at the direction of Council. The report noted that the Old Bowmanville Neighbourhood Association (OBNA) had identified the area bounded by Wellington Street, Liberty Street, and Concession Street as unique and that it be preserved as part of any infrastructure renewal program. The report suggested that a "special designation" be considered by Council for this section of Bowmanville. .. .. .. 1.2 Through Resolution #C-419-01 Council directed staff to commence discussions with the OBNA regarding an appropriate designation for the area. Upon meeting with representatives of the OBNA it was indicated that the special designation they might be seeking could be the designation of the area as a Heritage Conservation District under the Ontario Heritage Act. In October of 2001 a formal request was received to begin the process of examining the area for its potential to become a designated heritage conservation district. ... .. III 1.3 All heritage conservation districts are designated under Part V of the Ontario Heritage Act. The Act does not state a particular process or provide detailed steps that must be followed in order to obtain designation. It simply states that Council may by by-law define one or more areas of a municipality as an area to be examined for future designation as a heritage conservation district and the Council may, after such examination is complete, prepare Official Plan provisions with respect to such designation. Council is required to consult with its heritage committee (LACAC) before passing such a by-law. If the municipality's Official Plan contains provisions relating to the establishment of heritage conservation districts, Council may by by-law designate an area as a heritage conservation district. There is no detailed procedure requiring extensive public consultation, the preparation of background studies, or the preparation of district guidelines or plans. ... - .. IIlIli - 1.4 Due to the lack of specific regulations in the Ontario Heritage Act, staff conducted research the process used by other municipalities in obtaining approval of heritage conservation districts. Staff reviewed the Ministry of Tourism, Culture and Recreation Guidelines which outlines the key ingredients for a successful heritage conservation district, as well as consulted with Ministry staff. .. - 1.5 The designation of a district is a lengthy process encompassing a number of steps. On May 21, 2002, Report PSD-048-02 was presented to Council for information purposes. The Report explained the steps and procedures involved in designating a district based on the Ministry Guidelines and the successful practices of other municipalities. This report is included in the public consultation appendix of the Bowmanville Heritage Conservation District Background Study. Section 3.4 of Report PSD-048-02 notes that the study process should have two separate phases. Phase I would be to conduct a Heritage Conservation District .. .. .. 619 .. - - - - - - - - - - - - - - - - - - - REPORT NO.: PSD-055-04 PAGE 3 Background Study. The study would serve as a primary support to justify the area as being historically significant. The objectives of the study are to examine: . The historical growth and development of the prospective district within the context of Bowmanville's settlement history . The streetscape and landscape attributes of the neighbourhood . The planning policies that may impede or enhance heritage conservation . The heritage resources in the proposed district and their architectural and historical associations, and . . The appropriate boundaries for the designated area 1.6 Phase II would be the preparation of the Heritage Conservation District Guidelines. The Guidelines are to provide the basis for the management and protection of the area's heritage resources including the buildings, the open spaces, and the landscape features. The intent of the Guidelines is to conserve and maintain the original building form with particular emphasis on what is visible from the street. They are to address the following: . A description of the heritage character of the area and a statement of the conservation principles . Provide guidelines for alterations and additions to existing buildings . Provide for the conservation of heritage fabric and features . Outline landscape conservation guidelines for both public and private property, and . Provide planning and administrative guidelines for change in the area as a . whole, including public works undertaken by the municipality or other agencies 1.7 In September of 2002 Report PSD-091-02 was presented to Council recommending that the area bounded by the north side of Concession Street, the west side of Liberty Street, and the south side of Wellington Street be studied for its potential to become a heritage conservation district. The study area was enlarged by staff to include the south side of Wellington Street and the north side of Concession Street due to the number of listed heritage resources already identified in the Municipality's inventory. Council passed the study area by-law and staff prepared a terms of reference for consulting services to assist with the project. The consulting team of Martindale Planning Services, Unterman McPhail Associates and Barry-Bryan Associates (1991) Limited were engaged in January of 2003, to complete a heritage conservation district background study. 1.8 In researching the process for the study, many municipalities indicated that the establishment of a District Steering Committee would be instrumental in guiding the Municipality through the preparation of the background study. Therefore, a Committee was formed comprised of representatives of Municipal staff, the LACAC, the OBNA, and neighbourhood residents. The committee has assisted in reviewing and commenting on the development of the Background Study. While 620 .. REPORT NO.: PSD-055-04 PAGE 4 - the membership has changed as the study process has evolved, the District Steering Committee has provided significant insight into the issues residents would like addressed beyond the background study phase. It is anticipated. that the same committee would serve for the preparation of the Phase II Guidelines. 1.9 Public consultation is not a requirement of the Ontario Heritage Act but it is one of the key factors in creating a designated district that addresses the concerns and balances the desires of all of the property owners in the area. A number of meetings with the residents, mailings and other communications have been carried out as part of the process. Three open houses have been held during the background study and two newsletters' have been sent to the residents. In addition, numerous residents have written, called, e-mailed and attended meetings and the offices of the Planning Services Department to gain additional information and an understanding of the process and the potential pros and cons of designation. Opportunity has been provided for written comments at the open houses, through questionnaires and round table discussions. The newsletters to residents have been aimed at providing information on the process and responding to the questions raised by the residents at the open houses. The public input to date is detailed in the Heritage Conservation District Background Study. - ... .. .. .. .. .. 1.10 The Bowmanville Heritage Conservation District Background Study is now complete. The consultant team has concluded that from a historical, socio- economic and architectural perspective .....it can be stated without hesitation that the building stock in old Bowman viI/e., combined with the surrounding landscaping and streets, represents one of the finest examples in the province of a residential heritage conservation district." - - 1.11 The LACAC has been mandated under the Ontario Heritage Act to advise and assist Council on matters of heritage preservation. On March 16th the consultant team presented the Background Study to the LACAC with their recommendation that the project move on to the next step. There were members of the public in attendance at the meeting but they had not registered to speak. The LACAC, however, did listen to their concerns and agreed to hold a special meeting of the LACAC to hear public delegations before making their recommendation to Council. This meeting was held 'on March 30th. There were six delegations, three were strongly opposed, and three were in favour of moving on. The presentation made by the delegates indicated that there was dissention in the neighbourhood between opposing parties, and a lot of misinformation about the effects of proceeding with the preparation of guidelines. The LACAC did not make a recommendation to Council that evening. Instead the LACAC passed a motion that a separate meeting be held with the delegates, the LACAC Chair, staff and the local councillor to see if a consensus on how to proceed could be reached. This meeting was held on Apri/19th. As a result of the discussions that evening the LACAC passed the motion shown on Attachment 1 during their regular meeting on April 20th. - - - - .. .. .. 621 - - REPORT NO.: PSD-055-04 PAGE 5 - 1.12 Neighbourhood residents and stakeholders have asked whether there are other alternative means to achieving the goals of heritage protection and neighbourhoodenhancement. Suggestions of a more detailed zoning, site plan control and other alternatives can be examined as part of the second phase by staff. The by-law contained a three (3) year period within which the by-law remained in full force and effect, expiring on March 14,2004. The Owner has advised staff that transfer of ownership of the above noted lots did not take place before the by- law expired, hence the necessity for the current application. 3.0 COMMENTS 3.1 Attachment 3 is a Summary Table provided in accordance with the Region of Durham's requirements under the delegation of Part Lot Control. It details lots affected by the Part Lot Control By-law and the unit type and number to the Part Lot Control By-law. 3.2 The Finance Department has indicated that the taxes are up to date for the subject properties. 4.0 RECOMMENDATIONS 4.1 In accordance with Subsection 7.3 of Section 50' of the Planning Act, the By-law may provide a specified timeframe during which the By-law shall be in force. REPORT NO.: CSD-08-04 PAGE 2 .J .J .J .J .J .J j J j J j J j j j J j J J 1.0 BACKGROUND 1.1 At the April 26, 2004 meeting of Council, correspondence Item D-21 in reference to the Driftwood Theatre Group request for financial assistance was referred to the Community Services Department for consideration under the Municipal Grant Program. 2.0 COMMENTS 2.1 The Driftwood Theatre Group is a non-profit organization celebrating its 10th Anniversary season. The Group offers world-class professional theatre performances throughout the province. The group is made up almost entirely of students and volunteers. They perform primarily at outdoor community venues such as the Visual Arts Centre. Their admission fee is based on Pay-What-You- Can. There are four performances scheduled in Durham this season; Parkwood Estate in Oshawa, Trafalgar Castle in Whitby, Palmer Park in Port Perry; and, The Visual Arts Centre of Clarington. 2.2 The Driftwood Theatre Group is eligible for grant funding as their Head Office is located within the Region of Durham (Oshawa) and their service may be considered a direct benefit to the residents of Clarington. 2.3 Staff would note the request for funding was received as correspondence and is a general appeal for funding. As part of the criteria for funding is based on being a benefit to the residents of Clarington, the payment of the grant should not be processed until the completion of their performance at the Visual Arts Centre. 3.0 FINANCIAL 3.1 At the Council meeting of March 22, 2004, Council approved the 2004 Municipal Grant Report and allocated $64,900.00 in funding to support various initiatives presented by local community groups. The total grant funds identified in the 2004 Operating Budget is $76,000.00. A further amount of $500.00 was recently awarded to the Canadian Calendar Girls Inc. The balance remaining in the 2004 Grant Account is $10,600.00 to address future requests Council may receive throughout the year. Should Council approve the request for funding from the Driftwood Theatre Group, there are currently sufficient funds available for that purpose. Most not-for-profit theatres recuperate 50% of their costs through ticket sales. In its efforts to share theatre with many communities in an accessible fashion, Driftwood adds an even greater challenge to its financial burden. There is no fixed admission cost for Driftwood performances (a philosophical choice that the company refuses to part with). Jeremy explains, "The suggested contribution for a Driftwood performance is $12 per person. The average actual contribution is $5 per person (and sometimes as little as $3.50). The true value of each ticket is nearly $35 per person. What this means, essentially, is that our audience revenue accounts for less than 15% of our total annual budget." Newton Trelawney Property Management Services owns the townhouse complex located at 83, 87 and 91 Aspen Springs Drive in Bowmanville. The company wishes to hire Mr. Bruce Webster to perform the enforcement duties on site as they relate to Handicapped, Fire Route and Visitor Parking offences. Parkwood Village Condominium Corporation has approached the Municipality and requested that an officer from Securitas Canada be authorized to issue parking tickets on their property at 1651 to 1659 Nash Road, Courtice. The officer Securitas is proposing is JiIIJ. McMurter. In orderfor both Mr. Webster and Ms. McMurter to be able to perform these duties they must be appointed pursuant to the Police Services Act as Parking Enforcement Officers. Mr. Webster and Ms. McMurter are aware that once appointed they must attend at the Municipal Administrative Centre for training prior to commencing any enforcement duties. PAGE 2 OF 3 BACKGROUND AND COMMENT It has become obvious to the staff of the Clarington Animal Shelter that the necessity for the completion of an Adoption Application Form for Dogs and Cats by perspective animal adoptees has become crucial to the most efficient and safe operation of the animal shelter for the following reasons: · Pet adoptions impact neighbourhoods as well as families. All pets require a COMMITMENT, not just a purchase. · Most of the animals received by Clarington Animal Services are strays and therefore the past history of the animal is unknown to members of staff. The evaluation of the animal conducted by staff members during the 7 -day waiting period is the only available information about the animal. Animal Services staff have the expertise to direct potential owners to animals which are appropriate to their family situation, hopefully preventing bites arid neighbour conflicts. Staff members become familiar with the personality of the animal; i.e., which dogs are timid, which dogs are barkers and which dogs would require a lot of patience or a very experienced owner. Some pets require being the only pet- in the household. The approval of an Adoption Application for Dogs and Cats would be an important tool for staff members to make a good permanent match between the pet and the perspective owner. · There are presently owners who regularly lose dogs/cats or whose dogs/cats end up being killed on the road because the dogs/cats are allowed to run at large. The Adoption Application would allow staff members to refuse the adoption of another pet to these persons knowing the end result of another animal adoption. · There are presently owners of cats who allow their unaltered (unfixed) cats to run loose and breed. The Adoption Application would allow staff members to have some control with the cat overpopulation problem by being more selective of the perspective cat adoptees. · Staff members have encountered situations where a parent brings a child/children into the animal shelter to look at "cute little kittens" and the parent ends up being persuaded by the child to adopt a pet. An Adoption Application would alleviate this type of "impulse buying" of pets. · Some apartment dwellers have, in the past, insisted on adopting a large breed of dog or a dog which barks a lot. Shortly thereafter; complaints are received from their neighbours about the same dog. An Adoption Application would assist Staff with this type of problem. · Some persons who live at home with parents have adopted an animal without the prior consent of the parents. The parents end up bringing the animal back to the animal shelter because they do not want the animal. Staff has experienced people with young children adopting dogs/cats which, in their opinion, have a questionable temperament. When advised of this, some people choose to ignore the advice of staff members. Staff is greatly concerned about the safety of these children. Also, in some cases, the dog/cat ends up being returned to the animal shelter or "dumped" elsewhere when the parents realize that they have made a mistake by adopting this animal. An Adoption Application would help reduce these types of situations and more appropriately adhere to the requirements of Bill C-45. The following shelters presently use Adoption Applications: Oshawa Animal Services Durham Region Humane Society Shelter of Hope (Port Hope) Port Hope Humane Society PAW Animal Shelter in Whitby and Uxbridge/Scugog Animal Shelter do not use an Adoption Application form for their pet adoptions. In summary, Council's approval of an Adoption Application would allow staff members'the opportunity to refuse a particular adoption if, in their professional opinion, they conclude that the perspective adoptee and the animal are not a good match. ' The ultimate goal of the staff of the Clarington Animal Shelter is to provide the best possible service to the residents of Clarington as well as the best possible care to the animals by finding them compassionate and responsible owners. ~ L l.. k L. i ... , L L L ~. )I .. BACKGROUND AND COMMENT A request for proposal was advertised and issued to provide architectural services for the Brian McFarlane Hockey Museum. Subsequently, bids were received and tabulated as per schedule "A" attached. As stipulated in the proposal documents, proponents were evaluated based on the following criteria: . Previous experience designing similar projects and public buildings . Team experience . Key personnel . Price . Working knowledge in Clarington and Durham Region . Ability to complete projects in accordance with Schedule . Completeness of proposal . Approach to report . References As per the request for proposal document, the consultant selection would be made on the basis of the written proposal and a potential interview. Upon completion of the review by the selection committee, four firms, Totten Sims Hubicki Associates, Barry-Bryan Associates (1991) Ltd., Thomas Brown Architect Inc. and Unit a architecture Inc. were selected for an interview. After further review and analysis and based on the pricing submitted, and the evaluation criteria, and the interview process, it was unanimously agreed that Barry-Bryan Associates (1991) Ltd. be recommended for the project. In addition, the Request for Proposal emphasized specific museum design experience as part of the performance criteria. The Director of Finance has reviewed the funding requirements and concurs with the recommendation. The subject firm have successfully completed numerous projects for the Municipality of Clarington in recent years. Tenders were advertised in local papers, as well as the Municipal Web Site. Subsequently, tenders were received and tabulated as per Schedule. "A" attached. The funds for the demolition of these houses were not identified in the original property acquisition report or in the 2004 Capital Budget. It is therefore recommended that they be drawn from the General Capital Reserve Account # 100-000-2917. The Director of Finance has reviewed the funding requirements and concurs with the recommendation. Queries with respect to department needs, specifications, etc., should be referred to the Director of Operations. The low bidder has previously performed satisfactory work for the Municipality of Clarington. After further review and analysis of the bids by the Operations Department and Purchasing, it was mutually agreed that the low bidder, Hard-Co Construction Ltd. , Whitby, Ontario, be recommended for the contract for the Demolition Services.
